JULIAN, Calif. (KGTV) – The San Diego County Sheriff’s Department arrested a man they say punched someone in the face near Julian after accusing him of trespassing.Deputies say they became aware of a series of theft-related crimes on the 5600 block of Eagle Park Road in August.The victims were outdoorsmen enjoying activities in the Cleveland National Forest. On November 6, Deputy Craig Rembold was contacted by a man who was hunting in the area on the 5th when he was accused of trespassing by a local land owner later identified as Frank Martinez, 54.During the conversation, Martinez punched the man in the face, causing significant injuries to the victim. On November 15, deputies arrested Martinez during a traffic stopped. He was taken to jail for battery and firearm violations.Martinez was arrested for battery and firearm violations. Jurors have found Border Patrol Agent Lonnie Swartz not guilty on the Second Degree Murder charge of shooting through the border fence and killing 16-year-old Jose Antonio Elena Rodriguez.Jurors could not come to an agreement on a verdict on the two lesser charges, voluntary manslaughter and involuntary manslaughter.If they wish, prosecutors can retry Swartz on the lesser charges only.Friday jurors told Federal Judge Raner Collins they could not agree on a verdict.  The judge told them to continue deliberating. They could choose to convict Swartz on lesser charges of Voluntary Manslaughter or Involuntary Manslaughter.Swartz testified he was protecting himself and other officers from rocks thrown over the border fence by people on the Mexican side trying to interfere with efforts to arrests smugglers who were trying to climb over the fence and into Mexico.In closing statements to the jury, prosecutors said in his two years as a Border Patrol Agent, Swartz had rocks thrown at him six or seven times, and each time had responded by using less lethal weapons. Border Patrol may use items like guns that shoot an irritating pepper.But the night of October 10, 2012, Swartz had been on duty at the DeConcini Port of Entry.  He had only his gun and used it to fire 16 rounds through the fence. Ten shots hit the 16-year-old Mexican teen.Prosecutors say the threat against Swartz and other officers was not severe enough to justify deadly force and that they could have easily removed any threat by taking cover.They say other agents took cover but Swartz was fed up with rockings, wanted to send a message, and did it by calmly walking to the border fence, taking careful aim, and firing 16 shots into Mexico.Defense attorney Sean Chapman told the jury rocks are enough of a danger to justify deadly force and that there is no evidence to conclude Swartz fired out of anger over rock attacks. KANSAS CITY, Mo. — There is no rule book when it comes to COVID-19, with endless questions still surrounding the potentially deadly virus. One big question that many are now asking: If you've already had the virus, should you get the vaccine when it becomes available? "Certainly right now, it's looking like they are going to recommend people that have had COVID to go ahead and get the vaccine when it's available to them, based either on their job or on their other health conditions," said Dr. Sarah Boyd, infectious diseases physician at Saint Luke's Health System.Boyd said it is important for everyone to get the vaccine, even those who already have had COVID-19."We know the majority of people that are at about 90 days, but there are some that probably longer," Boyd said. "Over the next few months, there will be information I am sure coming out about the natural course of immunity and if at some point you are at risk to get reinfection."Amanda Finley tested positive for the coronavirus twice and wants to get the vaccine as soon as she can."For me, I haven't had adverse reactions before, but the only way to know if it is going to affect long-haulers is if we try it," Finley said. "I just don't feel right saying, 'oh, somebody goes try it for me.' I will gladly do it. I will be first in line."She runs a Facebook group for COVID long-haulers.Some of the members in the group are excited about the vaccine, while others are nervous about it. But Finley said a big reason why she will get the virus is a simple one."Because I definitely do not want to get this again," Finley said. "It affects every system in the body.
