SAN DIEGO (KGTV) - A local business owner is warning others about a phony debt restructuring company that he said cost him thousands of dollars.Hugh Herrera owns Pacific Beach Vinyl."What we're selling is music, which is one of the uplifting things of life," Herrera said.A couple years ago, Herrera needed help managing his debt with the business. After a situation with a lender, he eventually turned to what he thought was a legitimate debt restructuring company. He received a solicitation in the mail and gave the company a call."It sounded like something viable to me," Herrera said.He started working with Corporate Restructure, Inc. He said he paid about 0 a week."In the end, the net result, we'd pay about half of whatever we owed through making weekly payments to this firm," Herrera said.  Instead, Herrera said Corporate Restructure took about ,000 and ran."They just disappeared. Couldn't get a hold of them," Herrera said.According to news releases from the Department of Justice in New York, the men behind Corporate restructure faced dozens of charges related to bank and mail fraud. The news release dated late last year said there were approximately 200 victims that lost a total of .2 million."Somebody should really look out for predatory-type people, obviously, because that's what happened to us," Herrera said.He is now working to pay off his existing debt after he learned an expensive lesson."Things are looking better. He has hopes of getting some of his money back after the criminal proceedings in his case are finished.The Federal Trade Commission recommends people to contact creditors directly for assistance with debt. SAN DIEGO (KGTV) - A large group of city leaders, hotel workers, homeless service providers and community members gathered Thursday outside the Hilton San Diego Gaslamp Quarter to show support for the Yes! For a Better San Diego initative.The initiative, which will appear on the March ballot, has bipartisan support and seeks to address the city's homelessness issues, street repairs and job creation with a hotel tax increase. Supporters say the initiative would generate 7 million in the first five years. According to San Diego Mayor Kevin Faulconer, the highest hotel tax increase would be in downtown San Diego at 3.2 percent, with 2.25 percent for hotels on the outskirts of downtown and 1.25 percent for hotels on the outskirts of the city.San Diego's current transient occupancy tax is 10.5 percent."It's not only about the thousands of jobs that you just heard, the infrastructure and the roads, the most important issue that is facing our city the issue of homelessness and for the first time a dedicated funding stream," said Faulconer.He said the initiative would also expand the San Diego Convention Center and create 7,000 new jobs.Some tourists tell 10News raising the hotel tax could backfire and make some visitors simply stop coming to San Diego on vacation."It probably means I'll choose somewhere else next time I travel, somewhere more affordable for me," said one tourist who did not want to be identified."I definitely think it's important to deal with the homeless population and expand your economy, but I don't think that should happen with your tourism dollars. SAN DIEGO (KGTV) -- A pillar to the community and a San Diego civic icon Reverend George Walker Smith has died at 91. For six decades, Rev. Smith was a trailblazing leader in the African American community. Smith also led Christ United Presbyterian Church of San Diego for decades. Those who were lucky enough to cross paths with him say he was kind to all. "We kind of thought of Rev. Smith as the black godfather of San Diego, and of this church, because he helped so many people," said Delores McNeely, a church member of 30 years. He was the first African American to be elected in the city when he won the race for the San Diego Board of Education in 1963. Rev. Smith started the Catfish Club, whose weekly lunches were a gathering spot for those interested in civic or political issues. "All the political leaders in the community came, and we had this huge forum, and they listened to him. And if something were going on in the community, the first person that they would call was Rev. Smith," said McNeely.McNeely says the forums started at the church but then moved to Channel 10 when attendance got too large. "His legacy is going to help the community to grow, everything he did, and wanted to do," said McNeely.Members of the congregation spoke to 10News Sunday. "He was a person who would never say no to anyone if you asked him to do. If he couldn't do it, he found someone who could," Jewel Kelley, a member of the church said. Rev. SAN DIEGO (KGTV) - A Los Angeles area man says the San Diego County District Attorney's office charged him with a crime he didn't commit.Angel Galvan says the mistake cost him money, time and when you search his name at the courthouse a court file."For me to go through all of this, it hurt a lot," said Angel Galvan.Galvan says in July of this year, he received a letter from the San Diego County District Attorney saying he'd been charged with Grand Theft of Personal Property from Go Wireless. He thought it was a mail scam."What is PC 487," Galvan said.It was no scam.Galvan says the district attorney's office claimed he and other people were using stolen credit cards to buy merchandise from a Go Wireless location in the San Diego area."I hope you realize I live in the valley (San Fernando) like I don't live nowhere near San Diego," Galvan said.Galvan lives in Panorama City, that's in Los Angeles County, about two and a half hours from San Diego.Galvan says he did work at a Go Wireless store near his home, but for only two months, and that was back in 2017. The alleged crime happened in March of 2018."Every day I got home, I was stressed," Galvan said. "I couldn't believe it," he said.According to a claim, Galvan filed with the County of San Diego, "It turns out that another individual named Angel Galvan worked at Go Wireless, but worked in San Diego, committing crimes."Team 10 obtained an email sent by a San Diego County Deputy District Attorney in August of 2019 to Galvan's criminal attorney acknowledging he was not the correct Angel Galvan.The email stated, "HR at Go Wireless mixed him up with another Angel Galvan. I will calendar a dismissal asap. Sorry for the mix-up.""No one called him, no one looked to see if it was the right person, no one checked his address no one checked his work records," said Galvan's civil attorney Alex Ozols.Ozols claims the District Attorney's office did not do any further investigation after receiving Galvan's information from Go Wireless, and that's a problem."A lot of time, they do get it right, and we appreciate that they are representing the state of California," Ozols said. "However, when they get it wrong, the repercussions are just so bad when they do, and in this case, they did."Galvan tells 10News he had to sell his truck to pay the legal fees. He also had to drive to San Diego for an arraignment where he was order to do a book and release. He says he was fingerprinted and had his DNA taken.According to the claim, "He will/does have this listed on his Department of Justice print out, he is still in the police system, an arrest records still exists, and his DNA was taken against his 4th amendment constitutional right because he was charged with a felony."Galvan says he lived in constant fear he'd go to jail, and his son would grow up without a father."I work 50-60-hour weeks. I barely even see my son now, and the last thing I wanted to do was go to jail and not be able to see him at all," Galvan said.Galvan said when the case was finally dismissed there was a wave of emotion."It hurts a lot because of everything I went through," he said.Both the San Diego County District Attorney's office and Go Wireless said they couldn't comment on pending litigation.Galvan's attorney tells 10News the County of San Diego rejected the legal claim, and they do plan to file a lawsuit.Court records show there is an ongoing court case involving another person named Angel Galvan. 10News tried to track that person down was unable to speak with anyone. 3540
