Phil McMullin of the Orange Police Department.On Saturday morning, Corona police said Smith had relocated to a motel in that city, where he was being surveilled by law enforcement."Mr. Smith is not on any form of supervised release or required to register as a sex offender. Smith can move around without restrictions," Corona police said in a Twitter message.At 9:05 p.m. Saturday, Corona police tweeted: "A short time ago Cary decided to leave the City of Corona. Gavin Newsom asking for help researching why Smith was no longer required to register as a sex offender despite a conviction and requirement to do so in 1985.Newsom's office referred questions to the Department of State Hospitals. Ken August of the Department of State Hospitals said state and federal privacy laws prohibited the department from commenting.Smith appeared to be "very mild and passive" when McMullin spoke with him Thursday night.State and Orange County Health Care Agency officials referred Smith to the facility. Police warned the administrator of the facility about Smith's past, but he was accepted.Smith pleaded guilty in 1985 to a misdemeanor sex offense against a child, requiring him to register as a sex offender for the rest of his life, Spitzer said.However, in 2005, that requirement was lifted for an unknown reason, Spitzer said."We need to look into this and know why he is no longer a lifetime 290," Spitzer said, referring to the code in the law that requires sex offenders to register with authorities so they can be tracked."We believe he is a lifetime registrant," Spitzer said.In 2002, prosecutors attempted to charge Smith with sexual assaults on a 13-year-old, but the case was thrown out because of an issue with the statute of limitations, Spitzer said.Smith was committed to Patton State Hospital in San Bernardino in 1999 on a psychological hold when his wife gave a psychiatrist a letter her husband wrote that described sex acts he fantasized about on a 7-year-old boy in his neighborhood in Costa Mesa, according to prosecutors.The state kept him locked up in a state hospital under a civil commitment that concluded he was a danger to children, according to prosecutors. Under that law, he had the opportunity to seek release in a trial every six months.But during the hearings he has testified that he continues to fantasize about sexually assaulting and killing young boys, prosecutors said."He calls himself Mr. RTK," which stands for Rape, Torture, Kill, Spitzer said. "That's what I think has kept him in. He says, `If you don't cut off my penis and hands I will molest again.' "Spitzer said he has no real connection to the case because it was a civil commitment, but wanted to warn the public about the potential danger."It's just really upsetting and aggravating to me that one of the governor's departments released a guy who is such an aberration and outlier and it doesn't advise the public," Spitzer said."That's crazy to me. So the only thing I can do under the law is warn people and get his picture out there and build awareness of him, but I can't do much else."It was the county counsel's office that had the authority to object to Smith's release, but it was apparently not notified this time and the hold on him expired on Saturday, Steel and Spitzer said in their letter to Newsom.Spitzer said his office has been in touch with the state Attorney General's Office to determine why the sex offender registration requirement was lifted and whether it can be reinstated. 5848

TWENTYNINE PALMS, Calif. (KGTV) – After a Southern California Navy corpsman suddenly died this summer, his family has been trying to get answers for almost two months. This week, 10News has learned that 30-year-old HM3 Michael Vincent De Leon may have been killed by someone else.10News began looking into the case last week after his father, Jose De Leon, contacted 10News for help. 10News interviewed De Leon over Skype because he and the rest of the family live in Texas. De Leon says his son was stationed at the Twentynine Palms Marine Corps base in San Bernardino County. It was almost two months ago when De Leon says that he was visited by military officers who informed him that his son had died and an investigation was underway.“I gathered my emotions and asked them ‘why?’ or ‘what happened?’ but they couldn't give me anything,” De Leon tells 10News.Since then, the family says they've largely been kept in the dark, but this week 10News learned from a source with close military ties that the Naval Criminal Investigative Service (NCIS) has confirmed that Michael's death is now being investigated as a homicide. It’s a very different story than what De Leon says he was lead to believe in the hours just after learning of his son’s death when he says the word "suicide" came up from service members on-base.De Leon didn't believe it, claiming there was no history of depression or substance abuse. He says his son was happy and excited about an upcoming deployment.“He was an extrovert. He could walk into a room and make friends,” he told 10News with tears in his eyes.De Leon is a former television news photojournalist. Using his skills, he started his own investigation. This is what he says he learned just 48 hours later from a service member who is close to the case. De Leon tells 10News, “I begged him, ‘Just tell me, did Michael pull the trigger or did someone else?’ There was a long pause and he [replies], ‘Mr. De Leon, someone else pulled the trigger.’"De Leon says that other service members who knew his son said that his son was shot on-base at another corpsman's going-away party in the military housing area. A full week passed, but De Leon says there was still no word from the base about what happened.“It’s a bunch of bureaucrats that are not vested at all in the family,” he adds.He says after formally complaining he finally got a call from an agent with NCIS, which is handling the investigation. De Leon says the agent would only confirm that there was a shooting on-base at a housing unit with corpsmen present and a firearm was produced. It’s now seven weeks later and 10News has verified with our source that agents are officially treating this investigation not as a suicide, but as a homicide. It remains unknown as to whether it was accidental or intentional.10News directly asked NCIS and the base for comment. On Thursday afternoon, a spokesperson for the base sent 10News the following statement:"I spoke with a representative from the Provost Marshall's Office and he has confirmed that the incident is currently still under investigation so the information you inquire is unable to be released at this time. However, I was able to confirm that the base policy for securing firearms for those who live on/work at/visit the military housing area is that all firearms need to be in a secured location in the home and must be in a secure location in order to get a weapon onto base and when being transported to and from the home. Weapons must be registered on the installation. As far as Marines living in the barracks, their firearms need to be stored in a unit armory. It is actually an inspectable item and part of the unit armory policy. I apologize I do not have more information for you at this time. VERO BEACH, Fla. — It was around 9 in the morning, on Aug. 21 that Vero Beach police first became aware of Frank Cook."This guy parked his car in the middle of the road and took off running," one 911 caller said.Five more 911 callers would follow."Says his truck is out of gas, and his wife and kids are in danger at a school around the corner here," another caller said. "He's on something. He looks like he is about to die."Then, Cook ran into a Community Church and pre-school. "Community Pre-School here in Vero Beach. He's in the hallway in our main lobby. He's not well, he's not well," a caller said. "He's barefoot, he's delusional. He said there were people after him this morning. I'm not sure his children were actually here. He keeps grabbing at something in the back of his waist belt," another caller said.His children weren't there. When police caught up with Cook, after he ran a mile or two from the pre-school, Cook told them he had taken cocaine and an unknown substance.He asked them to check on his wife and children, screaming profanities, and telling officers, "If we don't go now, the samurai ninjas are going to kill my family."When told his children were OK, Cook responded, "What about my wife! She's probably been abducted."Incident reports show a witness at the pre-school noticed Frank Cook "was armed when he was inside the building yelling and causing a disturbance inside the hallway of the church building."The witness "stated that he could hear the subject yelling inside the building that "I am not here to shoot anyone" and shouting for his kids.  A receptionist added that Cook "kept trying to get into some of the classrooms," so "she had all the teachers in the nearby classrooms lock-down and asked the rest of the classrooms to do the same."Police did find a loaded gun with "one round in the chamber" in Cook's waistband, although reports say Cook "never displayed a firearm nor made any threats to hurt anyone."Pre-school loophole"You had this gentleman walking in with a gun. It was very unsafe for everyone, and it was legal for him to do that,"  Florida State Sen. Lori Berman said. She's right.Following the incident, Cook was only charged with resisting arrest because had a concealed carry license.The State Attorney's Office says under Florida law they couldn't consider gun charges because Cook can carry his gun into a pre-school.The concealed carry statute prevents a licensed owner from carrying into a secondary or elementary school. Pre-schools do not apply to the law. "Why is there a division between the younger children?" Berman said. "Especially after Parkland, we're all on heightened alert when anytime somebody goes into a school who doesn't belong there." Six years ago, Berman tried to make it illegal to bring a gun into any child care facility. The bill died.Berman says she's going to "look into the possibility of filing legislation to close the loopholes that currently exist."But Eric Friday, the general counsel for the Florida Carry Organization, doesn't think it's that simple. "There's nothing you can write into a new law that would have changed anything here or is going to prevent the next criminal," Friday said.Friday says there should be fewer gun-free zones."There's no reason why a person who is licensed to carry a concealed firearm is safe on the sidewalk outside of a school but suddenly a danger because they cross an imaginary boundary," Friday said.Berman disagrees. "It's something I'm going to continue to advocate for because I think it's crazy we have that distinction right now in our statutes. We don't want to send the message for people, yes it's legal for you to walk into a pre-school with a gun," Berman said.Currently, Frank Cook is legally barred from owning, possessing or purchasing a gun or ammo over the next 18 months. That's because he's on drug probation. Cook was arrested for possession of cocaine in June 2018.Also, while in a hospital emergency room, police said they saw Cook going through "drastic mood swings of anger, to sadness, and then to being calm as if coming down off narcotics."According to police records, Cook told them he "used cocaine every day for the past three years," "believed his house was "wiretapped" and that "helicopters flying to spy on him."Doctors decided to hold him, and police completed a risk protection order because "of multiple firearms at the residence." In early October, an Indian River County judge approved the risk protection order, barring Cook from owning, possessing, or purchasing a gun/ammo for the next 12 months.
