SAN DIEGO (KGTV) — There is new frustration for San Diegans trying to cutback their spending amid coronavirus restrictions.Some companies are refusing to freeze automatic renewals despite being closed. That's leading to resentment as workers across the county face layoffs, furloughs and reduced hours. Amanda Sullivan, a mental health professional, says she's still being billed a month for her 24 Hour Fitness membership, despite the gym shuttered. 24 Hour Fitness promises instead to add the lost time to the end of her membership. "It feels like robbery," she said. "We're taking your money, you can't do anything about it, we're telling you this is what we're offering, we'll just tack on time at the end."Sullivan said her emails to 24 Hour Fitness have gone largely ignored, or she's received boilerplate responses. Meanwhile, 24 Hour Fitness has shuttered its call center. In a statement, the gym stood by its decision, noting it also made available its subscription app that includes exercise instruction."24 Hour Fitness is focused on the continued health and safety of our club members, team members and guests. With that in mind, we have made some difficult decisions to ensure our ability to provide services to our club members and sustain our business over the long term," the statement said.The coronavirus shutdowns have prompted a variety of responses from membership-based businesses.While 24 hour is billing as normal, other gyms, like CorePower, OrangeTheory and Chuze have frozen fees. LA Fitness will only keep billing if a club reopens in the San Diego market by April 1.The San Diego Zoo and SeaWorld say they will extend annual passes to make up for the lost time. Spokespeople for both parks say additional questions should be directed to customer service. Consumer attorney Frederick Schenk, of CaseyGerry, says each subscription contract is different but he says it's always worth a phone call to ask for a refund. "I'm finding that vendors are working with their customers to come to terms with this horrible dilemma," Schenk said. "We're all facing it, and we have to face it together. So if a vendor thinks that it's going to take advantage of its members it will find in the not-too-distant future it will have lost that member and many others."Michael Weiner, a consumer attorney with Slate Law Group, said it is difficult to analyze situations without seeing individual contracts, but in general a consumer would appear to be on strong legal footing if he or she is being billed for something they aren't getting. Weiner suggested reaching out to corporate, and posting on social media if things don't change. "If they were still rebuffed, there are multiple avenues to take, from hiring counsel to speak to the company on their behalf, to filing a complaint with the Consumer Financial Protection Bureau and the local San Diego Chamber of Commerce," Weiner said. SAN DIEGO (KGTV) — The San Diego Sheriff's Department says it has resumed conducting pre-pandemic evictions but continues to make that decision on a case-by-case basis.The department said in a statement that it served 12 evictions in July."The priority of enforcement focused on vacant locations or locations with reports of criminal activity. When possible, deputies conducted pre-eviction interviews and offered community resources to those who may need them at the pre-eviction interview and on the day of the lockout," SDSO's statement read.Of the 12 evictions last month, one was at a commercial property and 11 were at residential properties.Of the 11 properties, six were occupied and five were abandoned, SDSO said. In four of the six properties, deputies said criminal activities had taken place at the residences.At the fifth location, deputies say they found an elderly woman who was suffering from mental illness with health concerns and living with no heat or water. She was taken to a hospital.SDSO said the court order for the sixth location was about to expire so it had to be served.Last month, San Diego City Council leaders voted to extend a rent payback period on renters who have lost income due to COVID-19 until December 30. Renters are also required to follow the rules in leases, but landlords cannot evict a tenant for nonpayment due to COVID-19. 1380

SAN DIEGO (KGTV) - The San Diego Fire Marshall explained to 10News in an exclusive interview Wednesday why dozens of residents in a Little Italy apartment complex were trapped when a vandal flooded their stairwell.February 25th, around midnight residents heard the alarm go off, their only route of escape was to head to the stairs, but once they reached the bottom, they realized there was too much water to get out. When they climbed back up the stairs, they realized, they were locked in."It felt like a waterfall coming down on you," Resident Ryan Lange said."It was a freak accident," Fire Marshall Chief Doug Perry said the issue is the doors were supposed to unlock whenever an emergency alarm goes off. "When you're in an interior stair it's supposed to be openable from the egress side and ingress side without any special knowledge," Chief Perry said.Normally the locked hallway doors act as a way to protect residents from intruders. Chief Perry said the building management is being notified of the problem and given three options to fix it.Those are:-Install hardware on the doors so they unlock automatically when an alarm is triggered.-Install a button in the lobby so firefighters may unlock the doors during an emergency.-Install a phone on the 5th floor so anyone in the hallway can call a 24/7 service to unlock the doors remotely during an emergency.Chief Perry said the issue would've become apparent during their annual inspection, "we were right about the time frame where in the next two or three months we would've been in that building, we walk the whole building, check all the life safety stuff."So how did this fall through the cracks in the first place? The building's approved plans on file show the fire code was missed in the developing stages. "The onus is truly on the architect, because the arcitect is the design professional who knows these codes inside and out," Chief Perry said human error is always a concern.Thanks to Chief Perry, a fix is on the way or 1810 State Street. "Channel 10 should take credit for it because of the phone call that you made to me and got me involved with it," he said.If the building was one story taller it would have fallen under more strict codes and this would not have happened. SAN DIEGO (KGTV) -- The San Diego City Council has voted to tentatively approve a prohibition of electric scooters on the city’s boardwalks. The Council voted 5-4 Monday afternoon to approve the ban. The prohibition will include Mission Beach, Pacific Beach, Mission Bay Park Bayside Walk and the La Jolla Shores Boardwalk. Earlier this year, councilmembers voted for regulations on the dockless scooters. SAN DIEGO (KGTV) — The San Diego Sockers announced Saturday that former team and North American Soccer League executive Jack Daley has died.Daley, 82, died on March 7 at his San Diego home, the team said. A cause of death was not immediately released.From 1981 to 1984, Daley was a managing partner for the Sockers, and prior to that, general manager of the Toronto Metros from 1971 to 1973 and then NASL Seattle Sounders from 1974 to 1981.During his time in Seattle, he helped the team to its first two Soccer Bowl championship games and iconic players to the city, according to the Seattle Times. He's credited with helping cement the Sounders as a household name in Seattle, before the league folded. The Sounders name would be adopted as Seattle's Major League Soccer expansion team in 2007. 803
