BAKERSFIELD, California — A Kern County, California judge decided Thursday to set free a man who's been on death row for 26 years.Vicente Benavides, 68, was freed from San Quentin Prison Thursday afternoon.The judge said all Benavides' charges were changed to not guilty.  His defense attorney told KERO television station that Benavides will not have to return to Kern County.On Tuesday, District Attorney Lisa Green made the announcement that her office would not file charges against Benavides, saying the case would be nearly impossible to retry in court. She said it would be very difficult to convince a jury beyond a reasonable doubt of Benavides' guilt.According to a decision released by the California Supreme Court last month, the convictions of Vicente Benavides in 1993 "were based on false evidence and that he received ineffective assistance of counsel."The decision also says that "false evidence was introduced at trial and that petitioner's convictions of substantive sexual offenses, special-circumstance findings, and judgment of death must be vacated."Benavides was convicted in 1993 of first-degree murder, rape, and other charges. He was sentenced to life. He was serving his term on death row in San Quentin. It was asked that his murder conviction be reduced to second-degree murder. That was also thrown out. The judgment has been vacated entirely. Benavides' defense attorney says his client's case is extremely rare, saying only two similar cases have occurred since the death penalty was reinstated in the 1970's.The California Supreme Court cited multiple doctors who evaluated 21-month-old Consuelo Verdugo in November 1991 when she died. The baby was taken from the Delano Regional Medical Center to Kern Medical Center then eventually the UCLA Medical Center where she died November 25, 1991.Multiple reports were made by doctors who said based on the inability to insert a catheter, bruising found near Consuelo's genitalia and other factors, they believed she had been sexually assaulted. 2101

As the number of coronavirus cases continues to climb around the world and disrupts the travel industry, Princess Cruises has announced cancellation of early 2021 trips.“Due to restrictions and limitations with border and port access determined by government and health authorities and the continued uncertainty of airline travel,” Princess Cruises canceled about 30 voyages on two ships.The Island Princess, which stopped at ports around the world, and Pacific Princess, that sailed around South America and Australia, will not set sail until at least April, according to a release from the company.The cancelled voyages include a 111-day around-the-world from Los Angeles.Princess Cruises, which is owned by Carnival, is offering refunds or credit for a future cruise.Carnival Cruises has also canceled some 2021 voyages, and likely won’t return to full capacity until 2022.The cruise company is facing legal action for their handling of passengers when the coronavirus pandemic started this spring. Two lawsuits allege Princess Cruises did not act fast enough to impose quarantines when cases were discovered.When the lawsuits were filed in June, Princess Cruises told USA Today “our response throughout this process has focused on the well-being of our guests and crew within the parameters dictated to us by the government agencies involved and the evolving medical understanding of this new illness.” 1414

At least 48 people were shot within a 24-hour span on Sunday in New York, capping off a violent Fourth of July weekend, police said.Among those shot, 10 of them were fatal.Since Friday, there were 63 victims of gun violence, continuing the rising trend this summer.Most of the shootings were on Sunday, though there were a number of incidents on Saturday, including one in which no one was hurt. Police opened fire in Astoria, Queens on Saturday night when they spotted an individual shooting at someone else. A suspect was taken into custody in that incident.Police also witnessed violence first hand outside the 40th precinct in the Bronx Saturday night. A bullet pierced the front window of their marked cruiser.While in Brooklyn, a flaming firecracker was tossed inside a patrol car with an officer sitting inside.In a pair of tweets from Manhattan police commanders, the chiefs called out city leaders, saying the city is under attack, and they are demanding action.Former police commissioner Ray Kelly criticized Mayor Bill de Blasio for limiting anti-crime units as “crime is raging out of control in New York City.”Police are searching for suspects in multiple shootings.According to the NYPD, there were 575 incidents with 705 victims from Jan. 1 through July 4 of 2020. On Wednesday, one major retailer said it is adapting its Black Friday to the times.Home Depot said it is opting not to have a big one-day sale in stores. Instead, the home improvement retailer will host its Black Friday sales throughout the holiday season both in stores and online.“Savings will start in early November and last through December, both in-store and on homedepot.com,” the company said on its website. “Say goodbye to one day of frenzied shopping and enjoy Black Friday savings all season long without the stress and crowds.Home Depot added that it will remain closed on Thanksgiving like in years past. As the NHL went into what it calls “Phase 2” of its plans to resume the 2019-20 season, the league announced that 23 players tested positive for the coronavirus.The 23 players who tested positive is in addition to 12 players who previously tested positive in early June when the league began “Phase 1” of its reopening plan. All told, the league has had 35 players test positive.So far, the league has administered a total of 2,900 tests, with 396 having been tested so far. The tests have been administered to players representing 24 of 31 teams who will participate in the league’s postseason.The league said it will not identify those who test positive for the virus.The league suspended play in mid-March in an effort to help stop the spread of the virus. The league left off as most teams played roughly 70 games of an 82-game schedule.Days after the league’s shutdown, an Ottawa Senators player became the first player to test positive for the virus.When the league resumes, a tournament be held to conclude the season with games played between two “hub cities.” With coronavirus cases declining in Canada while still on the rise in the US, it is likely the NHL will conclude its season north of the border. 1221
