SAN DIEGO (KGTV) - Law enforcement agencies across San Diego County must comply with a new law designed to increase transparency of police misconduct.Senate Bill 1421 requires departments to release records of officer-involved shootings and major uses of force, officer dishonesty and confirmed cases of sexual assault to the public.Earlier this year several police associations in San Diego County sued to block the release of records, arguing Senate Bill 1421 doesn’t contain any express provision or language requiring retro-activity or any clear indication that the legislature intended the statue to operate retroactively.They claimed the bill eliminates the longstanding statutory confidentiality of specified peace officer or custodial officer personnel records.In March a judge ruled the bill applies retroactively to all personnel records of peace officers not only now but before January 1, 2019.The Judge ruled no records could be released before March 29 giving the unions time to appeal if they want. It does not appear any have appealed.Some agencies tell 10News they plan to start releasing records this week.10News is still waiting to hear from other local agencies about when they are planning to release records. 1238

SAN DIEGO (KGTV) – Mexican authorities are investigating a gas explosion at an apartment complex that hospitalized at least three and displaced 150 people on Christmas Day.The explosion happened around noon at the Edificio Hipódromo located at 12609 Col. Alba Roja in Tijuana, one mile south of the stadium Estadio Caliente.This station’s Mexican media partner Televisa reports that the powerful blast caused damage to nearby homes and left debris strewn in the streets on opposite sides of the building.Images from the scene show several windows and glass doors blown out, and collapsed ceilings inside some apartment units.The three victims were described as a 2-year-old child and two adult females, ages 25 and 45. All three were transported by San Diego Fire Rescue to UCSD Medical Center in the United States with second-degree burns. Their conditions are unknown at this time.No other injuries were reported at this time.The explosion prompted evacuation orders at the Edificio Hipódromo and nearby homes displacing 150 people, according to Televisa. 1066

SAN DIEGO (KGTV) — ICE served four subpoenas to the San Diego Sheriff's Department (SDSO) Friday for information protected by sanctuary state policies regarding migrants arrested in San Diego.SDSO is required to protect the data under California's sanctuary state laws, which prohibits local law enforcement from cooperating with immigration detainers or requests for data concerning illegal immigrants."The public needs to be aware and concerned that California sanctuary state laws do not protect public safety and is bad public policy. Criminal aliens are being released back into the community daily and most will reoffend resulting in more victims, " said Gregory Archambeault, San Diego Field Office Director for ICE’s Enforcement and Removal Operations in San Diego.RELATED: US border agents to pursue migrants in 'sanctuary' citiesICE says it rarely uses subpoenas for information because most law enforcement agencies comply with requests for data on illegal immigrants that have been arrested.California passed its sanctuary state policy in 2017, preventing local agencies from complying with ICE's request. Friday's subpoenas are the agency's first issued in California."The Sheriff’s Department has received the subpoenas from ICE and is in the process of reviewing them. If able to, the Department will comply with the lawful requests in a timely manner," a statement from SDSO read.ICE is seeking information to the following cases:A 40-year-old Mexican national who was arrested in December by San Diego Police for continuing sexual abuse of a child, lewd and lascivious act of a child under fourteen years old, and oral copulation with a person under fourteen years old. ICE says the individual has two DUI convictions from 2009, has been returned to Mexico on eleven occasions between 2009 and 2011, and is currently in SDSO custody.A 42-year-old Mexican national who was arrested for first degree robbery by SDPD in November 2019. ICE says he has a prior conviction for possession of a controlled substance (methamphetamine) from 2013 and he was granted a voluntarily departure, but failed to leave the U.S. ICE says he has since been released back into the community.A 31-year-old Mexican national who was arrested by SDPD for battery of spouse and false imprisonment in December 2019. ICE says he has a prior conviction for a deceptive government identification from 2008 and that he's been removed from the U. S. three times between 2008 and 2010. ICE says he has since been released back into the community.A 28-year-old Mexican national who was arrested for assault with force, great bodily injury, child cruelty and battery of spouse by SDPD in January 2020. ICE says he was previously arrested in 2017 for battery on spouse by local law enforcement and was returned to Mexico multiple times in 2004 and in 2018. SAN DIEGO (KGTV) - Just after President Donald Trump addressed the nation about border security, Our Lady of Guadalupe Church in Barrio Logan held an event to recruit volunteers to help at asylum shelters. “The primary purpose was to let people know from a more personal perspective what’s taking place with the caravan,” said Father John Auther, pastor at Our Lady. The volunteers work with the San Diego Rapid Response Network to help the migrants who make it across the border.Several people who had volunteered in the past got up to speak about their experiences. “If I thought I was humble, it’s made me more humble. It’s rewarding,” said Martha Carriedo. She has volunteered for months at the shelter which is housed in an undisclosed location in San Diego. It serves as a temporary refuge for asylum seekers who have made it through the border legally but need help finding a way to meet with friends or family. Or if they don’t have any connections in the U.S., to find a sponsor or longer-term housing option while they wait for their asylum case to be heard.
