A Florida judge has denied a request for a temporary injunction to block the Palm Beach County mask mandate.Attorneys for a group of Palm Beach County residents filed a lawsuit claiming that the county's emergency order requiring masks in public places to help prevent the spread of the coronavirus was unconstitutional.Judge John Kastrenakes issued his ruling Monday morning."The right to be 'free from governmental intrusion' does not automatically or completely shield an individual's conduct from regulation," Kastrenakes wrote in his 13-page order. "More to the point, constitutional rights and the ideals of limited government do not absolve a cititzen from the real-world consequences of their individual choices, or otherwise allow them to wholly shirk their social obligation to their fellow Americans or to society as a whole. This is particularly true when one's individual choices can result in drastic, costly and sometimes deadly consequences to others."Kastrenakes went on to say that there is no "constitutional or protected right to infect others."Commissioners voted unanimously last month to approve the mask mandate, despite objections from an impassioned group of residents who spoke against such an ordinance.County Administrator Verdenia Baker last week extended the order for an additional 30 days. It now remains in effect until at least Aug. 23.Mayor Dave Kerner said Friday that the county is in the process of mailing about 3 million masks to residents."As this community tries desperately to navigate the tumultuous seas presented by COVID-19, it is reasonable and logical that our elected officials are throwing the citizens of Palm Beach County a lifeline in an attempt to ameliorate the spread of this deadly, unbridled and widespread disease," Kastrenakes concluded. "Based on the evidence, this court will not second guess the manner in which a co-equal branch of government sought to discharge its sacred duty to protect the general public."A statement from the Florida Civil Rights Coalition, which filed the lawsuit on behalf of the plaintiffs, said Kastrenakes "unsurprisingly" denied the motion, "paving the way for continued government tyranny under the guise of disease prevention in Palm Beach County."Attorneys for the plaintiffs argued during a hearing last week that the mask mandate infringes upon their clients' constitutional rights.In their statement, attorneys claim the ruling "disregards fundamental rights like freedom of speech and the right to medical self-determination protected by the Florida Constitution."The Florida Civil Rights Coalition plans to appeal the ruling. The company shut down temporarily for the pandemic and that will also affect the holiday offering of its "Hot Tamales" and "Ike and Mike" fruit candies."I don't think the consumer will know when they walk into a supermarket what is short and what is not short because so many things are disrupted," said John Phillip Tarantino Jr., president of Tarantino Foods, LLC in Buffalo.Tarantino Foods is a wholesale food distributor with 2,000 customers that includes colleges, casinos, restaurants, and pizzerias.The company president told 7 Eyewitness News Reporter Ed Reilly that his business is having a hard time finding many items such as french fries, California dates, certain types of cheese, frozen bread, bread crumbs, ketchup, Kraft ranch dressing, macaroni and cheese, McCormick spices, and packets of hot sauce - to name a few.It is a difficult situation for food service suppliers as retail demand in grocery stores exploded during the crisis and forced manufacturers to redirect their efforts. Some less-profitable items are not being produced. Pasta and flavored drinks have seen those reductions.Tarantino said consumers were looking to buy anything they could stockpile, such as Campbell soups and frozen vegetables.Shut down of food plants with workers afraid of the virus started the problem which increased to a "tsunami" with surging demand by shoppers. That situation was made even more complicated by a severe shortage of product packaging materials. Tarantino said he believes that to be one of the reasons why some food products are having a hard time getting to the shelves currently.The family-owned business is recommending people take advantage of the WNY harvest season to stock-up on corn, tomatoes, and squash. Not only is it plentiful and cheap, but there could be produce problems coming soon as workers are not able to pick citrus and row crops, like lettuce and broccoli, on the West Coast due to the wildfires, added Tarantino.Some viewers asked why canned pumpkin is so hard to find?7 Eyewitness News contacted Libby's and received the following response:"The team in Illinois is currently working hard harvesting Libby’s pumpkins and canning for the upcoming season. In a region known for beer, cheese, and very cold winter, the surf scene is growing and Jake Bresette is helping lead the charge. “I just love it, man,” he said. “Anytime I can get out into the water, whether it’s one foot or 10 feet, it’s always a good time.” More and more surfers are keeping up on a well-kept secret: with the right weather, the waves on the Great Lakes can be just that – great! Outside of the water, Bresette owns and operates Lake Effect Surf Shop in Milwaukee where he sells surf and skate gear and offers lessons to anyone who wants to learn how to surf. “Yeah, we actually do them with or without waves,” he said. “So, if there are waves that’s great, we’ll get out here and score some waves. But, if not, we’ll bring out some big paddle boards.” While introducing the sport of surfing to a new generation, Bresette always remembers to honor the local pioneers of the sport. “We didn’t start the surf scene here,” he said. “We’re just helping to continue the progression.” Bresette says the key to that progression is to get out when the surf is up. “I know it sounds a little cliché, but it is really about the journey as well as the success of finding waves,” he said.
