SAN DIEGO (KGTV) - The Supreme Court ruled Wednesday in favor of providing employers the option to opt out of providing free birth control to their staff, based on religious beliefs.The 7-2 vote was polarizing."It's a huge win for religion," Pastor Andy Ballon said."We are extremely disappointed," Planned Parenthood Affiliates of California’s President/CEO, Jodi Hicks said.Pastor Ballon said the vote is a victory because it allows people of faith the freedom to not do something they don't believe in. "We believe that life starts at conception, so we believe we should have the right to chose to not provide or not pay for these contraceptives."Ballon said women have options to access birth control outside their healthcare plan provided through work.One of those options is Planned Parenthood."We know what [the vote] means. It will have a devastating effect on women trying to plan how they want to live their lives quite frankly," Hicks said.She explained those plans could involve pursuing higher education or a career.Hicks said 5.5 million women in California could have to pay if their employers opt out. Hicks said that leaves minorities much more vulnerable, saying many can't afford birth control."We are planning on campaigning to encourage those companies still cover access to birth control for women," she said.Pastor Ballon said it's not a fight against women. "Women play an important role in my life and it's not about taking anybody's rights. SAN DIEGO (KGTV) – The San Diego Unified School District said Wednesday that they are coordinating and organizing with student leaders for March 14th, when students from across the country are planning for a walkout.The walkout is in response to the Florida shooting.  The student-led demonstration is meant to urge lawmakers to pass stronger gun control laws.“We support student's voice,” School Board President Kevin Beiser said in news conference Wednesday. The protests are planned at 10 a.m. on Wednesday, March 14th.  The district wants students to help plan events at all participating schools, which are mostly high schools, according to Andrew Sharp, a district spokesman.It will be up to those school communities to come up with a plan.  Sharp says, in general, the district would rather the students keep activities on campus in so-called “teach-ins” as opposed to “walk-outs but the superintendent has said, “students will not be disciplined for participation in planned peaceful demonstrations occurring at schools.” District heads will be meeting with student leaders from “Equity Coalition” on Wednesday, March 7 to hear their ideas on the protest. SAN DIEGO (KGTV) – The San Diego County jail system is being blamed after a part of a former inmate’s cheek was bitten off by another inmate who was mentally ill.10News was at Thursday afternoon’s press conference where their families accused the jail system of failing to provide adequate mental health resources. “I felt unprotected,” says Miguel Lucas. Lucas now has a scar running across his cheek. It comes after he says part of his face was bitten in an unprovoked attack by inmate Reginald Harmon. It happened in June at the Central Jail.Harmon is still behind bars, but now family members and supporters of both men are coming together to say the jail system that's run by the San Diego County sheriff's Department needs reform. “I was sick to my stomach and I was very upset with the jail,” says Harmon’s mother, Alicia Muhammad. She says that days before he got jailed, she made repeated calls to the Psychiatric Emergency Response Team (PERT) hoping for intervention, but each time he was discharged. After being arrested for suspected DUI, she says she warned the jail. “I spoke with the lady at the front desk and advised her that my son had mental issues and she said, ‘Okay.’ She would let the guards know,” she adds.However, she says her son wasn't placed into a mental health unit. Even after he reportedly attacked a different inmate, the families say he was placed in a lower security unit and neglected by mental health providers for two days, until he attacked Lucas. “It’s just unfortunate that people had to go through what I went through and what people are still going through to this day,” says Lucas. Following the attack, the families of both men connected and found a friendship. Currently, Lucas is living with Harmon’s aunt and attends church with the Harmon’s family. Lucas did not want to press charges, expressing that he knew Harmon was having mental health issues at the time of the attack.The families plan to file a civil lawsuit against the San Diego County Sheriff’s Department in the next few months. The Sheriff’s Department sent 10News the following statement on Thursday:“The San Diego County Sheriff's Department investigated the assault on Miguel Lucas and forwarded the case to the District Attorney's Office. Reginald Harmon was charged with one count of aggravated mayhem. Lucas and Harmon were properly classified and housed at the time of the incident. Inmates are assigned to different facilities or housing units for a variety of reasons, including classification, bed space considerations, medical or mental needs, or issues with other inmates. SAN DIEGO (KGTV) -- The register sex offender accused of kidnapping and raping a three-year-old Oak Park girl pleaded not guilty to five felony counts Wednesday. Francisco "Freddy" Diaz now faces up to life in prison if convicted. Diaz is being held without bail. The young girl’s father, Silvester Soltero, says he was working on his car when his neighbor broke into a bedroom window, grabbing his sleeping daughter.Soltero says Diaz’ mother brought his daughter home, but she wasn’t wearing any pants. Soltero said when he asked his daughter what happened, she told him the man touched her private parts.RELATED: Man arrested after three-year-old says she was kidnapped and touchedWhen the father asked who the man was, Soltero said his daughter pointed to Diaz. When the father approached Diaz, Soltero said he became hostile, even threatening to kill him if he snitched.The two men then started fighting when Diaz reportedly tried to poke Soltero in the eye with a fork. After he ran off, San Diego Police caught Diaz a short distance away. After his arrest, Soltero learned his neighbor was a registered sex offender.“They should have told me, they should have told me I was living next to a pedophile, If I had known I wouldn’t have brought my daughter around here, there’s no way in hell," he said.Diaz was convicted in 2006 for molesting three girls on the playground near Oak Park Elementary School, right across the street from his mother’s house. Diaz was sentenced to eight years in prison, in part because he already had a criminal history. In 2000, Diaz was convicted of assault with a deadly weapon and making a terrorist threat.San Diego Police say Diaz was in full compliance with the terms of Megan's Law. He is required to check in with police every year and he does so, said Lt. Jason Weeden.Because Diaz' child molestation convictions were misdemeanors, he doesn't have to steer clear of schools and playgrounds. Soltero says if that's true, the law should be changed. “If you’re a sex offender you shouldn’t be by a school, period," he said. 2091
