A growing group of Republicans want Attorney General Jeff Sessions to be the party's choice in the Alabama Senate race, but ethics experts say Sessions either would have to have to leave the Department of Justice or continually disavow campaigns to put him in the seat if he wants to run for the office and avoid legal trouble.This week Senate Majority Leader Mitch McConnell of Kentucky and Senate Majority Whip John Cornyn of Texas both said they would support Sessions as a write-in candidate over Republican candidate Roy Moore, who has been accused of pursuing sexual relationships with teenagers when he was in his 30s.Moore denies the allegations, and says he has no plans leave the race. And Sessions has not indicated that he's planning to run for his old seat.But ethics experts say that even if Sessions does not himself campaign to be a write-in candidate in the race, he could have an "affirmative duty" to disavow campaigns to put him in the Senate while he's still the attorney general. If he remains silent, he could be in violation of the Hatch Act, a 1939 law restricting the ability of most federal employees to engage in political campaign activities.Walter Shaub, a former director of the US Office of Government Ethics who's now at the nonprofit Campaign Legal Center, told CNN that the federal Office of Special Counsel has issued an advisory opinion on write-in candidates, which specifies:"(S)uch a candidacy is permissible only if spontaneous and accomplished without an employee's knowledge. You acknowledge that you have heard rumors of a write-in effort to elect you to the school board. It would be a violation of the Act if you encouraged this effort or remained silent. The Act imposes on you an affirmative duty to disavow this effort through public announcements and other appropriate means." It remains to be seen whether the OSC considers the comments by McConnell and Cornyn as imposing an "affirmative duty.""There's a question as to whether it's a write-in campaign or a stray comment from one guy," Shaub said following McConnell's comments. "If McConnell keeps talking about it, he's going to create an affirmative duty."Larry Noble, a senior director at the Campaign Legal Center who's a CNN contributor, said Republicans such as McConnell are "putting (Sessions) in a very difficult position" by even suggesting he be a write-in candidate."We are close to the line of his having to disavow," Noble added.For Sessions to be eligible as a write-in candidate, Noble said, he would have to "affirmatively disavow" any campaign or resign from office to avoid violating the Hatch Act.Sessions would likely be asked about his support for the write-in candidacy frequently until the December 12 election. Questions could also be raised about whether he was having private conversations about the effort with the state party and the Republican National Committee, which also would violate the Hatch Act.In response to a request for comment, Sarah Isgur Flores, director of public affairs for the Department of Justice, said, "Our ethics officials will need to evaluate precisely what has been said by others and then review what, if any, affirmative obligations we may have."Samuel Bagenstos, a University of Michigan Law School professor who specializes in constitutional litigation, noted that a few previous attorneys general -- including Dick Thornburgh and Robert Kennedy -- have campaigned for Senate seats, but neither were floated as write-in candidates."It's extremely suboptimal for an attorney general, who is supposed to have some insulation from electoral politics, to be actively running for a political office," Bagenstos said, adding, "And of course there would be lots of possible recusal questions."Aside from ethical considerations, running as a write-in candidate would be a long shot even if Sessions resigned.Few candidates have won Senate seats via write-in campaigns. Sen. Lisa Murkowski, R-Alaska, won her seat that way in 2010, but prior to her election the last person to do it was Strom Thurmond in 1954.However unlikely, a Sessions victory would serve two purposes for the GOP: The party would retain the seat, and Sessions would leave the DOJ after months of public criticism by President Donald Trump over his decision to recuse himself from the Russia investigation and not to prosecute Trump's political enemies. 4412

This took place in the area of Dana Peak Park on Stillhouse Hollow Lake, according to officials.His body was recovered on Sunday.Hernandezvargas’ awards and decorations include the National Defense Service Medal, Korean Defense Service Medal, Army Good Conduct Medal, Overseas Service Ribbon and the Army Service Ribbon.“The Black Knight family is heartbroken by the loss of Spc. Francisco Hernandezvargas. Our hearts go out to his family and friends during this difficult time,” said Lt. Col. Neil Armstrong, commander of 1st Bn. 5th Cav. Regt. “Spc. Hernandezvargas served his country honorably both stateside while at Fort Hood and abroad in Korea and Romania and this tragic loss is felt by every member within our formation.”The unit is cooperating with local authorities as this incident is currently under investigation.The drowning marks the fourth death of a Fort Hood soldier in the past few months. A jury wants James Fields, convicted of killing paralegal Heather Heyer during a white nationalist rally in Charlottesville, to serve life in prison on the murder charge, it decided Tuesday.They also recommended a 0,000 fine on the murder count. For the five counts of aggravated malicious wounding, the jury said Fields should receive 350 years and a 0,000 fine, and for the three counts of malicious wounding, he should get 60 years and a ,000 fine. For the final count of leaving the scene of the accident, the jury ruled Fields should be imprisoned for nine years.Fields looked straight ahead and gave no audible reaction as the verdict was read.Judge Richard Moore will formally sentence Fields on March 29 and can rubber stamp or overrule the jury's decision. Moore will also decide if the sentences will run concurrently or consecutively.Fields, 21, was attending last year's Unite the Right rally in Charlottesville when counterprotesters demonstrated against the white nationalists. That afternoon, Fields got in his Dodge Challenger and plowed into the counterprotesters at about 28 mph, killing the 32-year-old Heyer.The jury found Fields guilty of first-degree murder and the other counts Friday.In addition to the state charges, Fields also faces 30 federal hate crimes charges. The next step in his federal case is a January 31 status conference.On Monday, Susan Bro finally confronted her daughter's killer, presenting a victim impact statement. She told the court that her family members have attended therapy sessions "to push back the darkness."As for her own life, she said, it will never be the same. At one point, as she read her statement, she apologized to the court, saying it was difficult to read through her tears."Some days I can't do anything but sit and cry as the grief overtakes me," she said.One of the victims of the attack, Star Peterson, said Fields ran over her leg. Not only has it not healed, but "the metal holding my leg together has harbored one infection after the other," she said.Peterson called the last 16 months of her life a "nightmare" and said her 7-year-old son fears going out in public because someone might attack him.A University of Virginia psychologist, Daniel Murrie, who evaluated Fields before the trial, told the court that the 21-year-old had a history of mental illness and was on antipsychotic medication by age 6.He was hospitalized for mental illness when he was 7 and again when he was 15, Murrie said. He was diagnosed with schizoid personality disorder at 14. His father and both grandfathers, too, struggled with bipolar disorder, the doctor said, explaining that one of Fields' grandfathers killed his wife and himself."Mr. Fields did not come to Charlottesville in good mental health. In fact, he came to Charlottesville not having taken medication in two years," the defense attorney argued. "On August 12, he was a mentally compromised individual."Murrie determined that Fields was legally sane at the time of the attack, which is why the prosecution was able to proceed. 3063

  

A group of Pac-12 football players says it won't practice or play until its concerns about playing during the COVID-19 pandemic and other racial and economic issues in college sports are addressed. “We believe a football season under these conditions would be reckless and put us at needless risk,” the players said in their news release. “We will not play until there is real change that is acceptable to us.”The players posted a statement on The Players' Tribune website and on social media and sent out a news release. One of the players tells The Associated Press that more than 400 of his peers throughout the Pac-12 have been communicating about the issues they are raising. The players are concerned about the risks of COVID-19 and think the conference and NCAA lack transparency, uniformity and adequate enforcement infrastructure. The news release listed the names of 13 Pac-12 players, including Oregon star safety Jevon Holland.The NCAA has released guidelines for COVID-19 testing and other health and safety protocols to be used by schools, and Power Five conferences — the Pac-12, Big Ten, Big 12, ACC and SEC — are finalizing their own similar recommendations.The Pac-12 also announced Friday that 20 hours per week of mandatory team activities for football, including weight training, meetings and unpadded walk-through practices, will be permitted to begin Monday.
