VISTA, Calif. (KGTV) - Several schools in the Vista Unified School District are returning back to virtual learning for two weeks after positive COVID-19 cases were identified. The district reopened for in-person learning at normal capacity, also known as Vista Classic, on October 20th. According to the district’s website, 17 cases have been reported since October 20th.District Superintendent, Dr. Matt Doyle, said Vista Classic and Vista Virtual were designed to work together so that there is the flexibility to move back and forth.Mission Vista High School, Vista High School, Madison Middle School, Roosevelt Middle School, and Rancho Minerva Middle School are also back to Vista Virtual due to positive cases.A class of 28 students and one teacher at T.H.E. Learning Academy Elementary school is also under quarantine after one positive case was reported.Last week the school unanimously approved a plan that would close down some middle and high schools for two weeks when positive cases are reported. The closures would happen if one school has two or more positive cases at the whole time, the entire school would switch back to Vista Virtual for two weeks. If three secondary schools have one positive case each, all three will return to Vista Virtual for two weeks.“I think two is tough; that doesn’t give us a lot of confidence that it won’t close down again,” said Dolly Goulart, a parent of a Mission Vista High School student who has been back to virtual learning.“I do appreciate that they’re doing trying to get classic families back in. They gave families a choice over the summer.”Goulart said her son’s transition back to Vista Virtual went smoothly.“From my perspective, it seemed perfectly seamless. He did fine pivoting back,” said Goulart. “He’s about a week into his two-week virtual pivot.”“We meet regularly with representatives from the S.D. Health and Human Services Department to discuss our health and safety measures and make adjustments as appropriate,” said Dr. Doyle in an email to A.B.C. 10News.Doyle said in just weeks, a high volume COVID-19 testing center would open in Vista Unified. Before school reopened, the district notified parents that they couldn’t guarantee that students would be six feet apart in class. The district’s website stated, “It is important to note that while many health and safety precautions are in place for the Vista Classic learning model, all classrooms will have the normal amount of students enrolled. This means that while we will be following social distancing procedures, student seating arrangements will be less than six feet apart.”There have been mixed reactions to the reopening plan from teachers and parents; some like Goulart are happy with the plan, while others call for revisions.“Why are we allowing kids not to social distance within our classrooms?” asked Keri Avila, the Vista Teachers Association president. “When we talk about keeping businesses open, when we talk about returning to some sort of normal, this takes that all away.”Avila said, in some cases, students are in crowded classrooms without enough safety measures in place. She’s calling on the district to make changes to the current reopening plan so that schools can remain open.“We hope to work with our district to create a system to keep our schools open, not one that keeps pivoting back to virtual,” said Avila. Two positive COVID-19 cases have also been reported at Alta Vista High School, but ABC 10News has not been able to confirm if the school has closed down. 3527

VISTA, Calif. (KGTV) - The parents of a two-year-old boy say they're still reliving the terrifying experience they faced in a store parking lot over the weekend.Peter Kopcak and his fiance Jennifer Lawson were backing out of the Costco parking lot on Hacienda Drive in Vista Saturday afternoon."I just seen out of the corner of my eye this guy running down between the two cars, and I didn't know what he was doing," said Kopcak. The couple said the guy tried to rip their toddler out of his car seat."He opened the car seat back door, reached in and grabbed my kid, she jumped out of the car, left it in reverse, I put it in park. I jumped out, he was trying to grab the carseat and, she pushed him and I just had to take him down," said Kopcak.Kopcak tackled the man to the ground."I took him to the ground and did what I had to do to subdue him, a bunch of people, an off duty officer pulled me off the guy and held him down told him to put his hands behind his back," said Kopcak.Sheriff's deputies arrested 37-year-old Adam Glavinic. He's facing charges of felony attempted kidnapping and being under the influence of a controlled substance."I thought he was going to take my kid and I wasn't about to let that happen, I'd do anything I could to stop him cause that's the worst nightmare, just having someone A, touch your kid, B, try to take your kid," said Kopcak. The couple was also upset to learn Glavinic was released from jail on a 0,000 bail Sunday."I couldn't stop crying when I found out, cause he will do this to someone else and who knows if it's a single mom or the husband isn't quick enough, and the guy takes off," said Lawson."I don't understand how he got out so fast. What if he tries to grab another kid or hurt someone else? It boggles my mind," said Kopcak. There's a backlog of out of custody cases due to the pandemic. Glavinic isn't scheduled for arraignment until February. 1912

Walmart and Target are being sued for allegedly selling toys with lead levels up to 10 times more than the federal limit of 100 parts per million, New York Attorney General Barbara D. Underwood announced on Thursday. According to a statement released by Underwood's office, the AG's office was able to find Cra-Z-Jewelz jewelry-making kits from stores. The kits allegedly contained lead at levels of 120 to 980 parts per million. The Attorney General's office had further independent testing done to confirm the results. The toy's maker, LaRose Industries, which is also a plaintiff in the New York lawsuit, issued a national recall. Underwood's office is accusing Walmart, Target and LaRose of "repeated illegality and fraud under New York State law by committing thousands of violations of state law prohibitions on importing, distributing, and selling hazardous toys; deceiving consumers; and false advertising."Underwood's office is seeking civil penalties of  to ,000 for each Cra-Z-Jewelz kit the companies sought to sell in the state.“No parent should have to worry that their child’s toy may be toxic. As we allege, these companies imported and sold toys with dangerous levels of toxic lead – jeopardizing the health of New York’s children and breaking the law,” Underwood said in a statement. “Our lawsuit seeks to hold these companies accountable for the failures that allowed lead-contaminated toys on store shelves, while forcing them to take responsibility for the safety of the products they sell.”The suit also seeks to force the companies to adhere to higher quality control standards to prevent toys with high lead levels from being purchased. The CDC says that lead in children's blood has been shown to affect IQ, ability to pay attention, and academic achievement. The CDC added that children under the age of 6 years old are at most risk of lead poisoning.  1936

Voters are again set to render a verdict on the direction they would like to take the country. They turned out in record numbers for early voting, and polls open for Election Day have been steadily busy. Two years into Trump's tempestuous presidency, Democrats are targeting their best election results in six years. But given uncertainty over the quality of polling, questions over the makeup of the electorate and Trump's talent for busting political norms, no one can say for sure how the election will play out.Click here to see photos from around the country as people turned out to cast their ballots. 618

VISTA, CA (KGTV) — The man accused of intentionally driving a U-Haul van into a crowd of people outside of an Encinitas bar, pleaded not guilty to serious charges in a Vista courtroom Wednesday.Christian Davis, 28, stood next to an attorney with his head down as he was formally charged with two counts of attempted premeditated murder, three counts of assault with a deadly weapon, and one count of felony driving under the influence of alcohol.Deputy District Attorney, Kim Coulter, said the incident early Sunday morning started at the Saloon and Shelter bar when Davis was kicked out.RELATED: Video shows driver slamming into crowd outside Encinitas bar"He was asked to leave because he was highly intoxicated and it was time for him to go," said Coulter.Once he was kicked out, Coulter said he got into a verbal argument with two bouncers, then threatened them."It escalated and culminated with Davis telling the security guards 'you're going to regret doing this, I’m going to come back and I’m going to kill you,'" she said.Moments later, witnesses saw the U-Haul heading for a crowd of people standing outside of the bars.RELATED: Man arrested after driving into crowd outside Encinitas barThe incident was captured on a passerby's dash cam video."He reversed out of a 7-Eleven and he came barreling down a sidewalk in front of Shelter bar, right into a crowd of people," said Coulter. "It’s our position that he used the U-Haul passenger van as a deadly weapon."Good Samaritans rushed to hold Davis in place until deputies arrived and arrested him. Sadly, two men who were outside of the bar at the wrong time were seriously hurt."A 25-year-old victim has had a severe injury to his leg, he’s had his third surgery today," said Coulter. The other victim, a 24-year-old, was also left hospitalized with severe injuries."He has two collapsed lungs, fractured ribs, a broken arm and he did spend time in the ICU," she said.Bail was set at million. If Davis is released on bail, he will wear an alcohol monitoring bracelet. He is due in court for a preliminary hearing on March 17. 2095
