ENCINITAS, CALIF. (KGTV) -- The return to in-person instruction for some north county students appears to be in legal limbo.Friday, the California Teachers Association filed a legal petition on behalf of the union representing the teachers in the San Dieguito Union High School District. The union wants the district's reopening plan blocked, saying, among other things, it violates the state's public health rules concerning the pandemic.Last Tuesday, the school board voted to give students the option of returning to in-person instruction five days a week on January 27th. Previously, the board voted to return to campus one day a week beginning January 4th.Lori Laroque has two boys in eighth grade at Pacific Trails Middle School. She applauds the board's decision."I was elated, and this was something that should have happened a long time ago," said Laroque.Ann Cerny has been teaching U.S History at Earl Warren Middle School for twenty-seven years. She also has a high school daughter in the district.Cerny says she would love to see kids return to campus, but she says now is not the time."Yes, in-person learning is best, but it's not going to be that 2019 in-person situation, and people aren't seeming to accept that reality," said Cerny, who has been teaching remotely from her classroom.Union leaders estimate up to 20% of teachers won't return if the plan for five days a week in-person instruction goes through.Cerny says she has concerns about exposure to COVID-19, but that isn't her biggest fear."It's the academic chaos that we find ourselves heading towards. I'm just worried that it's not going to roll out well. I'm worried for equity for students. I'm worried for the many, many teachers going out on leave and having subs for classes," said Cerny.The school board president said the district is actively recruiting for teachers and substitutes.No one from the board was available to comment on camera, but President Maureen Muir sent 10News a lengthy statement explaining the reopening plan."The health and safety of our students and staff is the District's highest priority. The District's Safe Reopening Plan follows the guidance issued by the California Department of Public Health and includes detailed protocols for distancing and ventilation.Staff will be encouraged to maintain 6 feet of distancing, as practical, from one another at all times, and teacher desks will be at least six feet away from students. Students will maintain distancing as practicable and in compliance with guidance from CDPH, including arranging desks in a manner that minimizes face-to-face contact. We have evaluated all of our classroom spaces and planned to maximize distancing. We have also planned carefully to maximize distancing for students and staff outside of our classrooms, including before, after, and between classes.The District consulted with ventilation and filtration experts to determine the maximum efficiency our units can handle. MERV 8+ filters were installed in all of our units, which achieves MERV 11 efficiency. Additionally, we purchased and installed HEPA filters in our classrooms, common areas, and offices. We have CO2 sensors in our newer buildings that monitor indoor air quality and we are purchasing more for other spaces.To ensure the continuity of teaching and learning, the District is allowing teachers who are in a high-risk group, or who have a household member in a high-risk group, to teach from home for the remainder of the second quarter, which ends on January 22, 2021.We have also informed teachers who have childcare needs due to COVID-19 that they may also work from home during this same time period. The District has made every effort to work with our teachers to keep them safe and to address their concerns about returning to work. The District is continuing to evaluate potential staffing shortages and has been actively recruiting teachers and substitute teachers to address this issue.The District is aware that the San Dieguito Faculty Association filed a petition for a peremptory writ of mandate on Friday that seeks to prevent the District from providing in-person instruction to students in January. (KGTV) - Surveillance video captured a man in a truck treating an Escondido neighborhood like a dumping ground.In the video, a white truck pulls up in the 800 block of North Citrus Avenue just before 1 p.m.  The driver goes to the back and casually pulls the couch onto the street, before going back to the truck to toss out a piece of carpet. He then drives off."Just makes our neighborhood look bad and ugly, and we don't want that," said Gil Gomez who lives feet from where the couch was dumped.His frustrations growing every time he watches the video, recorded from his Ring camera. That's because the truck appears to be a newer model Ford F-150."If you can afford to buy a brand new truck, you can afford to get rid of this thing properly," said Gomez.Gomez fears this type thing could attract more dumping."It might happen around the corner next time. That is the type of culture we cannot stand for," said Gomez.Gomez posted the video on the Neighbors by Ring app to track the person down and to send a message to would-be dumpers. "Not in our neighborhood. (KGTV) — The owner of a juice bar says she is "completely disheartened" after her business was targeted by a burglar for the third time in several years.On Tuesday morning, owner Vianey Delacruz says her sister went to open up when she saw the broken window and trail of glass. Delacruz opened up Get Juiced on S. Escondido Blvd. about four years ago."Feeling empty, not just in your pockets but in your heart," said Delacruz.Among the stolen items: A cash register, iPads, and two tablets, totaling about ,000."Basically took everything of value we need to run our business," said Delacruz.The pain of the theft is something Delacruz has felt two other times since 2015. In the first break-in, surveillance video showed an intruder in a hoodie picked the lock, before grabbing iPads, tablets and laptops, and a cash register.In another break-in, two men removed a window screen, then climbed in and took another cash register, iPads and speakers. It's unknown if any of the burglaries are linked. The total value lost in all the burglaries is more than ,000. Delacruz does not have insurance for the business, so the loss comes out of her pocket. Excedrin's manufacturer has recalled more than 433,000 bottles of the painkillers due to bottles having holes on the bottom of them.GlaxoSmithKline (GSK) issued the recall Wednesday stating that the bottles aren't in child-resistant packaging as required by the Poison Prevention Packaging Act since there are holes in the bottom.GSK says this could potentially lead to children gaining access and swallowing the over-the-counter drug, posing a risk of poisoning.The recall involves 50, 80, 100, 125, 200, 250, and 300-count bottles of Excedrin Migraine Caplets, Excedrin Migraine Geltabs, Excedrin Extra Strength Caplets, Excedrin PM Headache Caplets, and Excedrin Tension Headache Caplets. Experts say a scammer cloning a phone number can happen to anyone and a Nebraska woman says her number is being used to try and solicit others.Caller ID "spoofing" is used to disguise someone's identity and is usually to trick a person into giving away personal information for criminal activity, or money. Now, many in Omaha are seeing local numbers including the same prefix show up on a call.Evy Akpan says recently she was receiving multiple calls a day from people who said she had called them several times when she hadn't called them at all."If I'm trying to live my life, and I'm getting phone calls throughout the day, and my phone is constantly ringing for a scam purpose, it's frustrating," Akpan said. "And also just receiving these voicemails of upset people chewing me a new one, and I'm like, 'I'm not calling you!' "The Better Business Bureau of Nebraska, SW Iowa, South Dakota, and Great Plains Kansas said scammers usually only clone a person's number for 24-48 hours then move on to new ones. The Federal Communications Commission says it's best not to pick up a call from an unknown number because if you do, criminals will know your number is active."Really, it's important not to trust the caller ID. The fact that it says it's coming from an area code that we're not familiar with doesn't really mean anything these days," said Jim Hegarty, CEO of the BBB Nebraska.The FCC adds that if your number's been spoofed, there's not much you can do other than change your voicemail to let people know of the situation. 1557
