LOS ANGELES (CNS) - The captain of the Conception, a Santa Barbara- based dive boat that caught fire last year near Santa Cruz Island, resulting in the deaths of 33 passengers and one crew member, was indicted today by a federal grand jury in Los Angeles on 34 counts of seaman's manslaughter.Jerry Nehl Boylan, 67, of Santa Barbara, was named in the indictment that alleges Boylan, as the captain and master of the vessel, ``was responsible for the safety and security of the vessel, its crew, and its passengers.''Each of the 34 little-used seaman's manslaughter counts carries a penalty of up to 10 years in federal prison, according to the U.S. Attorney's Office.Federal prosecutors informed Boylan's attorneys of the indictment after it was filed, and the defendant is expected to self-surrender to federal authorities in the coming weeks.The indictment alleges that Boylan caused the deaths of 33 passengers and one crew member -- including two Santa Monica residents -- ``by his misconduct, negligence, and inattention to his duties.''Marybeth Guiney and Charles McIlvain, diving enthusiasts who lived in the same Santa Monica condominium complex, were among the nearly three dozen people trapped aboard the Conception when it sank amid a three-day Labor Day weekend diving trip to the Channel Islands.The indictment cites three specific safety violations: failing to have a night watch or roving patrol, which was required by the Code of FederalRegulations and for over 20 years was a requirement in the Conception's Certificate of Inspection issued by the U.S. Coast Guard; failing to conduct sufficient fire drills, which are mandated in the CFR; and failing to conduct sufficient crew training, which was also required by the CFR.The 75-foot, wood-and-fiberglass passenger vessel docked in Santa Barbara Harbor. On what would be its final voyage, the boat carried 33 passengers and six crew members.During the predawn hours of Sept. 2, 2019, a fire broke out while the boat was anchored in Platt's Harbor near Santa Cruz Island. The fire, which engulfed the boat and led to its sinking, resulted in the deaths of 34 people who had been sleeping below deck. Boylan was among five crew members who were able to escape.``As a result of the alleged failures of Captain Boylan to follow well- established safety rules, a pleasant holiday dive trip turned into a hellish nightmare as passengers and one crew member found themselves trapped in a fiery bunk room with no means of escape,'' said U.S. Attorney Nick Hanna.``The loss of life that day will forever impact the families of the 34 victims. With this indictment and our commitment to vigorously prosecute the case, we seek a small measure of justice for the victims and their loved ones.''The fire aboard the Conception is one of California's deadliest maritime disasters, prompting criminal and safety investigations. The families of victims have filed claims against the boat owners, Glen and Dana Fritzler and Truth Aquatics, and the Fritzlers and the company, in turn, filed a legal claim to shield them from damages under a maritime law that limits liability for vessel owners.The families' suits allege that the 41-year-old Conception was in blatant violation of numerous Coast Guard regulations, including failing to maintain an overnight ``roving'' safety watch and failure to provide a safemeans for storing and charging lithium-ion batteries, and that the below-decks passenger accommodations lacked emergency exits.``Nothing will ever replace the 34 lives that were lost in the Conception tragedy,'' said Special Agent in Charge Kelly S. Hoyle of the Coast Guard Investigative Service-Pacific Region. ``Our hearts remain with the families as the Coast Guard continues to work with our partners in the Department of Justice on this investigation.'' 3828

Authorities say Morgan at one point also took Lee from his Hollywood Hills home to a Beverly Hills condominium "where Morgan had more control over Lee."Lee's daughter said in a request for a restraining order last year that Morgan was manipulating the mentally declining Lee, preventing him from seeing family and friends, and trying to take control of his money and business affairs.Attorney Alex Kessel has said Morgan has never abused or taken advantage of Lee. Kessel said in an email on Saturday that he had been in contact with prosecutors to arrange for Morgan to surrender on Tuesday."It is unfortunate that the DA and police did not honor our commitment to surrender next week and arrested him," Kessel said in an email.Lee died in November at the age of 95.Morgan's bail has been set at 0,000. LOS ANGELES (AP) — The two Southern California desert communities rocked by last week's powerful earthquakes may have sustained as little damage as they did because they have no tall buildings and many of the homes in one are fairly new and were built to stricter earthquake standards.California's Seismic Safety Commission Chairman Michael Gardner said during the agency's Thursday meeting that the tallest building he knows of in the Mojave Desert towns of Ridgecrest and Trona is the three-story Ridgecrest hospital.The region was struck by a magnitude 6.4 earthquake on July 4, followed by a 7.1 temblor the next day.Ridgecrest, whose 28,000 residents include many who work at the nearby China Lake Naval Weapons Center, is about 150 miles (241.4 kilometers) east of Los Angeles.The nearby mining town of Trona, with a population of about 2,000, was harder hit. Commissioners noted many of its buildings are older.Authorities estimated the damage to both towns at about 0 million, although that could go up as buildings continue to be evaluated.Commissioner Kit Miyamoto said that as inspectors entered some buildings they discovered serious damage to ceilings and other areas that they couldn't see from the outside."Three buildings from the exterior appeared to be fine and probably safe for entry, but upon further investigation the roofs had actually collapsed," he said, adding inspectors may find others in that condition.Gardner said commissioners are also waiting for more information from the Naval base, where security is tight.Miyamoto noted that many of Ridgecrest's homes were built in the 1980s and '90s of more earthquake-resistant materials."As we know, newer California houses hold up really well," he said.That was not so much the case in Trona, where many fireplace chimneys collapsed and other damage was recorded.Buildings flooded when water heaters toppled over and ruptured gas lines sparked fires, and roads, highways and sidewalks also buckled.Trona also lost all of its water for several days when a pipeline carrying it from Ridgecrest ruptured. It was restored Thursday, but San Bernardino County spokesman David Wert said a "boil order" remains in place while water lines are being flushed. Meanwhile, free water was being distributed to residents.Other utilities to both towns have been restored, and Gardner said a local assistance center opened in Ridgecrest on Thursday.The commission itself plans to meet in Ridgecrest next month.No one in the area was killed, although authorities believe the quake may have taken the life of a man in the small Nevada town of Pahrump, 180 miles (289.7 kilometers) away.Troy Ray, 55, of Pahrump was killed when his jack slipped as he was working underneath his car. The shaking from one of the quakes felt from Las Vegas to Los Angeles might have caused the jack to slip, although authorities noted they couldn't be sure.Separately Thursday, California Insurance Commissioner Ricardo Lara and California Earthquake Authority CEO Glenn Pomeroy urged residents statewide to consider buying earthquake insurance that they said could be tailored to meet homeowners' and renters' individual needs and pocketbooks.Contrary to some reports, they said the insurance is available everywhere in California. LOS ANGELES (AP) — California’s plan to safely reopen its economy will begin to require counties to bring down coronavirus infection rates in disadvantaged communities that have been harder hit by the pandemic. The complex new rules announced late Wednesday set in place an “equity metric.” It will force larger counties to control the spread of COVID-19 in areas where Black, Latino and Pacific Islander groups have suffered a disproportionate share of the cases because of a variety of socioeconomic factors. The equity measure will require that positive test rates in its most disadvantaged neighborhoods, where rates are often much higher, do not significantly lag behind the county overall.Health officials in San Diego, Orange and San Francisco counties said they already have been targeting vulnerable communities with testing for the virus, providing interpreters and taking other measures to address inequality.Supporters of a more rapid reopening criticized the measure. 988
