(AP) -- The California Supreme Court overturned the 2005 death sentence for Scott Peterson in the slaying of his pregnant wife.The court says prosecutors may try again for the same sentence if they wish in the high-profile case. It upheld Peterson's 2004 conviction of murdering his wife Laci Peterson.Laci Peterson was eight months pregnant with their unborn son, and investigators said that on Christmas Eve in 2002, Scott Peterson dumped the bodies from his fishing boat into San Francisco Bay.The court on Monday said the trial judge made several significant errors in jury selection that undermined Peterson's right to an impartial jury at the penalty phase.The court ruled potential jurors for the death penalty phase were improperly dismissed after saying they disagreed with the death penalty but would be willing to impose it."The trial judge made a mistake by kicking those people off the jury, so the only people that sat on the jury were in the death penalty camp," said criminal defense attorney Gretchen von Helms.Prosecutors will now decide whether to retry the sentencing phase.While the sentence was overturned, the court affirmed the murder convictions. "The sentencing was a positive step. The other decision (convictions affirmed) was about what we expected. Now we go to the habeas appeal," said Lee Peterson, Peterson's father.The court will examine the case again when it decides a separate habeas corpus challenge, based on evidence. not presented at the original trial. Peterson's father declined to talk about the arguments in the appeal, but says he's expecting a development within the next four months.Peterson's family issued this full statement in response to the court's decision:Our family is sincerely grateful that the California Supreme Court recognized the injustice of Scott’s death penalty. For a long and difficult 18 years, we have believed unwaveringly in Scott’s innocence, so today’s decision by the court is a big step toward justice for Laci, Conner and Scott.Now our family will do two things: First, we wait for Stanislaus County District Attorney Birgit Fladager to decide whether to pursue a new penalty phase trial. If the DA elects to do so, a new jury would be seated, and they would hear all the evidence. They would then decide only Scott’s sentence: life without the possibility of parole or the death penalty. While we hope for the opportunity to present the new evidence to a jury, it is not likely that this penalty phase trial will happen. The case against Scott has weakened to the point where no jury would ever sentence him to death again and the District Attorney is aware of these facts.Second, we wait for the court to address the new forensic and eyewitness evidence we have submitted that shows Laci was alive the morning of December 24th and demonstrates Scott’s innocence. SACRAMENTO, Calif. (AP) — Lassen Volcanic National Park in northern California has temporarily banned overnight camping in some parts of its park after several interactions between campers and foraging bears. The decision was made to close down back-country camping in the Twin, Rainbow, Swan and Snag Lake areas after multiple visitors reported that bears had come to their campsites and searched their backpacks for food. The Sacramento Bee reported that the areas will remain open for hiking, but the park warns visitors to be careful. The National Park Service website said the policy will not only protect campers but “protect the bears by promoting the offending bear(s) to return to normal foraging behavior.” 724

(AP) — Californians who lost their home insurance because of the threat of wildfires will be able to buy comprehensive policies next year through a state-mandated plan under an order issued Thursday by the state insurance commissioner.As wildfires threaten the state, insurance companies have been dropping many homeowners who live in fire-prone areas.Most of those people turn to the California Fair Access to Insurance Requirements Plan, an insurance pool mandated by state law that is required to issue policies to people who can’t buy them through no fault of their own.But FAIR Plan policies are limited, offering coverage for fires, explosions and limited smoke damage.California Insurance Commissioner Ricardo Lara on Thursday ordered the plan to begin selling comprehensive policies by June 1 to cover lots of other problems, including theft, water damage, falling objects and liability.Lara also ordered the plan to double homeowners’ coverage limits to million by April 1.“You have people that now are being sent to the FAIR Plan and they have no other alternative. They won’t even get a call back from an insurance company to offer them a quote,” Lara said.The FAIR Plan has been around since 1968. It is not funded by tax dollars. Instead, all property and casualty insurance companies doing business in California must contribute to the plan.Known as the “insurer of last resort,” the plan has been growing in recent years as wildfires have become bigger and more frequent because of climate change. FAIR Plan policies in fire-prone areas have grown an average of nearly 8% each year since 2016, according to the Department of Insurance.Likewise, since 2015 insurance companies have declined to renew nearly 350,000 policies in areas at high risk for wildfires. That data comes from the state, and it does not include information on how many people were able to find coverage elsewhere or at what price.The FAIR Plan is governed by a board of directors appointed by various government officials. Lara says he has the authority to reject its operating plan. On Thursday, he ordered it to submit a new plan within 30 days that includes an option for comprehensive policies and other changes.California FAIR Plan Association President Anneliese Jivan did not respond to an email seeking comment.It’s unknown how much the plan’s new policies will cost. But rates for FAIR Plan policies are supposed to break even. The insurance industry must cover any losses. RIVERSIDE, Calif. (AP) — Police say a man who was suspected of burglarizing a vehicle was fatally hit by another car as he fled the Southern California scene. The 35-year-old man allegedly stole property from a car in Riverside, California, around 9:30 p.m. Thursday. The man's name has not been released. Authorities say the vehicle’s owner confronted the man, who ran away while discarding the items from the car. As he fled, the man tripped and fell into the path of a 2014 Mitsubishi Outlander. Police say the Outlander struck the man, who later died at a hospital. The Outlander’s driver was not injured and is cooperating with police. 648

Avery Monsen took us behind the scenes of the "Super Secret Secret Club."Monsen has a lot of day jobs these days. He writes and illustrates books for children and adults, he's done some acting and he's been in commercials. But these days, Hollywood isn't doing much. One day a friend of his asked him to make a video to help entertain his own kids, who were quite literally climbing the walls.“He knows that I have this sort of grab bag of circus and magic tricks and skills that are very rarely actually useful in life, but they are useful in entertaining children,” said Monsen.And so, the Super Secret Secret Club was born. You can find it online, on Instagram or on Instagram TV, and it is full of good, clean fun.“It’s just a bunch of cardboard and duct tape, but there’s also all these strings that go everywhere we’re probably going to lose our security deposit on this place, whoops,” said Monsen.There's no market research about what kids like and Avery describes himself as a someone who is quite possibly still a kid.“I think I’m just making things that I like is the truth, and my taste is the taste of a 4 and 9-year-old. The things that I think are funny are the things a 4-year-old thinks are funny,” said Monsen.He also made activity pages for kids. There's puzzles and games and even a Super Secret Secret Club membership card.“I knew that kids were going to get bored and antsy in the quarantine times. I felt the least I could do is make some fun videos for them," said Monsen.Monsen isn't in it for the clicks, likes or comments. He's purely helping kids laugh, for free. And admittedly, he says, he needed a project and he happens to have a garage full of crafts as well as a huge paper maché pet rock named Anthony, who talks, by the way.“Which maybe means I’m a bit of a hoarder. I have a lot of cardboard. We had just moved into this new apartment which had a garage. Before that, I was doing projects in the living room which made my wife very sad,” said Monsen.His content has kids everywhere giggling and Monsen says, “when you’re devoting your entire week to making a silly video and you’re not getting paid for any of it, getting videos of kids enjoying it and doing the activities and laughing really, really makes it worthwhile.”Certainly, it’s a worthwhile effort from a guy who has all the tricks, trades and a huge knack for making all the little ones laugh during a time when giggles are hard to come by. 2603
