SAN DIEGO (KGTV) -- The state agency that protects California consumers by licensing and regulating the state’s construction industry received more than 30 complaints about a San Diego County-based business.A Team 10 investigation discovered some customers who said they signed a contract with American Pride Enterprises, paid thousands of dollars up front and were left with little or nothing. The Contractors State License Board revoked American Pride Enterprises' license for non-compliance with an arbitration award in July of 2018.An outdoor cover to block the sun was the final piece in what had been a total backyard transformation for the Zimmerman family.“We were just looking to put a patio cover over our east-facing patio,” said Jim Zimmerman.Zimmerman said in 2017 he hired American Pride Enterprises and its owner Stephen Hage to do the work.He said there were no red flags. The company was licensed, bonded and at the time there were no real complaints online.“We paid just under ,200,” Zimmerman said. “That was to cover materials, and he was supposed to come back in three weeks and complete the job. That was the last time we ever saw Stephen Hage.”Zimmerman told Team 10 Hage initially offered to pay the money back, but instead of getting a check Zimmerman got excuse after excuse about why the money hadn’t arrived.Eventually, Zimmerman said the evasion tactics were too much and he sued Hage in smalls claims court.Zimmerman says he got some of his money back.A Team 10 investigation discovered Zimmerman isn't alone.Team 10 was in court when several people who claim Hage swindled them reached an agreement with his bonding company, getting some of their money back.James Francois said he paid Hage more than ,000 for a patio.“He never showed up, never delivered any material, never did an hour of work,” Francois told 10News.Court documents show more than 20 names listed on the lawsuit filed by the bonding company, which seeks reimbursement from Hage.A spokesperson for AmTrust told us, “This is a claim filed under a contractor’s license bond issued to our principal, American Pride Enterprises, by Wesco. Due to the claims we have received exceeding the aggregate ,000 bond limit, we filed an interpleader (a way for a holder of property to initiate a suit between two or more claimants to the property) to pursue funds that would be distributed to the named consumers, assuming the principal does not resolve the claims that have been presented.”  Court documents show Hage filed for bankruptcy in July, and list his estimated liability around 0,000. In bankruptcy people trying to get money can’t access the assets until the bankruptcy is resolved.Team 10 tried to track down Hage, but no one answered the door at his listed address.The Contractors State License Board told Team 10 through a spokesperson:  2964

SAN DIEGO (KGTV) - The Rock Church is making holiday giving even easier, teaming up with Express Feedback for Good to raise money for their Toys for Joy campaign.Under the new program, people can sign up to take on-line surveys. For each one they take, the Church will get towards their holiday fundraiser."This is a life or death situation for some kids and some families," says Pastor Miles McPherson.The Toys for Joy program is now in its 23rd year. Each year the Church helps around 20,000 families with food, clothing, toys, and more for the holidays. McPherson says he hopes the new survey tool will inspire people to do more."The express feedback tool gives people the opportunity to do something to help somebody, but we want them to take the next step, touch a person, smile at a person, hear someone's story," he says.The surveys only take about one minute each, and there's a limit of 100 per person. The Church says they hope to raise 0,000 from the surveys, to help supplement the other donations they get each year.The company, Express Feedback for Good, takes the information from the survey and sells it to businesses to help them serve their customers better."It's a win/win for both parties," says Product Manager Dena Coykendall. "The non-profit can create resources, and business can collect information from a crowd that's more representative."This year, the Rock Church will have four locations for their Toys for Joy campaign on December 14th. SAN DIEGO (KGTV) - Three animal rights activists have been banned from SeaWorld San Diego following a demonstration at an orca show this year.A San Diego Superior Court order issued Thursday banned three protestors affiliated with People for the Ethical Treatment of Animals (PETA) from entering SeaWorld San Diego and Aquatica San Diego, SeaWorld said in a statement.Included in that ban were Ricky Rodriguez, Lyanne Fernandez, and Lisa Lange, PETA's senior vice president of communications. "We said from the beginning of this case that a safe environment for our employees, guests, and animals is and will always be our top priority, and we will not tolerate this type of behavior in our parks."The three protestors are also legally prohibited from harassing, threatening, or committing violence against 10 SeaWorld employees named in the court documents.The court order stems from a July 24 incident in which the protestors disrupted an "Orca Encounter" presentation. SAN DIEGO (KGTV) -- The retrial began Thursday for Constantino Banda Acosta, the man prosecutors say was drunk and angry from a fight when he caused a hit-and-run crash that severely injured a 6-year-old returning from a family trip to Disneyland. The jury was deadlocked Thursday on whether or not Banda was even at the wheel. Throughout the trial, Banda sat quietly in the courtroom and could be seen smiling at the jury as attorneys laid out their case.The central question in the retrial is whether Banda or an employee of his construction company, Jorge Adame Ariza, was the one driving.RELATED: Verdict reached in trial for driver accused in hit-and-run crash that injured boyAriza was captured in security footage driving the truck from a restaurant where the two men were drinking.Ariza claims he turned the wheel over to Banda before the accident happened, which severely injured 6-year-old Lennox Lake of San Ysidro. Authorities say Banda had also been deported at least 17 times before the crash.Prosecution in the case say the two men were heatedly searching for a man who beat up Banda. Lake’s father says the young boy is expected to testify in the trial later Thursday.Lake is still receiving extensive treatments for his injuries.RELATED: Jury deadlocked in case against driver accused in San Ysidro hit-and-run?Banda was speeding west on Camino de La Plaza around 11:30 p.m. on May 6 when he reportedly ran a stop sign at Dairy Mart Road and crashed his pickup into a Honda Accord carrying the Lake family. In September of 2017, a jury found Banda guilty of misdemeanor charges of driving without a license, battery and vandalism. The jury was hung, however, on felony charges of hit and run causing death or permanent injury, DUI causing injury and driving with immeasurable blood alcohol causing injury.  1866

  

SAN DIEGO (KGTV) - The San Diego District Attorney's Office announced a new program Thursday that would send low-level offenders to the classroom instead of a jail cell.The Community Justice Initiative requires 12 hours of cognitive behavioral therapy, as well as four hours of community service. The participant then has their case dropped and their record sealed. They wouldn't have to report an arrest on any future job application."Some people deserve second chances," DA Summer Stephan said.The program started in the South Bay in April 2018, expanded to the East County in January 2019, then North County in May. It's funded in part by the county, grants, and 0 from each criminal."That amount is less than any fine they would have gotten on any case," Stephan said.So far the program has seen 586 participants. 296 of them completed the program.Director of Cognitive Behavioral Therapy for Adult Justice Programs and Social Worker Laura Soto spoke of one of her patients who completed the program, "she [Amanda] began to spend more time with her son, she got a diploma and she got an office job, and then she started cosmetology school."Amanda was arrested for stealing. Through the program she shifted her mindset away from entitlement."Amanda began to think about the consequences, and things to be grateful for and that made her happy," Soto said."The most common offenses in the program are in fact shoplifting, non DUI traffic violations or vandalism,." Stephan said only non-violent and non-sexual offenders qualify."Misdemeanor convictions can have damaging affects that last a lifetime," she added. Stephan said criminals will continue turning to a life of crime if they can't find a way out.10News asked Stephan what she would say to critics who believe this program could incentivize criminal behavior. She said, "the people who complete the program recidivate at 2% which is so phenomenally low."She compared it to the 16 percent who didn't complete the program and were arrested for a crime again. 2027
