SAN DIEGO (KGTV) — The family of a Navy sailor nearly killed in Syria is starting the new year with one less challenge.Over a year ago Navy EOD Tech Kenton Stacy was left paralyzed after an IED explosion. As Stacy was recovering in San Diego, renters were destroying the family’s Virginia home. “Just with everything we’re going through, it added stress. I just couldn’t believe how someone could damage our home and be okay with it,” said Kenton’s wife Lindsey.The home reeked of cigarettes, and the carpet, walls, and blinds were destroyed. When the EOD community in Virginia learned what happened in November they began to make repairs on the home.Julie Fish, a real estate agent with Signature Realty Select, also stepped in to help, taking over as the realtor.After reaching out for more help, people around the country offered money, time, services and resources. “These guys are...it’s like a brotherhood, there’s nothing they wouldn’t do for one another, and I like to think the wives are the same way,” said Fish, whose husband is also a Navy EOD Tech. SAN DIEGO (KGTV) - The City of San Diego released Friday body-worn camera video and hundreds of pages of documents related to a 2018 officer-involved shooting. Raul Rivera was shot and killed by police on Hollister Street and Tocayo Avenue in May 2018 after police say he came at them with a knife. The new documents show police collected 28 9mm cartridge casings, nine bean bag cartridge casings, and four Taser cartridges from the scene. At one point, the video shows police tasing Rivera. He appears to rip off the barbs and continued to struggle. After several minutes, the violent scene comes to an end when police shoot and kill Rivera. They say he charged them with a knife. The San Diego County District Attorney's office did not bring charges against any of the three officers who fired.The report noted, "law enforcement officers were confronted by an agitated subject who was armed with a knife and was under the influence of narcotics. Mr. Rivera urged officers to shoot him as he advanced toward them."  At the time of the shooting, family members told 10News Rivera was in a bad mental state and wished the police had helped him, not hurt him. On Friday Rivera's sister told Team 10 investigator Adam Racusin she was too shaken to talk about the loss of her brother. SAN DIEGO (KGTV) - The Downtown Central Courthouse plans to resume jury trials in two weeks after a six-month postponement during the shutdown, but there are concerns about the massive backlog of cases and keeping jurors safe. Non-jury trials are currently in progress through a remote virtual process.“I do have an incredible backlog, not only in criminal but also in civil cases,” said San Diego Superior Court Presiding Judge Lorna Alksne on Monday. So far, 900 jury duty summonses have been sent out for telephonic standby for in-person appearances in groups of 70 people. “The jury lounge [holds] 500 to 600 people but instead of that were going to bring in 70 [people and] socially distance them,” she added.Those people who are selected for jury will sit in courtrooms which have been retrofitted with protective measures like plexiglass barriers. Judge Alksne said there around about 2,400 criminal cases ready for trial that must be reset. Beyond that, there are thousands of other criminal proceedings to get to. “There's about 17,000 other things that need to be reset before they can even get to a trial,” she added.Civil cases are another obstacle. A spokesperson for the Courthouse confirmed that there are approximately 54,000 civil cases that are pending. There are about 2,800 that are ready to go to trial but Judge Alksne said Monday that civil jury trials likely won't resume until sometime in 2021.“The only way that I'm going to beat this backlog is if jurors come in for jury service so if you feel like you're able to serve, we would ask you to respond to the summons and come into court and help us get the jury trials started again,” she added.She noted that civil bench trials will start in mid-October and in-person arraignments will start on November 1st. 1792

SAN DIEGO (KGTV) — The family of 19-year-old Dylan Hernandez, the San Diego State University (SDSU) freshman who died after falling off a bunk bed last November, say they are concerned about the investigation conducted by Campus Police and the University. The family believes the University Police Department is not pursuing certain angles, including a possible cover-up.Last November, Dylan Hernandez died after attending a Phi Gamma Delta fraternity party. In police reports obtained by the San Diego Union-Tribune, the freshman made it back to his dorm room around midnight. On the morning of Nov. 7, 2019, he fell off the top bunk bed and hit his head. An autopsy concluded that Hernandez had fractured his skull, suffering from a brain bleed that ultimately led to his accidental death. Reports also state that his blood-alcohol level was about 0.23, nearly three times the legal limit. RELATED: San Diego State suspends 14 fraternities after student is hospitalizedIn a newly released statement to 10News, the Florida native's family said they are disturbed at how poorly Campus Police and San Diego State are handling the investigation. "The Hernandez family is concerned because witnesses they provided to SDSU and UPD still have not been questioned," George Kindley, Hernandez family lawyer, said. The same University Police reports state that UPD never interviewed anybody from the Phi Gamma Delta fraternity. They also never sought out search warrants for Snapchat videos or phone records, despite knowing that some fraternity brothers instructed others to delete possibly incriminating videos and messages. According to the report, one of those messages read, "Remember, silence is golden."This was a shocking revelation to the family. "The Hernandez family also told 10News they are questioning the SDSU's bunk bed safety enforcement. SAN DIEGO (KGTV) -- The 21-year-old killed while driving across the trolley tracks near Encanto has been identified.The San Diego County Medical Examiner says Alex Garza, 21, was believed to be distracted, possibly on the phone, when he reportedly tried to drive his Toyota Prius across the tracks just before midnight at 60th Street and Imperial Avenue. The vehicle was struck by a trolley before it became pinned against a poll.San Diego Police and fire units responded to the scene where Garza was pronounced dead. 525
