A federal judge has dismissed adult film star Stormy Daniels' defamation lawsuit against President Donald Trump.Daniels sued Trump after he said Daniels' story of a man threatening her not to come forward with her story of her alleged affair with Trump was "a total con job."Daniels argued Trump's tweet "attacks the veracity of her account" of the incident and that Trump's statement was "false and defamatory, and that the tweet was defamation ... because it charged her with committing a serious crime," District Judge S. James Otero wrote in his opinion Monday.Trump had asked Otero to dismiss the lawsuit."The Court agrees with Mr. Trump's argument because the tweet in question constitutes 'rhetorical hyperbole' normally associated with politics and public discourse in the United States. The First Amendment protects this type of rhetorical statement," Otero wrote.Daniels says she and Trump had an affair in 2006, shortly after he married first lady Melania Trump and she gave birth to their son, Barron. Trump has denied the affair. In addition, Trump is entitled to attorney's fees, Otero said.Trump's attorney Charles J. Harder said in a statement to CNN, "No amount of spin or commentary by Stormy Daniels or her lawyer, Mr. Avenatti, can truthfully characterize today's ruling in any way other than total victory for President Trump and total defeat for Stormy Daniels.""The amount of the award for President Trump's attorneys' fees will be determined at a later date," Harder added.Daniels' attorney, Michael Avenatti, responded to the ruling on Twitter and said: "Daniels' other claims against Trump and Cohen proceed unaffected. Trump's contrary claims are as deceptive as his claims about the inauguration attendance.""We will appeal the dismissal of the defamation cause of action and are confident in a reversal," Avenatti continued. 1860

A maker of the Carolina reaper hot pepper is defending distributing the pepper after a man became hospitalized from eating the pepper, the UK's Sky News reported. The Carolina reaper was named the world's hottest pepper last year by the Guinness Book of World Records. The pepper is rated at 2.2 million Scoville heat units. By comparison, a jalapeno is rated up to 8,000 Scoville heat units. A habanero is rated up to 300,000 Scoville heat units. An article in last week's British Medical Journal claimed that a 34-year-old man was hospitalized for eating the pepper during a hot pepper eating contest. The man experienced "thunderclap" headaches, The report also claimed the man's arteries had constricted after consuming the pepper. But Salvatore Genovese, a grower and distributor of the Carolina reaper, said the pepper should be eaten "correctly," according to the Sky News.  "It's not really designed to... just plonk it in your mouth and eat it," Genovese said. "I would never do that and I wouldn't recommend it."Just cook with it, make a curry, infuse it slowly take it out if you want to afterwards, and get the rich flavors from that super-hot chili."Genovese told Sky News he sold nearly 500,000 over the last few years without hearing any complaints. The unidentified 34-year-old man showed normal health five weeks after eating the pepper.  1458

A Fond du Lac man who holds the world record for "Most Big Macs Consumed" ate his 30,000th Big Mac on Friday.Don Gorske said he ate his first Big Mac on May 17, 1972, and has enjoyed, on average, two of the sandwiches nearly every day since.“I take that first bite, it was the best thing I had ever tasted in my life,” reads a pamphlet from Gorske that chronicles his hamburger habit. An entry titled “Summer of 1972” reads, “When I’m not at work, or going to McDonalds [sic], I’m at County Stadium, eating a Big Mac while watching the Brewers, or I’m ‘cruising Main Street’ like everybody else."Gorske’s good health can be verified by asking his wife, a nurse practitioner, he writes.“My height is 6’2”, [and] if I try hard, I can get up to 195 pounds,” he writes. There have been eight days that have not included a Big Mac for Gorske since he took that first bite of one in 1972, he wrote. The most recent was November 23, 2011, when McDonald’s was closed for Thanksgiving Day. He thought he had a Big Mac saved in the freezer, but was mistaken.“It’ll never happen again,” he wrote. 1096
