(KGTV) — East County residents say they're behind a local dog rescue's efforts to provide for canines, but that the facility has been operating dangerously.Suzy Avalos lives next door to the Happy Hearts German Shepherd Rescue, which is run out of a La Mesa home. She tells 10News the dogs that reside in the yard have had no problem jumping the fence."You see the fence is not high. It's right up here. The dogs don't have a problem jumping over this fence," Avalos said. "I've lived here for 10 years and it's just progressively getting worse."RELATED: Disease fatal to dogs that can spread to humans on the rise in some statesWhen the dogs escape they can also be aggressive, neighbors say, with at least one dangerous incident being recorded. 10News obtained records from the La Mesa Police Department showing at least 28 instances where officers responded to the dog rescue to help round up escaped canines or help people who say they were attacked by the dogs."We have a lot of people on this street that have young kids and I'm just worried a child is going to get bit or something worse is going to happen," Avalos said. "They're out of control and she should not have a license."The woman who runs the dog rescue, Donna, declined an interview by 10News. Legislation requiring shoppers to wear masks in New Jersey stores is one step closer to becoming law.A bill proposed by state Democratic lawmakers got the stamp of approval from a New Jersey Assembly committee Thursday.If passed, customers could be fined between and 0 for being in a business without a mask that covers the nose and mouth. The bill would apply to any store that has posted signage saying masks are required.Assembly Democrats who backed the bill called the legislation "a matter of life and death" and said there needs to be a penalty for those who don't do their part to prevent the spread of the coronavirus.Republican lawmakers called the bill ludicrous and an attack on residents' civil liberties.Some suggested a better policy would be for businesses to refuse to serve customers who choose not to wear masks.Hoboken, New Jersey tried to pass a similar mask ordinance in August, attempting to fine people 0 for not wearing a mask in any place where social distancing was not possible. It ultimately did not pass.In New York City, MTA riders can now be fined for refusing to wear a mask on buses, subways and trains.As of midnight in Connecticut, anyone can now be fined 0 for violating mask and social distancing orders. (KGTV) - A wellness center in La Mesa is accused of misleading patients by illegally marketing a breast cancer screening device, according to the Food & Drug Administration (FDA).This week, the FDA issued a formal warning to Total Thermal Imaging Inc. and its president and co-owner, Linda Hayes, for illegally marketing and distributing an unapproved thermography device as a sole screening device for breast cancer and other diseases, according to a press release.Thermography is heat-sensitive imaging depicted in variations of color.10News spoke to San Diego's Susan G. Komen breast cancer awareness organization, which says thermography alone is not enough. “It can be used in addition to a mammogram or other screening tool that has been shown effective but there hasn't been any scientific evidence for thermography right now being a standalone tool,” says Lizzie Wittig, Director of Mission Initiatives and Public Policy.The FDA is demanding a response within 15 working days.No one at the clinic answered the door. 10News called and sent messages, and got this text reply: "Total Thermal Imaging Inc. is reviewing the warning letter from the FDA and developing a response. We will work with the agency to ensure our products comply with acceptable regulations." This isn't the first time that a clinic has gotten a warning letter about thermography. (KGTV) -- Officials with the Lakeside Union School District confirmed the closure of Winter Gardens Elementary School due to a COVID-19 outbreak.In a letter sent to families and school personnel Thursday, LUSD Superintendent Dr. Andy Johnsen acknowledged that “there have been 12 positive cases identified at Winter Gardens over the last two weeks” and because of the outbreak, the campus on 8501 Pueblo Rd. would be closed for 15 days starting Dec. 4.The school’s Extended School Services (ESS) will also be shut down.Dr. Johnsen said they closed the school Friday as, "all of the other cases we've had up until this point no other person has been identified as a close contact."Winter Gardens Elementary will proceed with distance learning from Dec. 4-18, according to Dr. Johnsen. The initial plan is to reopen the campus for in-person learning on Jan. 4.Dr. Johnsen noted that “staff members and students that may have come into close contact with the positive individuals have been directly contacted by San Diego County Public Health with further instructions.”“Because of how COVID-19 spreads, public health officials have indicated that all of us should consider ourselves as being potentially exposed,” Dr. Johnsen said in the letter.Dr. Johnsen said the infections likely originated off-campus. A La Jolla Immunologist agreed with that theory, saying on the molecular level adults are more likely to pass the virus to each other and not get it from children.Dr. Johnsen said the 12 infections is out of 308 students and staff combined. He said public health officials recommend closing schools when they reach a 5% infection threshold.He said students and staff were wearing masks, socially distant and the district hired cleaning staff to sanitize high touch points each hour and classrooms overnight. When the school reopens, Dr. Johnsen said they will not make any changes to their protocol, adding the district and public health officials support the procedures they have in place.Johnsen would not identify how many students and staff each were infected, due to privacy laws. 2115
