However, if that article is posted on social media and spread to hundreds of thousands of people, the person can only sue the individual who posted the article and cannot hold the social media company responsible for spreading the article.The wording of Section 230 also allows internet companies, and more specifically social platforms, to moderate their content by removing or censoring posts that are obscene, violent or otherwise violate that specific platform’s terms of service and standards, so long as the social platform is acting in “Good Samaritan’ blocking” of harmful content.This has allowed online social platforms to grow and thrive, offering a space for users to share their thoughts and opinions, without the fear that those thoughts and opinions will get the platform in trouble. The wording for Section 230 came from established case law, including a Supreme Court ruling in the middle part of the 20th Century, which held that bookstore owners cannot be held liable for selling books containing what some might consider obscene content. The Supreme Court said it would create a “chilling effect” if someone was held responsible for someone else’s content.“Today it protects both from liability for user posts as well as liability for any clams for moderating content,” said Jeff Kosseff, who wrote a book about Section 230 and how it created the internet as it is today.President Donald Trump in May signed an executive order that would clarify the scope of the immunity internet companies receive under Section 230.“Online platforms are engaging in selective censorship that is harming our national discourse,” the order reads.One of the issues raised in the executive order is the question of when does a social platform become a so-called “publisher” by making editorial decisions about the content on the platform. Those decisions include controlling the content allowed on the platform, what gets censored, and creating algorithms that spread certain content further or faster.Content publishers are held to different rules and responsibilities by the Federal Communications Commission. News publishers can be held liable for the content they share on their platform, either in print or online.The president’s executive order came after Twitter started adding a fact-check warning to his tweets that contain false or misleading information. The executive order does not allow the president to change the law, but rather encourages his administration to take a look at Section 230.Lawmakers on both sides have concerns about how social platforms are abusing the protection they receive under Section 230, and have held several committee meetings.Many experts agree Section 230 cannot just be removed.If social platforms are suddenly held responsible for the content on their sites, there could be a whole new level of moderation and censorship as they clamp down on anything remotely controversial and unproven - possibly including some of the president’s own posts.Instead, lawmakers are investigating what changes, if any, could be made to Section 230 to offer clarity for both users and internet companies, as well as set boundaries for potential liability. 4178

ENCINITAS (CNS) - A woman is dead today after being struck and killed by a vehicle in Encinitas, authorities said.At 8 p.m. Saturday, the victim, in her 50s, was hit by a vehicle traveling northbound on the 2600 block of South Coast (101) Highway, according to the San Diego Sheriff's Department.``The driver of the involved vehicle stopped immediately and remained at the scene of the collision,'' said Sgt. Jeffrey Houser, with the NorthCoastal Station. ``The driver and nearby bystanders rendered medical aid to the injured pedestrian.''The pedestrian was transported by ambulance to a nearby hospital where she was pronounced dead.Drugs or alcohol are not suspected to be factors in the collision. The driver is cooperating with investigators, according to the sheriff's department.Anyone who may have witnessed the crash is asked to call the department at 858-565-5200. 882

Family members of a Tennessee woman accused of ramming a security barrier at the White House said she is mentally ill and needs treatment.Jessica Ford went before a judge Thursday after police in Washington, DC said she plowed into the White House fencing and was immediately taken into custody by the Secret Service.It was Ford's fourth and most dramatic effort to gain access to the White House in recent months. She was charged with three felonies.The question of why Ford did what she did was no mystery. Her family said she suffers from a mental illness and that they actually warned the Secret Service last week that Ford, armed with a BB gun, was again headed for the White House.The 35-year-old insists her children live in the White House, and told the judge in court that her fiance is the President. "She is very delusional. She thinks her children are in the White House. That's why she keeps going up there," said Victoria Walls, Fords' cousin.In Ford's most recent attempt to get to the White House, she thought it was the holiday season."She decided when she left (last week) it was Christmas Eve, and I got to be there by Christmas Day," said her mother Alice Wilson. Authorities were watching for Ford since her family called to warn them that she was in route with plans to ram a gate."I said you can't go do that. They will kill you," said Walls.Ford still went and the Secret Service was waiting."I think that's the reason they didn't kill her, because they knew she was coming and knew she had a BB gun," said Wilson.Ford faces felonies and possibly years in prison."Oh, I love her with all my heart," said Wilson. She said her daughter needs help. This isn't the revolving door that welcomes customers into local restaurants, it's the state's rules on indoor dining that is worrying business owners."It's devastating thinking that we might have to close again," Charlie's Family Restaurant owner, Suzan Meleka said. "I haven't slept in two nights."When the quarantine began in mid-March, the 28-year-old Escondido diner had to shut its doors. Meleka said they tried take-out. But as a traditional sit-down diner, it just wasn't for them.Then came the good news on May 21, 2020. With temperature checks, new cleaning, social distancing protocols in place, Charlie's reopened, and their loyal regulars came back."The food is great, the prices are great, the atmosphere is great!" one customer said."It's like a family here," said another."We were worried that a lot of them might forget about us because we were closed for two and a half months," Meleka said. "So they've just been wonderful. They are glad to be back to some sort of normalcy."But that normalcy did not last too long for diners in 19 California counties on the state's watch list. On July 1, 2020, Governor Gavin Newsom declared that every restaurant in counties surrounding San Diego had to again, stop serving food indoors. So far, San Diego is clear from that list. But Meleka is worried we are next."I think if restaurants are following every single protocol, they shouldn't be penalized," Meleka said.Compared to their large dining hall and banquet room for overflow, Charlie's only has four outdoor tables. ESCONDIDO, Calif. (KGTV) -- San Diego County’s largest ice-skating facility is closing for good.Officials with Ice-Plex Escondido announced Thursday that the facility, located on 555 N. Tulip St., is shutting down effective immediately.Since 1995, Ice-Plex was a destination for San Diegans looking for a place to ice skate or play hockey. The facility, with its two Olympic-sized ice rinks, offered classes and public ice skating sessions that ran 7 days a week.In a statement on their website, Ice-Plex officials said, “This was not an easy decision. Our hockey and skating communities have been strong partners to us throughout the years, and we have worked hard over the last few months to find an alternative way to keep the facility open. Unfortunately, that solution has not emerged.”Officials said the facility has been operating “at a substantial loss” in the past few years, and they’ve struggled to maintain the equipment and other systems needed to keep the facility running.The pandemic-related closure also affected the facility’s ability to stay afloat, and despite numerous efforts, officials could not find ways to keep the Ice-Plex open.“We close our doors with a heavy heart and would like to extend our deepest thanks to our athletes, customers, staff and volunteers, who have been responsible for creating a welcome and competitive environment at Ice-Plex.
