VISTA, Calif. (KGTV) - Kellen Winslow Jr. affirmed his innocence to 10News Thursday as he appeared in court to face a third charge of rape.The son of a Chargers legend, Winslow pleaded not guilty to the alleged rape a 17-year old girl in 2003.  10News was able to capture a few words with Winslow as he walked to his car in the parking lot outside court. When reporter Jim Patton asked about the new rape charge, Winslow responded it would all come out in court. Then asked if he was innocent of the other allegations of raping two women in Encinitas, Winslow said, "I'm advised by my lawyer to not speak on much. But yes, I am innocent." The new charge involves a woman who was 17 years old at the time. Winslow was 19. She claims he raped her while she was unconscious. Winslow Jr.'s attorney has previously said their relationship was consensual.  Thursday, the defense repeated a request for the woman's psychological history.Thursday's court hearing lasted no more than 15 minutes as attorneys debated whether this new case should be tried along with the other two rape allegations. Winslow Jr.'s attorneys argued the new charge could prejudice the other two.The judge allowed the cases to remain joined for now for efficiency but said the trial judge would make the ultimate decision.  Winslow is currently free on a million bond, while required to wear a GPS monitoring bracelet. His trial date was set for March 19th, 2019. 1507

Video of an Arizona guitar hero is wowing people around the country.  The guitarist is Ridge Brown, a senior at Ironwood High School in Glendale, Arizona. He played the national anthem for a school assembly and the video posted by his teacher has gone viral, with thousands of clicks and attention from national news outlets. The reason, Ridge is a student with autism. The performance in front of his classmates was the first time he played in public, and he nailed it. "I was a little nervous, but I always felt excited," Ridge told Scripps station KNXV in Phoenix. "Autism can't hold me back because I'm a real rock star." That's the message his dad, Glen Brown, loves to hear. "There's a very, very smart person inside there, trying to get out," Glen said. Glen's mission in life is unlocking that potential. These days, Glen said Ridge loves talking and interacting with people, but that wasn't always the case. Ridge was nonverbal until age three. Music was the thing that finally freed Ridge from his autistic silence when he started singing with the radio. "It helps me express every emotion I have inside my entire brain," Ridge said. Now, he has plans for an encore."If the Suns wanted me to play the National Anthem at the game I'll be doing that," Ridge said. At the end of Ridge's first performance, a thunderous applause warmed dad's heart. "I broke into tears," Glen said. VISTA (KNSD) - A Carlsbad man who allegedly drugged and sexually assaulted a 16-year-old girl and raped a woman he met online was charged Wednesday with 17 felony counts.Michael Fangman, 47, faces between 20 and 25 years in state prison if convicted of charges involving the minor, identified only as Jane Doe 1, and the woman, identified only as Jane Doe 2.Fangman was arrested shortly before 8:25 a.m. last Friday at his home, Carlsbad police Sgt. Reid Shipley said.Carlsbad police have been investigating since March when they received the first report of sexual assault. The 16-year-old girl contacted police on March 18 and alleged that she had been sexually assaulted by Fangman, who she had met online, Shipley said.The criminal complaint includes allegations that between March 11 and March 16, Jane Doe 1 was sexually assaulted and was given heroin by Fangman during that timeframe. He faces 14 counts related to Jane Doe 1, as well as three pertaining to Jane Doe 2, including forcible rape.According to the deputy district attorney, Benjamin Barlow, all of the alleged acts took place in Carlsbad in the month of March of this year. The judge ordered a no contact order with Jane Doe 1 and Jane Doe 2. (KGTV) -- The San Diego District Attorney is expected to decide later this week whether there should be a new trial in the case of Kellen Winslow Junior.Tuesday morning, the judge declared a mistrial after the jury said it was deadlocked on eight remaining counts. The counts include kidnapping, forcible rape and forcible oral copulation involving a hitchhiker last year in Encinitas and forcible rape and rape of an unconscious person for an alleged attack on a teenager at a party in Scripps Ranch back in 2003 when she was 17 and Winslow was 19. The other counts the jury deadlocked on are willful cruelty to an elder and battery against an elder. The prosecutor said the jurors were leaning toward conviction. "On each one of the counts, there were a majority of jurors who voted in favor of guilt. They voted 10-2 in favor of guilt on forcible sodomy of Jane Doe 2. They voted 10-2 in favor of guilt for the forcible rape of Jane Doe 4. They voted 10-2 in favor of guilt on the counts of elder abuse and elder battery regarding Jane Doe 5 and then they voted 8-4 in favor of guilt on the rape of an unconscious person for Jane Doe 4 and they voted 7-5 in favor of guilt on the kidnap for rape, forcible oral copulation and and forcible rape of Jane Doe 1," said Prosecutor Dan Owens. Defense attorneys said the deadlocked jury shows there were credibility issues among the accusers. There was no corroborating evidence whatsoever, it's just people's word," said defense attorney Brian Watkins. The case involved 12 counts and the testimony of 5 women."We were always concerned about trying the cases together. Our position was always that these cases would not be able to stand alone. We fought to keep the cases separate. We lost that battle. We took on all these cases at once and we still prevailed to the point that we did not get convicted of everything and we have more litigation to do," said Watkins. Monday afternoon, the jury convicted Winslow of raping a 58-year-old homeless woman in Encinitas last year. Jurors also found the former NFL tight end guilty of indecent exposure and lewd conduct involving two other women. He was acquitted of a second count of lewd conduct involving one of those women. Watkins said they'll appeal the three convictions. "We won't be satisfied until he's exonerated and he's back home with his family," said Watkins. He'd be facing an additional 6 months for each 1 of the misdemeanor counts of indecent exposure and lewd acts committed against Jane Does 3 and 5, for a total of potentially 9 years in prison," said Owens. Sentencing is on hold until a decision is made about a new trial. Winslow's father, Kellen Winslow Senior, a Chargers Hall of Famer attended every day of the trial, but declined to talk to the media. A hearing is scheduled for 10 a.m. Friday on setting a new trial. "Ten jurors did feel very strongly that he had committed forcible sexual offenses against more than one victim, that would lead to a lifetime prison term and that will be another factor we will consider very strongly in determining how to proceed with the case," said Owens. 3618
