SAN DIEGO, Calif. (KGTV) - A former assistant at a local nursing home is accused of raping a disabled patient. In a story that you'll first see on 10News, Team 10 investigative reporter Jennifer Kastner discovered the patient was a stroke victim who uses a wheelchair. What may have happened behind the walls of the Paradise Hills nursing home is difficult to process. An accusation of rape seemed to have slid under the radar for almost a year, until now. It was a few months ago when 10News was tipped off about Reo Vista Healthcare Center, which touts being named one of Newsweek's top nursing homes and having a Medicare 5-star rating.This week, San Diego Police confirmed that detectives referred the case to the District Attorney's office, which is charging 26-year-old Ariel Chavarin-Camargo with forcible rape and a "lewd act upon a dependent adult by a caretaker". He is now sitting in a South Bay jail. According to state documents, it happened last February to a 58-year-old woman who uses a wheelchair and was living in the nursing home after suffering from a stroke and panic disorder. The documents report that the morning after the alleged assault, she reportedly came "crying" to a nurse, claiming that the night before, when she was returning from the kitchen and on her way back, "one of the CNAs (Certified Nursing Assistants) stated that one of her breasts was exposed." According to the documents, he “followed her and he exposed his private parts to her". She reportedly said, "the CNA raped her" for up to three minutes. A forensic exam reportedly found male DNA in her private area. According to the documents, when he was later questioned, he suggested that she came onto him but admitted "it happened” and “there was penetration". He reportedly said, "I feel bad. It happened so fast." Prosecutors believe that man is Chavarin-Camargo. He resigned after the reported rape. The administration of Reo Vista Healthcare Center sent 10News the following statement on Tuesday."We are grateful to local law enforcement and the District Attorney’s Office for successfully prosecuting this individual for their crime. Our team took immediate steps last February to suspend the individual, to notify, and to fully cooperate with authorities. We take all matters regarding patient safety and the conduct of staff seriously. Moreover, the actions of this individual do not reflect the values we hold at our facility. Our priority remains to provide the highest level of care for the patient and their families." Chavarin-Camargo’s next court hearing is scheduled for February 11th. 2603

We have removed any restrictions; they don’t have to get a permit or anything.”San Diego Mayor Kevin Faulconer also plans to sign an emergency executive order to provide relief for restaurant owners.“The City is finalizing a new ordinance for Council approval that will cut fees and streamline permits to make it easier for businesses to operate outdoors,” said Mayor Faulconer in a statement to ABC 10News.RELATED: San Diego County added to California's 'monitoring list,' certain businesses told to shut down“Given that the state’s new shutdown order has an immediate impact on local businesses, on Tuesday, I’ll be signing an emergency Executive Order that will waive regulatory requirements and help restaurants expand their service outdoors, increasing physical distance between employees and customers.”Meanwhile, business owners across the county are doing what they can to stay afloat.“We’ve been thinking what we could do, and we are ready to open for outdoor dining and give it our best shot,” said Suzan Meleka, owner of Charlie’s Family Restaurant in Escondido.Meleka said she would be using her outdoor patio area and potentially adding more tables and shading in the parking lot.“Currently there’s four, and we are going to add more, and they will be six feet apart for sure,” she said.While outdoor seating hasn’t been the most ideal for some restaurants, it has proven to be successful in many beach communities.“At our venues, I think it’s been really good outdoors,” said Steve Thomas, General Manager at Belmont Park.Cannonball Sushi and Beach House Bar & Grill already operate outside, but changes will be made at Draft South Mission to expand outdoor seating in hopes of keeping the restaurant entirely in business.“We just moved some more tables around, expanded the outdoor seating, and we’re going to pivot to make sure that we can still have Draft fully opened with the outdoor section,” he said. 3204

SAN DIEGO -- A woman is on high alert after she says a six-foot-long rattlesnake nearly attacked her dog Friday.Willow, 20, says she let her small dog out just before 10 a.m. Friday in San Diego.According to the 20-year-old, the dog started running around when Willow noticed a snake. She quickly grabbed the dog and started running back inside.Firefighters responded and found the massive red diamond rattlesnake cozying up net to some rocks near a fence line.A firefighter was able to safely remove the snake with tongs. SAN DIEGO COUNTY, Calif. (KGTV)— With precipitation numbers up, participation numbers were down for outdoor events around San Diego County. But many who chose to endure the rain said it was worth the extra splash. It’s a rare sight in the heart of San Diego: kids sledding on a giant snowy hill at Montgomery Waller Park. For the Murillo family, it’s an annual tradition. “We go to see Santa Claus, we go to the little stores that they have there, and we come to sled down for a little bit,” mother Diane Murillo said. She and her children were bundled up while having fun at San Diego Snow Day. But this year, Murillo noticed that the crowds were much smaller. “It’s a lot smaller. It’s empty today. There’s actually parking,” Murillo laughed. She said the steady rain discouraged many folks from showing up. The City of San Diego even had to cancel Santa Claus’ helicopter fly-over of the park, due to inclement weather. Murillo also noticed that the snowy hill was very sludgy, and only about half its normal length. But by the looks of the children, the event was still worth it. Meanwhile, in the South Bay, there was a tent full of Christmas-themed games. From Candy Cane trees, ring tosses, to face paint, families enjoyed the free entertainment at the Chula Vista Children’s Faire. “It helps, because that way, we’re not getting wet while they are getting their stuff done and doing the activities. So it’s nice,” mother Felice Navarro said. Her neighbor invited her and her children to join them at the fair this year. The kids also had an option to splash around if they wanted, as they ran through an obstacle course as Chula Vista junior firefighters. Fun was not just reserved for children. Up at Liberty Station, hundreds of people waited in line to join the San Diego BBQ and Beer festival. 25-year-old Victoria Ransom was not going to let the rain dampen her birthday celebration. “We wanted to be able to double fist if that was a possibility. Hands-free rain protection,” Ransom joked. She said she bought eight rainbow-colored umbrella hats online, the moment she found out about the weather. “You drink, you eat, it’s great,” Ransom said. “I got a nice pour because it’s my birthday, and we’re having a great time.” 2243

  

San Diego (KGTV)- The entertainment world is left in shock after the death of Chadwick Boseman. The Hollywood star lost his battle with colon cancer. He was just 43 years old. Local physicians are stressing the importance of getting screened.For four years, the actor fought a silent battle with this cancer. He was diagnosed in his late 30's, much younger than the age many get tested."What we have seen is in younger people, the rates of colon cancer are going up and have actually gone up every decade, and the reasons for that are not known," says Dr. Abi Olulade with Sharp Rees-Stealy Medical Group.Olulade says the rates of colon cancer are higher in the African American community."Not only is there an increased rate in colon cancer, but there's an increased chance of dying from this if you are African American," says Olulade.The American Cancer Society estimates 12-percent of colorectal cancer diagnosis this year will be in people under the age of 50."People have put off their screening, which is dangerous," says Dr. Walter Coyle with the Scripps MD Anderson Cancer Center.Coyle says due to the pandemic, fewer patients are coming in for screenings."The American Cancer Society says we should start screening people at age 45 and up now. All the other societies say 50 unless you're African American."Coyle says a healthy diet can help lower the risks of this cancer. He hopes the news of famous actor Chadwick Boseman will encourage people to get their screenings."I couldn't imagine someone that young and vigorous dying. This goes to show cancer doesn't pick favorites or the weak. 1608
