Tom Kelly was the bombardier on the crew "Heaven Can Wait." They were part of the famous squadron known as the "Jolly Rogers."On March 11, 1944, while on a mission to bomb Japanese anti-aircraft batteries around Hansa bay in the South Pacific, the 11 person crew was shot down by enemy fire."My family had been involved in what was then a four-year research project," Althaus said.They gave that research to Project Recover. The group of marine scientists, archeologists, and historians went to work using science and advanced technology to find missing aircraft with servicemen still onboard."It's really easy to look on a map and say, 'hey, x marks the spot.' And it turns out that x could be several square miles,'" said Eric Terrill, Co-Founder of Project Recover and a Scripps OceanographerIn October 2017, Terrill and his team set out on a three-week expedition.  "These robots allow us to do very detailed surveys of the seabed using scanning sonar," he said.After 11 days on the water covering roughly six thousand acres and talking to fishermen, they found the wreckage."It was a mixture of elation and sadness," he said. "It's very humbling knowing this is really a grave site of historical importance."Althaus' cousin was no longer just a name and a face in black and white."For the first time in 74 years, we've seen what his grave looks like and that is a priceless gift," Althaus said.Today, there are still more than 72,000 missing U.S. service members from WWII. "There are stories like this all around the country of an uncle or a father or a grandfather that never returned home," Terrill said. "It's remarkable to think that [families] carry this loss for that many decades and then to actually see it play out is just amazing."Lieutenant Kelly's family has already been in contact with the families of seven other crew members on the plane. They're hoping the military will recover the remains from the wreckage. 2379

A Kentucky judge said Thursday that she hopes to issue a ruling soon on whether a grand juror in the Breonna Taylor case can speak publicly about the proceedings.Judge Annie O'Connell of the Jefferson County Circuit Court heard arguments during a 90 minute hearing Thursday from Kevin Glogower, the attorney for the unnamed grand juror, and Assistant Attorney General Victor Maddox.Glogower filed a motion on behalf of his client on Sept. 28, seeking a declaration of rights to "disclose information and details about the process and details of the grand jury proceedings."In a press conference held the next day, Glogower said his client had concerns about "truth and transparency.""Our client felt a strong conviction to step up and take action to get all of that information out," Glogower said at the time.Shortly after the motion was filed, Kentucky Attorney General Daniel Cameron said his team had no concerns with grand jurors sharing "their thoughts on our presentation."But in a filing Wednesday, his office moved to dismiss the motion because "this type of broad and unchecked disclosure could jeopardize not only witnesses and other grand jurors but also set a dangerous legal precedent for future grand juries."Cameron's office has also suggested a disclosure by the grand juror could undermine the pending criminal case against former Louisville detective Brett Hankison, who was indicted by the grand jury for wanton endangerment."I think one of the problems with getting a fair trial, in a case as high profile as this, is finding a jury pool that has not been tainted by pretrial publicity," Maddox argued Thursday.O'Connell quickly challenged that argument."That cat's already out of the bag," she said. A federal judge has dismissed adult film star Stormy Daniels' defamation lawsuit against President Donald Trump.Daniels sued Trump after he said Daniels' story of a man threatening her not to come forward with her story of her alleged affair with Trump was "a total con job."Daniels argued Trump's tweet "attacks the veracity of her account" of the incident and that Trump's statement was "false and defamatory, and that the tweet was defamation ... because it charged her with committing a serious crime," District Judge S. James Otero wrote in his opinion Monday.Trump had asked Otero to dismiss the lawsuit."The Court agrees with Mr. Trump's argument because the tweet in question constitutes 'rhetorical hyperbole' normally associated with politics and public discourse in the United States. The First Amendment protects this type of rhetorical statement," Otero wrote.Daniels says she and Trump had an affair in 2006, shortly after he married first lady Melania Trump and she gave birth to their son, Barron. Trump has denied the affair.In addition, Trump is entitled to attorney's fees, Otero said.Trump's attorney Charles J. Harder said in a statement to CNN, "No amount of spin or commentary by Stormy Daniels or her lawyer, Mr. Avenatti, can truthfully characterize today's ruling in any way other than total victory for President Trump and total defeat for Stormy Daniels.""The amount of the award for President Trump's attorneys' fees will be determined at a later date," Harder added.Daniels' attorney, Michael Avenatti, responded to the ruling on Twitter and said: "Daniels' other claims against Trump and Cohen proceed unaffected. A man is hospitalized, but expected to survive, after his girlfriend struck him with her car following a domestic argument, according to police in Port St. Lucie, Florida.The incident happened in the 1900 block of W. Dunbrooke Circle.Police said the man got out of the car and began walking down the street and the woman then dropped off her baby at their house, drove back to where the man was walking and hit him.Video posted by police shows crime scene tape around a car which appears to have a big dent in the hood and a shattered windshield.The man, described as the woman's 24-year-old live-in boyfriend, was airlifted to a hospital with head trauma.  He was undergoing surgery late Wednesday afternoon.Police did not identify either person but said the investigation continues. “It sounded like a car hitting a shopping cart," said Lance Chmura who lives just across the street from the crash scene. He was making breakfast around 9 a.m. when he heard the impact and ran out to help.“I went down, grabbed his hand and stabilized him because he was starting to thrash around a bit," said Chmura.The impact of the crash was so intense it sent the man flying 35 yards down the street.“She (the girlfriend) then left the scene, drove back home.  Her relative got in car and came back to the scene," said Master Sgt. Frank Sabol with Port St. Lucie Police.The victim’s grandmother would not reveal what the girlfriend said to her immediately after the crash, but said the couple had a good relationship and had just moved down here last month. She said she thinks this was an accident.“I think they were just playing around and didn’t realize the severity of it," said the grandmother.“The initial investigation determines she was on the wrong side of the road when he was struck," added Sgt. Sabol.Right now, it’s being investigated as a case of domestic violence. No arrests have been made.  1948
