(KGTV) — Officials have identified the bicyclist killed this week after being hit by a train in Carlsbad.Thursday night, 37-year-old Jason Holsinger was riding his bike on the sidewalk when he came to the Grand Avenue train intersection in downtown Carlsbad. The event is the largest rail safety law enforcement initiative in the U.S., running from Sept. 22 - 28.In 2017, the family of Patrick Terrin filed a lawsuit against the City of Carlsbad and BNSF Railway, arguing they "negligently, carelessly and wrongfully failed to properly warn persons crossing the railroad tracks."Terrin was killed in 2014 after a night of bar-hopping nearby with his sister and friends. He had crossed under the crossing arm bar before it was fully down, as the rest of the group waited. Despite begin several feet off the tracks, he was hit and killed.The family's lawyer says crossing arms only extend across traffic lanes, leaving sidewalks unmarked with no paint to warn pedestrians where to safely stand.To make the area safer, Carlsbad has approved construction on a trench along the tracks as a safety measure. According to police, Ian Bushee, 37, and Malissa James, 26, who are both transients, were arrested on the 4800 block of Park Drive Monday. Both are on probation in San Bernardino for residential burglary. Police say Bushee was arrested for homicide, burglary, conspiracy, auto theft and accessory after the fact. James was arrested for homicide, burglary, conspiracy and auto theft. “The Police Department shares the communities’ concern over such a tragic incident,” Police Chief Neil Gallucci said. “Our thoughts and prayers go out to the victim’s family.”The incident was reported at around 12:30 a.m. at a home in the 1800 block of Outrigger Lane, just north of the Agua Hedionda Lagoon, according to Carlsbad police.MUST-READ: Victims in deadly paragliding accident at Torrey Pines Gliderport identifiedPolice said the suspects broke into the home, and during the break-in, a woman in the house was stabbed. CAMDEN, N.J. (AP) — A gunman opened fire on two New Jersey police officers while they were sitting in their vehicle at a red light Tuesday night, wounding them in what authorities are calling an ambush attack.At least one suspect opened fire on the plainclothes detectives in Camden, which is located just across the Delaware River from Philadelphia, said Camden County Police Chief J. Scott Thomson."The information we have thus far is that they were essentially ambushed," Thomson told reporters at a late night news conference. "A male walked up and began opening fire. We have anywhere between 10 and 25 rounds that were fired at the officers."One of the detectives was able to return fire, Thomson said, but it was not immediately clear if anyone else was shot. (KGTV) - More than two and a half years after Team 10 first reported about a North County property management company accused of stealing money from clients, the victims are finally getting their money back.Kelley Zaun owned Carousel Properties, a Carlsbad property management company. Victims first told Team 10 in 2016, they hired her to pay fees associated with their rentals. They said she did not pay those fees. She was accused of taking roughly 0,000 from victims, according to investigators.In 2018, Zaun faced 29 felonies for embezzlement, according to Deputy District Attorney Anna Winn. Zaun entered into a plea deal and agreed to a year in custody. With the help of the DA’s office, Zaun’s former clients were able to get their money back through the Department of Real Estate’s Consumer Recovery Account. Other victims’ payments are still processing. They have been able to reimburse 2,084.68 thus far.The Consumer Recover Account is an option for fraud victims when trying to recoup money from the person who took it from them. In order to utilize the fund, Lerner said there must be a criminal or civil court order for the defendant to pay back money he or she took. If victims cannot get refunded from the person who stole it, they can apply through the Department of Real Estate (DRE).Winn said she volunteered to be the victims’ liaison with the DRE, as the process for reimbursement is lengthy and many of the victims were elderly. One of Zaun’s victims told Team 10 he is “extremely grateful” for the DA’s office work on this case. CARLSBAD, Calif. (KGTV) - California Pacific Airlines has canceled all of its January flights in and out of Carlsbad’s Palomar-McClellan Airport. The announcement came after the small airline had already canceled flights from December 21 through the end of the year. CPA launched in November with direct flights to Reno, Las Vegas, San Jose and Pheonix. It had been almost a decade in the making for founder Ted Vallas, who finally opened CPA after taking over a small airline with a fleet of four aging jets. But by December, the problems began. Two of the planes were taken out for repairs, creating several days of canceled flights. Operations resumed for about a week, but a few days before Christmas the cancellations began again causing passengers to scramble to find alternate routes. On Yelp, one reviewer wrote “They canceled my flight last night, and rebooked me to this morning. Then they canceled my flight this morning... on Christmas Eve!! Had to ditch this airline completely and booked a last minute Southwest flight.” Founder Ted Vallas told 10News that all canceled flights will be refunded. He said maintenance issues were still a lingering problem, but they ran into another issue as the holidays approached - a lack of pilots. Vallas said they recently let two of their pilots go. That coincided with two other crews leaving for higher paying seasonal jobs at major airlines. Without enough planes or pilots for all of their scheduled flights, they decided to cancel them across the board at Palomar-McClellan. Vallas told 10News, “Being a scheduled airline and dedicated to this community the North County, it would be better to notify people in advance that we have this pilot problem.” He said they are currently training more pilots and in the process of leasing new planes, but those won’t be available until at least February. Vallas says another one of their planes will be heading in for maintenance during their 30-day shutdown. Palomar-McClellan airport has had a history of failed airline ventures. The most recent was Cal Jet, which folded after less than a year of operations. But big changes are coming. Back in October, the county Board of Supervisors approved a plan to extend the runway, which could help make a business model for an airline more viable. For now, CPA continues to operate out of several other airports. Vallas vows to resume operations out of Carlsbad as soon as possible, but has not yet set a hard date. 2469
