SAN FRANCISCO (AP) — A jury on Monday ordered agribusiness giant Monsanto Co. to pay a combined .055 billion to a couple claiming that the company's popular weed killer Roundup Ready caused their cancers.The jury's verdict is third such courtroom loss for Monsanto in California since August, but a San Francisco law professor said it's likely a trial judge or appellate court will significantly reduce the punitive damage award.The state court jury in Oakland concluded that Monsanto's weed killer caused the non-Hodgkin's lymphoma Alva Pilliod and Alberta Pilliod each contracted. Jurors awarded them each billion in punitive damages in addition to a combined million in compensatory damages.A federal jury in San Francisco ordered the weed killer maker in March to pay a Sonoma County man million. He said the ratio between the billion in punitive damages and million in compensatory damages is too high. He said judges rarely allow punitive damages to exceed four times actual damages awarded.The California Supreme Court ruled in 2016 that any punitive damages exceeding 10 times the compensatory damages are likely unconstitutionally high. The court didn't propose a ratio it felt correct, but said punitive damages should almost never exceed nine times actual damages, it said.The punitive damages awarded Monday are 36 times the actual damages.The lawsuits have battered Bayer's stock since it purchased Monsanto for billion last year and Bayer's top managers are facing shareholders discontent.Chairman Werner Wenning told shareholders at Bayer's annual general meeting in Bonn last month that company leaders "very much regret" falls in its share price. At the same time, CEO Werner Baumann insisted that "the acquisition of Monsanto was and remains the right move for Bayer."Bayer's stock price closed Monday at .91 a share, down 45 cents or 2.76 percent per share, in trading on the New York Stock Exchange. SAN DIEGO (KGTV)- Unlike many of its neighboring communities, San Diego’s Midway District does not have any tall skyscrapers. But the local planning commission is hoping that changes very soon. For the last 11 years, the Midway Pacific Highway community planning group has had a plan to modernize Midway. With the city’s lease of the Valley View Casino Center coming up in 2020, the group is hoping to share some big ideas.“What better way to create more housing than in Midway,” Cathy Kenton, Chair of the Midway Pacific Highway Community planning group, said.The advisory group’s goal is to rezone much of the 1,300-acre district, to encourage new, mixed-use construction. A big part of that would be the 11,000 new dwellings, which could increase the residential population from 3,000 to 23,000 in the next 30 years. Except there is one problem — the city’s 30-foot height limit.In 1972, San Diegans voted on Prop D, which limits all buildings west of I-5 in the area (Coastal Height Limit Overlay Zone), to 30 feet.The commission believes this outdated law is stifling its potential growth, literally.“40 feet would be terrific, 70 feet would be awesome,” Kenton said. “Anything that would help us get a little more vertical would certainly open up the community, and not make it so dense.”The commission’s current redevelopment renderings do not include any high-rises.“So they’re all very flat and pretty boring looking, to be honest,” Kenton said. But they are still presenting these plans to the Smart Growth and land use hearing and to city council next week.Kenton says getting that approved is only the first hurdle. She believes the only way that Midway can reach its highest potential is if Prop D is overturned by the voters.That requires a community petition or a city council vote to put the measure on the ballot. “No one has a crystal ball for whats going to happen,” Kenton said. Kenton says the likelihood of getting the measure on the June or November ballots is slim, but they will keep trying.Those opposed to it say, constructing tall buildings would obstruct ocean views. SAN FRANCISCO (AP) — A U.S. judge in San Francisco has refused to immediately allow the Trump administration to enforce a ban on asylum for any immigrants who illegally cross the U.S.-Mexico border.Judge Jon Tigar on Friday rejected the Justice Department's request to suspend his earlier order temporarily blocking the ban. Tigar said the administration had still not shown that the ban was legal.At issue is President Donald Trump's Nov. 9 proclamation that barred anyone who crossed the U.S.-Mexico border between official ports of entry from seeking asylum. Trump issued the proclamation in response to caravans of migrants approaching the border.Tigar on Nov. 19 sided with legal groups who argued that federal law is clear that immigrants in the U.S. can request asylum regardless of whether they entered legally. 827
SAN DIEGO, Calif. (KGTV) - Christmas morning, more than 700 families drove through a toy and food distribution at the Jacobs Center on Euclid Avenue in San Diego. Families were given boxes of food from the San Diego Food Bank, plus every child was able to get out of their car to receive at least three wrapped gifts. There were also free gift cards available.“My little one smiled. He was so happy,” said Elsa Sarabia, a mom of five who drove through.Sarabia said she works as a chef, and both she and her husband have lost hours at work this year. This event meant more gifts for her children that she might not have otherwise been able to afford.“We don’t have a lot of money to buy stuff for the kids and we appreciate everything you do for us,” she said, thanking the organizers.This is the fourth time this event was held. It’s hosted by Shane Harris and the People’s Alliance for Justice, with support from Supervisor Kristin Gaspar and the San Diego Lifeguards.The event had to adapt this year to be safe due to coronavirus, but Harris said they knew they had to make those changes to continue to fill this need. The breakfast would usually take place in a big hall, but organizers designed a drive-through format for 2020.“Really just trying to make sure the needs of the community are met particularly at a time where COVID-19 has made it really difficult for a lot of families economically,” said Harris.One volunteer was dancing through the whole morning as she distributed food, saying she was glad to give up her Christmas morning if it meant helping those in her community who needed it this year."A lot of these people do appear to be in great need. "The amount of jobs up there or jobs that are very close to a fit for me are just non-existent, and I have come to realize that there are tons of other wonderful qualified people applying for the exact same jobs I am," said Schmidt.She was working as an executive assistant for three vice presidents at Navis, a company that specializes in technology for the hospitality industry. Some of their biggest clients include hotels and resorts."It was literally my dream job. It was the best company culture I had ever been a part of, just some of the most brilliant people that were just so down to earth. I loved going to work every single day," said Schmidt. Schmidt thought working from home would be temporary, just during COVID-19, until the day managers called an all-team meeting."And it was very tough for them to tell us we no longer had jobs, that they were doing everything they could to make the company survive," said Schmidt.After months of searching, she finally found an opportunity that made her hopeful, only to learn it was a scam. When it came time for the virtual interview, the scammer instead wanted to have a text conversation over Google Hangouts. "All they want is personal information; they did not want to know anything about my experience or background," said Schmidt. The FBI says hiring scams have spiked during the pandemic.Now, Schmidt is considering moving out of the small town of Bend to go back home to California, where there are more jobs available. The San Diego Workforce Partnership is offering on-demand training videos online. They're also connecting job seekers with affordable certificate programs to help people learn new skills. Workforce development partners in other cities are offering similar resources. Schmidt is broadening her search, considering jobs she might have overlooked before the pandemic."Knock on every single door because I know eventually one is going to open, and it's going to be the right fit for you," said Schmidt.
