SAN DIEGO (KGTV) - Local VFW posts are bracing for the new restrictions to kick-in on Saturday.The restrictions result from an increase in COVID-19 cases in the county, putting the county in the state's purple tier, the tier with the toughest covid-19 related restrictions.Mike Hill, the post commander at VFW 5985 in Pacific Beach, says they are already struggling to make ends meet during the pandemic because of the restrictions."There are 22 VFW posts and more American Legion posts through San Diego County, and all of us rely on having events and having people coming to our canteen, which is sort of military for a bar and spend money there, and that helps support us," Hill said. "We've eaten up most of our savings to pay the bills while we've been closed."He says they have relied on donations so far and will be needing more the longer the pandemic lasts."I will tell you the members, and I will be dialing for dollars," Hill said. He says they will start within their members first, then the community."We'll reach out to the community and hope that some of them will value this place that's been in the community for 90 years and let it still be a home for veterans to be around other veterans," he said.VFW 5985 has been closed most days except Tuesdays and Fridays to make meals for dozens of veterans, their families, and those who need it. SAN DIEGO (KGTV) - Memorial Day weekend will see the most travelers out and about than in the last 12 years.More than 41.5 million Americans will be traveling this weekend, a five percent jump from last year, according to AAA. The increase in nearly 2 million travelers also means longer delays. SAN DIEGO (KGTV) - It is an effort to remove guns from dangerous people and an aggressive strategy by the City Attorney's office to implement a law that has been in place since 2016. Since the beginning of the year, the City Attorney’s office obtained 25 gun restraining orders, affecting teenagers to senior citizens.  “I think we have opened people's eyes to the availability of a tool that works,” said City Attorney Mara Elliott. “I think we all recognize that there are some people that should not have a gun or access to a gun.” It's a push to use a law Elliott said is underutilized. Now, she's training law enforcement to use it more.  These civil restraining orders prohibit someone from having a gun or ammunition. Law enforcement or close family members can request it if they're afraid someone will hurt themselves or others. A temporary order is issued until a hearing for a permanent one takes place. “It's not the city attorney or the police department making the determination... ultimately it's somebody that's got no horse in the race... a judge,” Elliott said.  This law came after a 2014 murder spree near Santa Barbara. Elliot Rodger stabbed three young men to death, then shot and killed three others. His family reported mental health concerns before the shooting.  “In the past, we had to wait for a tragedy. We don't have to wait anymore,” Mara Elliott said.  The City Attorney's office represents law enforcement in court.  Those with these restraining orders range in age from 19 to 81. All were men, except one. About a quarter involved were either current or former military. A City Attorney spokesperson said these numbers do not include minors that were connected to school shooting threats.  Team 10 spoke to one man who received a restraining order against him. He agreed to talk to 10News if he was not identified. According to the man, a fight with his wife was the catalyst for the restraining order. He claimed that he did not threaten his wife. “No, we never had a violent thing. Just words,” the man said.  It was a different story in the court petition. It said his wife was afraid and that the 81-year-old threatened “to shoot her” and the neighbor. His son, according to documents, was worried his parents were losing their sanity. It also showed he was arrested several years ago for domestic violence, but the charges were dropped. Still, he called the restraining order against him unfair. “I think every case is different. It depends on people you’re dealing with,” he said, calling himself a safe gun owner.  That man’s guns are at the San Diego Police Department. Under this law, guns are surrendered to law enforcement. An individual could also store them or sell them to a licensed firearms dealer. A permanent restraining order lasts a year. It expires unless someone seeks an extension. “We’ve done a lot to try and calm the nerves of those concerned about their Second Amendment rights,” Elliott said.  “Conceptually, the idea of taking firearms from criminals or people that are mentally unfit is something we stand behind,” said Michael Schwartz with the San Diego County Gun Owners PAC.  However, he still had concerns after meeting with the City Attorney. “If they've already broken the law, then we can take firearms from criminals or people that are mentally unfit. If they haven't broken the law, then why are we taking firearms from them?” Schwartz asked. He is also concerned about the potential for abuse of this law. The City Attorney's office said orders are issued when it’s not clear when or if a person will be charged or someone hasn't been convicted yet and the public needs protection. “I'm hoping that it makes people feel safer and it saves lives and I'm convinced we've done that,” Elliott said.  Elliott said it is still too early to determine any kind of trend of those served with a restraining order. There is a proposal right now to expand this law, allowing co-workers and school employees to request these types of restraining orders. That is heading to the Senate.     4173

  

SAN DIEGO (KGTV) -- Investors say an Oceanside company that promised a green and environmentally friendly way for people to invest their money, instead left them with nothing.Team 10 has spoken to multiple people who said they invested with the Pacific Teak Reforestation Project, managed and developed by Pacific Management Group.On the company’s website, Ron Fleming is listed as PMG’s founder and chairman of the board. The website states the reforestation project “provides individuals, businesses, and institutions around the world with the opportunity to build their financial future, while saving one of the earth’s most precious and scarce natural habitats: the tropical rainforest.” The company said as the trees matured and grew larger, so did profits. The website stated that "in the time it takes teak trees to grow from seedlings to maturity--after only 15 full years of growth--[the] asset's value will likely increase as many as ten times based on historical price trends." Investors would then benefit from that profit.Mark Baker, who lives in Tucson, said he and Fleming grew up together and their mothers were best friends. In 2010, he invested ,000 of his retirement money into Pacific Teak.“That money to me was going to be part of my legacy to help my grandkids go to school,” Baker said.In 2014, he said he invested another 0,000. To this day, he said he has not received any return on that investment. “I’ve had to make a plan B for my retirement,” Baker said.Team 10 spoke to at least six people who invested with Pacific Teak. Their teak tree purchase agreements show the investors paid anywhere from nearly ,000 to nearly 0,000 for a teak tree project in Costa Rica.“It was a green investment... they were planting and they were redeveloping land that had been the victim of slash and burn techniques by the locals,” said Greg Robertson, another investor who currently lives in Rome, Italy.Robertson met Fleming on a flight in the late 1990s. “That developed into a friendship,” he said.He invested nearly ,000 in the project. “This was a very green project. It was long term,” he said. “It was all positives.”It was positive at first, but Robertson said it changed as time went on. “No monthly letters or annual business account letters... nothing. Zero,” Robertson said. “It was unusual.”Michael Tillman said he put in more than ,000 with Pacific Teak in early 2009. He has not received any money on his investment.“It’s just the stress of trying to figure out where I’m going to recoup this money to send my daughter to school,” Tillman said.Tillman said investors were given teak forecasters, which showed how much trees gained in value over the years. “So, I’m looking at the low end which is ,000... and I’m thinking, that’ll cover maybe a semester or two,” he said.Tilllman said he started to sense something was wrong a couple years ago when they stopped hearing from Fleming. Tillman got in contact with other investors, like Baker and Robertson, and discovered many people had not received any return on investment. “I’m already stressed out because for so long, I thought that it was taken care of,” Tillman said.Team 10 reached Fleming via email. He said he “resigned himself from executive position in Pacific Management Group the later part of 2013 due to health issues.” He also said that he left prior to Hurricane Otto in 2016, which he alleged caused catastrophic damage to the project.”The investors said they were not aware of Fleming’s retirement in 2013, as he never communicated that to them. The investors also said they were not informed of any hurricane damage until after they questioned Fleming for updates.“I was devastated. I never thought it was part of his character,” Baker said.A spokesperson with the Department of Business Oversight—which is now the California Department of Financial Protection and Innovation—said Fleming was not supposed to operate in California. The DBO issued a desist and refrain order in 2016. It said Pacific Teak and Pacific Management Group did not have the proper permit to be in business. In addition, the state found the company “misrepresented that investors would receive substantial profits.” It also found the company was in violation of the Corporate Securities Law. The state said Fleming and the company “misrepresented to investors this investment opportunity was low- risk.” Fleming never responded to Team 10’s follow up questions, only writing that he was “super busy” with his youngest daughter getting married.Fleming’s attorney contacted Team 10, telling me the “matter is complex and there are many unfounded rumors, along with misstatements, that have been circulating.“The fact is that Mr. Fleming has done nothing unethical in connection with his association with Pacific Management from which he resigned in 2013. I would request that you and your employer be very careful in what you publish in this matter,” wrote attorney Dominic Amorosa.He added in a separate email: "I am not sure whether you can find any investor in the United States who believes that an investment must necessarily be successful notwithstanding any foreseeable or unforeseeable events." The investors are still in disbelief about the turn of events and hope they will able to recoup some of their money. “He didn’t care about us at all, just about himself,” Robertson said.“He messed up so many lives. So many lives,” Baker added.Investors said they reported Fleming to the FBI. A spokesperson said they could not confirm or deny any investigation, but will take appropriate action if it is warranted. 5616

  

SAN DIEGO (KGTV) - Law enforcement agencies across San Diego Country will have extra officers stationed near busy railroad intersections this week as part of "Operation Clear Track. "The week-long enforcement ties into National Rail Safety Week, from Sept. 22-28.In Carlsbad, officers will be near Carlsbad Village Drive and Grand Avenue during the lunch hour, reminding people to only cross when there are no trains nearby."The goal is to raise railroad safety awareness through education and the enforcement of state railroad grade crossing and trespassing laws," the Carlsbad Police Department said in a statement.Amtrak officers will also keep an eye on well-known trouble spots along the coast, like a stretch in Del Mar where surfers and hikers frequently cross over tracks to get to the beach."It's not safe to cross here," said surfer Cooper Baker, who admitted he does it regularly. "But, if people have their wits about them and make good choices about where they're stepping, it's totally safe. So I just try to make sure I know a train is not going to be here and that my footing is sure. I think it's fine."A recent study found San Diego is the 9th deadliest county for accidental train casualties in the U.S. from 2013-2017. In that time, 44 people were killed while trying to cross tracks. Los Angeles County topped the list, with 110 deaths in that time."It's definitely good to give people a reminder that trains are coming through," said surfer Shayne Jensen. "You gotta be safe."In the last year, the North County Transit District has taken steps to make trains safer. In 2018, they equipped all of their trains with Positive Train Control, a new technology that automatically slows trains down if any danger is detected.Meanwhile, there have been calls in Del Mar for more railroad crossings to be built. Residents are asking for more options, so they're not tempted to cross illegally.
