Three Democratic senators on Monday filed a lawsuit challenging the appointment of acting Attorney General Matt Whitaker, ratcheting up the court effort to declare his placement atop the Justice Department as unconstitutional.Sens. Richard Blumenthal of Connecticut, Sheldon Whitehouse of Rhode Island and Mazie Hirono of Hawaii filed the suit in US District Court on Monday, represented by the progressive public interest groups Protect Democracy and the Constitutional Accountability Center."The stakes are too high to allow the president to install an unconfirmed lackey to lead the Department of Justice — a lackey whose stated purpose, apparently, is undermining a major investigation into the president," Whitehouse said in a statement.The lawsuit is only the latest challenge to Whitaker's appointment to replace Jeff Sessions after President Donald Trump fired his attorney general the day after the election.Whitaker has come under fire from Democrats and others because he was a vocal critic of special counsel Robert Mueller's investigation before joining the Justice Department.He was serving as Sessions' chief of staff before Sessions was ousted, and has not gone through the Senate confirmation process in that role. His appointment leap-frogged Deputy Attorney General Rod Rosenstein, which also gave Whitaker control over the Mueller investigation that had previously been supervised by Rosenstein.Democrats had previously urged Whitaker to recuse himself from supervising the Mueller investigation, in addition to questioning the constitutionality of his appointment.Last week, the Justice Department issued a memo defending Whitaker's appointment, concluding that it was legally justified under the Vacancies Reform Act because it's a temporary appointment and "he had been serving in the Department of Justice at a sufficiently senior pay level for over a year."The Senate Democrats' lawsuit, however, argues that his appointment is unconstitutional under the Constitution's Appointments Clause requiring Senate confirmation of high-level federal appointees.In addition to the lawsuit filed Monday, Maryland's attorney general filed suit last week asking a federal judge to replace Whitaker with Rosenstein. Attorney Tom Goldstein, who is representing Maryland in that case, also filed a separate motion asking the Supreme Court to declare Rosenstein as acting attorney general.Whitaker has also come under scrutiny from House Democrats, who will take control of the chamber in January. Four expected committee chairmen sent letters to Whitaker and others asking for information about Whitaker's involvement in a company shuttered by the Federal Trade Commission, declaring they plan to investigate the matter next year.Trump said in an interview on "Fox News Sunday" that "it's going to be up to him" when asked if he would accept attempts by Whitaker to curtail the Mueller investigation. 2918

TOKYO — Shinzo Abe, Japan’s longest-serving prime minister, says he will resign because a chronic illness has resurfaced. Concerns about Abe’s health began this summer and grew this month when he visited a Tokyo hospital two weeks in a row for unspecified health checkups. Abe has acknowledged having ulcerative colitis since he was a teenager and has said the condition was controlled with treatment. Abe, whose term ends in September 2021, is expected to stay on until a new party leader is elected and formally approved by the parliament.Abe's resignation will mark the end of his second term. TIJUANA, Mexico (KGTV) — Health conditions continue deteriorating Friday in Tijuana where thousands of migrants are camping, contributing to the opening of a second shelter 45 minutes away.The new shelter in an area known as El Barretal has a roof, dry floor and can house 3,000 migrants, Rodolfo Olimpo, a representative from Baja California State's Special Committee on Migration Issues said. Friday, about a thousand were shuttled by bus to the new shelter. There are no lighting fixtures, but migrants are using portable lights as well as flashlights.In the first shelter, the floor is mud, puddles everywhere and the entire area is littered with junk. One man brushed his teeth over a muddy puddle.10News Reporter Laura Acevedo went to Tijuana Thursday and spoke with the migrants living in squalor. One woman from Honduras, Leida Reyes, told her she thinks this is better than what they lived with back home.She said she couldn't walk around freely without fear, her children never attended school because it was too dangerous.When asked about the President's hard stance on migrants, she said she thinks he'll have a change of heart when he understands they're coming from a country that they can no longer live in safely.Reyes has been in TJ for about 20 days and is waiting for her number to be called so her case for asylum can be processed.No one has stated how long either shelter will be in place. 1418

  

This pandemic holiday season, the last thing you need is too have your power disconnected.But Lisa Shook , who manages a home inspection company, recently got a call from someone claiming to be with their electric company."He said he was going to be in our driveway to cut off our services," she said.Shook handed the phone to owner Rob Wells, who was told he was behind on his bill, and would be cut off if he didn't pay immediately."He said we needed to pay 7 or they would disconnect the electric," Wells said, saying the man demanded a debit or credit card number.It sounded legit, as the caller knew the name of his business, and more.So this expert who normally inspects houses inspected his records, and realized he was not behind on his bill after all.But it may have been too late: Someone emptied his debit card a short time later."Everything got hacked, my credit card, everything," he said.It was all a scam. He is now working with his bank to repair the fraud charges.Easy to believe the caller's claimsLast year, one church almost lost ,000.Donald Kincaid is an Episcopal church groundskeeeper. He was shocked when he received a call from the power company claiming the church had fallen behind on its electric bill."The caller said that the gas and electric would be cut off in about a half an hour because the bill hadn't been paid," he said.The caller couldn't have been more clear. Unless the church paid the money immediately, workers would shut its power off.The caller said that to avert a shutoff, Kincaid needed to buy nearly ,000 in Green Dot Visa cards" and send it to them, giving them the number on the card."The church almost fell for the power disconnect scam, which targets homeowners, small businesses and now churches.Energy companies around the country remind customers that they will never call you threatening immediate disconnection.Duke Energy spokesman Lee Freedman says if you are behind on your bill, they will send you several notices first, and will never demand you pay immediately by debit or gift card.So hang up, and call your provider at the number on your bill, not the number the call came from.As always, don't waste your money.__________________Don't Waste Your Money" is a registered trademark of Scripps Media, Inc.
