SAN FRANCISCO (AP) — A federal judge in San Francisco is mulling the competency to stand trial of a Mexican man who shot and killed 32-year-old Kate Steinle. The 2015 shooting figured prominently in President Donald Trump’s run for the White House four years ago. The case against Jose Ines Garcia Zarate on federal gun charges has been pending since a judge raised “serious concerns” about Garcia Zarate's mental capacities back in January. Two doctors have diagnosed Garcia Zarate with schizophrenia and found him unfit to stand trial. The San Francisco Examiner reports that Garcia Zarate told the court Friday through a Spanish interpreter that he wanted to be sentenced to prison or deported back to Mexico. 720

SAN DIEGO (KGTV)- The high temperatures, dry brush, and low humidity are leading to elevated fire danger in San Diego County this week.Cal Fire San Diego is asking everyone to be prepared for the possibility of a wildfire igniting.“We depend on the public to be careful; we depend on the public to be prepared at a moment’s notice to evacuate,” said Cal Fire Captain, Isaac Sanchez.“The fact that the winds aren’t there, it does not help us sleep at night; we’re still very dry. San Diego (KGTV)- Family members of a man shot and killed by police in El Cerrito are demanding answers. Witnesses told police they saw the man swinging a shovel at officers before shots were fired. The family says the man had a mental illness. The aunt who called police Saturday night tells 10News she called 911 so officers could help get her nephew to a mental health facility. “We all call police for help,” says Grace Carolino. She says she’s still in disbelief that her cousin was shot and killed over the weekend. “It’s really bothering our family what happened because he’s not a threat.”Police said when they arrived at the home on Adelaide Avenue the man resisted arrest. Officers used a taser on the man. Witnesses say the man was swinging a shovel at police. Then another officer fired shots. “I can not imagine how the police officer used deadly force,” says brother Anthony Carolino. According to the District Attorney’s office, between 1993 and 2017, 79 percent of officer-involved shootings had some evidence of drug use or mental health concerns. Just last week, Governor Newsom signed a new law requiring officers to use every non-lethal option. But the Carolino family says that wasn’t the case over the weekend. “We have the taser; we have the pepper spray, we have the canine unit, we have a police negotiation team. Those things are not here.”The family says they are hoping this doesn’t happen to another family. 10News reached out to the San Diego Police Department to ask if they were aware of the man’s mental illness, the time frame of when the taser and gun were fired and how long officers were there before the shooting. SAN FRANCISCO — A California appeals court has upheld an order requiring Uber and Lyft to treat their California drivers as employees instead of independent contractors, less than two weeks before voters will be asked to exempt the ride-hailing giants from the state’s gig economy law. The two companies have more than 400,000 drivers in California alone. Treating Uber and Lyft drivers as employees would guarantee benefits such as overtime and sick leave.Uber and Lyft had appealed an August ruling by a San Francisco judge, but the appellate ruling found "no legal error" and allowed the earlier ruling to stand. The legal fight started after state lawmakers passed a law that says companies can classify workers as contractors only if they perform work "outside the usual course" of the company's business. Thursday's decision won’t have any immediate impact because it doesn’t take effect for at least 30 days, well after the Nov. 3 vote on Proposition 22.Uber and Lyft, along with DoorDash, have heavily bankrolled the ballot measure.Proposition 22 on the California ballot this fall asks voters to create a special designation for drivers of app-based companies to be excluded from the new state law. 1216
