SAN DIEGO (KGTV) - The Downtown Central Courthouse plans to resume jury trials in two weeks after a six-month postponement during the shutdown, but there are concerns about the massive backlog of cases and keeping jurors safe. Non-jury trials are currently in progress through a remote virtual process.“I do have an incredible backlog, not only in criminal but also in civil cases,” said San Diego Superior Court Presiding Judge Lorna Alksne on Monday. So far, 900 jury duty summonses have been sent out for telephonic standby for in-person appearances in groups of 70 people. “The jury lounge [holds] 500 to 600 people but instead of that were going to bring in 70 [people and] socially distance them,” she added.Those people who are selected for jury will sit in courtrooms which have been retrofitted with protective measures like plexiglass barriers. Judge Alksne said there around about 2,400 criminal cases ready for trial that must be reset. Beyond that, there are thousands of other criminal proceedings to get to. “There's about 17,000 other things that need to be reset before they can even get to a trial,” she added.Civil cases are another obstacle. A spokesperson for the Courthouse confirmed that there are approximately 54,000 civil cases that are pending. There are about 2,800 that are ready to go to trial but Judge Alksne said Monday that civil jury trials likely won't resume until sometime in 2021.“The only way that I'm going to beat this backlog is if jurors come in for jury service so if you feel like you're able to serve, we would ask you to respond to the summons and come into court and help us get the jury trials started again,” she added.She noted that civil bench trials will start in mid-October and in-person arraignments will start on November 1st. 1792

SAN DIEGO (KGTV) - The doctor responsible for one third of vaccine exemptions in the San Diego Unified School District fired back Thursday at critics who say her science isn’t sound. Dr. Tara Zandvliet has a refrigerator full of vaccines at her office in South Park. She administers them to her young patients, but she also writes medical exemptions for some children. “It’s the kids that are sensitive that you need to just take a little bit different tack with,” said Zandvliet. Zandvliet wrote exemptions for 162 of the 487 children who provided SDUSD with a medical reason to avoid the vaccines required for entry. Despite the number, Zandvliet says she does not consider herself anti-vaccine. “I’m not gonna write a medical exemption just cause someone wants it. I’m not gonna write it or not write it just because the school says ‘hey we have too many of them’,” she said. Since California became one of three states to ban personal belief exemptions for vaccines, the number of medical exemptions has risen. So has the number of children being vaccinated. San Diego Unified officials issued a statement about the situation, saying in part the district "has noticed some physicians issuing exemptions that appear to be excessively frequent and based on criteria that are not aligned with guidelines from the Centers for Disease Control and Prevention.” Zandvliet’s website says she will grant an exemption based on factors like family history of allergies or autoimmune disease, neither of which are recognized by the Centers for Disease Control as valid reasons for exemption. “I refuse 7 out of ten; the three that come in they've convinced me they have proof they've given me medical records from family members and it’s there,” Zandvliet said. Other doctors disagree with Zandvliet’s reasoning, including State Senator Richard Pan, who is also a physician. He was behind the law to get rid of the personal belief exemption and is now trying to make it harder for parents to get a medical exemption. SAN DIEGO (KGTV) — The County of San Diego is providing free COVID-19 testing to all school employees returning to in-person learning, a recommendation by the California Department of Public Health.There are more than 80,000 school employees across the county. “This is everybody from bus drivers, to food service workers, to teachers, to administrators,” said Music Watson, the Chief of Staff for the San Diego County Office of Education, or SDCOE.While most schools are sticking with distance learning, for now, some are preparing to return to in-person learning starting in September.The school employees that do return will be tested for COVID-19 often.“The recommendation is that in any given two month period, you’ve tested 100% of school employees, with about half being tested in any given month,” said Watson. “People who are doing distance learning and teaching in a distance format and not coming into contact with students and school staff, they’re not going to have to be tested.”The county is partnering with SDCOE to develop more testing sites specifically for school employees by late September.Testing is currently available at the more than 20 county coordinated sites at no cost to school staff.If positive tests are discovered, classrooms, schools, and districts may need to shut down for two weeks.“If 5% of a classroom tests positive, that classroom would close, and they would self-isolate. If 5% of a school tests positive, the school would close for two weeks, and if 25% of district tests positive, the entire district would close for that two week self-isolation period,” said Watson. “In a classroom, 5% is basically one student or teacher, that’s why it’s so important to have a testing protocol in place.”If a classroom or school does have to shut down, students will continue learning for the two weeks.“That doesn’t mean all of a sudden it’s 14-days of no learning, it means transitioning to virtual which might be online or packet work depending on the particulars of that situation,” said Watson.It’s not currently recommended that asymptomatic children get tested for COVID-19, but if a parent or guardian wants their child tested, they should discuss it with their pediatrician. 2222
