SAN DIEGO, Calif. (KGTV) - A large San Diego Church is continuing to hold in person, indoor services despite orders from San Diego County to hold services in outdoor settings only. Awaken Church has gotten three cease and desist orders at different locations and also had an outbreak at one of those locations, according to San Diego County.County Supervisor Nathan Fletcher said the church is not cooperating with the county in regards to the outbreak at their Balboa location, so the county had to publicly announce the community outbreak and ask anyone impacted to quarantine. He said if a church is impacted by blanket rules for an area, they would likely not win in court. A church would have to prove that they were treated differently.“If religions are being treated in a nondiscriminatory fashion, in other words if there’s a general law that establishes how many people can be in a room or what are the conditions, and it happens to have an incidentally impact on religion, that’s not a special problem as long as government has a rational reason for doing that, that’s alright. It’s only when government discriminates against religion that a special level of review called strict scrutiny is required and government has to have a really really good reason for discrimination,” said Smith.He added that the makeup of a court will also impact any future decisions on religious freedom, saying when Justice Ruth Bader Ginsburg was alive, cases regarding religious freedom during the pandemic were found to not be discriminatory, however with the newly appointed Justice Barrett, it’s more likely the Supreme Court would rule in favor of a church. 3009

SAN DIEGO (KGTV): A vacant lot next to the College-Rolando area library has become a dumping ground for homeless people and their trash. Now neighbors are fed up and want the owners to do something about it."My house is not even this trashy," says Erin Webster, who visits the library every day. "I keep my house clean. I think we should keep this whole community clean."The lot, at 6650 Montezuma Road, is owned by 52 Blue Falcon LLC, an investment group. They've filed paperwork with the city to build a 4-story Holiday Inn Express on the property. They're still waiting for final city approval."Everybody's trying to get through this process as quickly as possible," says Jeannette Temple with the Atlantis Group, who is a consultant on the project.In the meantime, homeless people have broken through the fence blocking off the lot. There are piles of mattresses, food, tents, electronics and other garbage piled up on every side.Temple told 10News the owners hired a cleaning company to come this week and remove the trash. SAN DIEGO (KGTV, CNS) - San Diego police were searching today for men believed to have stolen cell phones and a set of keys from three San Diego State students near campus, a university official said.The robbery happened Friday shortly before 12:30 a.m. in the 5600 block of Mary Lane Drive and Dorothy Drive.Police reported three phones and a set of keys were taken from three SDSU students. One of the students was taken to a hospital for further medical treatment. SAN DIEGO, Calif. (KGTV) -- A group of University City residents is suing the city of San Diego over its plan to pump sewage under their neighborhood to be turned into tap water. The nonprofit University City Community Foundation filed the lawsuit after raising ,000 from residents to challenge the environmental impact report for the city's Pure Water pipeline. The suit doesn't challenge the city's goal of making heavily treated reclaimed water one-third of its supply by 2035. The city says that will protect against future shortages and price increases. The lawsuit, however, says the city did not explore alternatives and did not adequately notify the public of the project's pipeline. It will pump sewage from the Morena Area, through Clairemont and University City, to a treatment plant at UTC. "There's no 100 percent guarantee that there could not be a leak, there could not be some discharge," said U.C. resident Barry Bernstein, who supports the lawsuit. "There could be some discharge. There may be some problems with the purification system."Ruth DeSantis, who heads the foundation, said the city and foundation are now in settlement talks. A city spokesman declined to comment on the lawsuit, but said there are multiple protections in place - including a system designed to immediately cut off to avoid sewage geysers. SAN DIEGO (KGTV)- Drugs and graffiti were just some of the problems filling parks around San Diego, with most of the activity happening during the night hours. A curfew has now been put in place for several parks.Community members and city leaders threw a party Friday morning to celebrate the change. Residents have been rallying for a curfew at City Heights Square Mini Park, which sits in the middle of an assisted living facility for seniors. Neighbors say before the curfew, they observed everything from gangs and drugs at the park. “We are this beautiful community,” says Delia Contreras. “We have kids, we have a lot of good things, but the drugs are no good.”Since the beginning of the year, 217 crimes have been reported within a 1,500 feet radius of the park. The crimes include assault, theft, and vandalism. “To me, San Diego is a paradise, and we need to clean up the whole town,” says Ronald Tieken. City Heights Square Mini Park will now have a nightly curfew from 9 pm to 5 am. There were other parks around the city with the same problems. Cedar Ridge Mini Park, Montclair Neighborhood Park, North Park Community Park and North Park Mini Park. These parks will now have a curfew of midnight to 6 a.m. “It took a lot of time because we didn’t want to take just one site, so we opened it up for other sites to bring their concerns in, and five parks were identified to go forward with it,” says Raul Contreras, with the city’s Parks and Recreation Department.
