SAN DIEGO (KGTV and CNS) - Trial started Monday for the Yuma, Arizona police officer accused of raping a woman during a visit to San Diego.Jared Elkins, 34, is charged with eight felony counts of rape for the alleged incident in September 2017.The 23-year-old woman’s mother called 911 to report a crime at a home on Marlborough Street in Kensington. Elkins, who is related to the alleged victim by marriage, was staying at her home.Elkins, the alleged victim, and two other family members went to dinner then watched a movie while drinking beer and wine at the home before the alleged assault occurred, according to prior court testimony.RELATED: Arizona police officer charged with raping San Diego womanThe alleged victim testified during a preliminary hearing in April that Elkins physically forced her to participate in sex acts despite her pleas for him to stop. The two other family members were asleep in the house so small "you can hear someone breathing in the next room," the woman testified.During the alleged assault, the woman said she asked Elkins what would happen if she cried out for help. "He said, ‘I would kill you,"' the woman testified. After the incident, the woman said she found another family member in the house and they called police.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Besides forcible rape, Elkins is charged with rape of an intoxicated person, forcible digital penetration, two counts each of forcible oral copulation and oral copulation of an intoxicated person, forcible sexual penetration and sexual penetration of an intoxicated person.Elkins -- a seven-year veteran of the Yuma Police Department who later resigned -- faces 14 years in prison if convicted, according to Deputy District Attorney Lisa Fox. 1834

SAN DIEGO (KGTV) - A former Border Patrol agent was sentenced Wednesday for trying to smuggle drugs across the U.S.-Mexico border while on duty in 2016.Noe Lopez, 37, of Chula Vista, was sentenced to 70 months in prison for attempting to smuggle methamphetamine and cocaine in exchange for cash. He pled guilty to the charges in June 2017.Investigators say the former Border Patrol agent agreed to pick up backpacks containing the drugs from the north side of the border while on duty. Undercover DEA agents used substances resembling drugs in the backpack drops.RELATED: Border Patrol agent arrested in North San Diego County on drug , weapons chargesIn a conversation with an undercover agent, Lopez discussed the area known as "Goat Canyon" as a preferred location, according to investigators, saying "Honestly, the thing is that there aren’t—there aren’t any cameras. Tina Camacho remembers asking her daughter Cirena Artero, 16, about her day at school."We talked, and she said her day was okay," said Camacho.Cirena is one of Camacho's five children."Around 6:45 p.m., we thought she went to her room. Around 7:30 p.m., we knew she was missing. SAN DIEGO (KGTV) — A foot pursuit between police and a suspect ended in an officer-involved shooting in the Logan Heights neighborhood Monday.An officer was trying to contact a 30-year-old Hispanic male, later identified as Enrique Aguilar, at about 3:20 p.m. over what he believed to be a narcotics violation, according to San Diego Police Capt. Tom Underwood. Aguilar fled, prompting a foot pursuit in the area of 3400 National Avenue, police say.Police said during the foot pursuit, Aguilar revealed a handgun.VIDEO: Video captures officer-involved shooting in Logan HeightsPAST OIS INCIDENTS: DA releases body cam footage, reviews several officer-involved shootingsOfficers say they ordered Aguilar to drop his weapon. Police said at one point, Aguilar pointed the handgun at officers, prompting an exchange of gunfire.Aguilar was struck at least once. He suffered non-life threatening injuries and was transported to a nearby hospital.Neither officer, one a 24-year veteran and the other a 2-year veteran, was injured in the shooting. Underwood added there was another male suspect they were searching for connected to the initial narcotics violation.Both directions of the 3200-3500 blocks of National Ave. have been closed to traffic as officers investigate.
