SAN DIEGO (CNS) - An ex-con accused of sexually assaulting a 24-year-old woman in broad daylight on a Mission Beach street pleaded not guilty Thursday to a charge of assault with intent to commit a sex crime. Philemon Shark, 40, who has two prior convictions from Washington state for residential burglary from 2014 and 2015, faces life in prison if convicted, said San Diego County Deputy District Attorney Trisha Amador. Judge Joseph Brannigan set Shark's bail at million and ordered the defendant to have no contact with the alleged victim. Amador said all sexual assaults -- no matter what level -- are ``serious'' and taken ``exceptionally serious'' by the District Attorney's Office. ``I think part of the concern is that when an individual is attacked in broad daylight in an area where they felt safe or did not feel a threat, of course that's added concern, but our office takes all sexual assaults equally as serious,'' the prosecutor said outside court. The attack happened about 8:40 a.m. last Sunday on Bayside Lane near San Jose Lane, just off Mission Boulevard, according to San Diego Police Lt. Jason Weeden. Weeden said the victim was walking south when Shark allegedly approached her from behind, threw her to the ground and held her down while he assaulted her. The woman screamed for help, and several residents forced the man off her, the lieutenant said. When Shark tried to leave, some of the residents followed him but lost track of him, Weeden said. Then, about 45 minutes after the attack, one of the neighbors found Shark hiding in a breezeway. Shark allegedly fled but was apprehended by patrol officers and booked into jail. Weeden said Shark is from the Seattle area and was believed to have been living in San Diego for the last few months. SAN DIEGO (CNS) - Margaret Hunter, who pleaded guilty along with her husband -- former Rep. Duncan Hunter -- to illegally spending hundreds of thousands of dollars in campaign funds for personal purposes, was sentenced Monday to eight months of home confinement, slated to begin immediately, and three years probation.The former East County congressman's wife, who also acted as his campaign manager during much of the time the pair improperly spent campaign funds on personal expenditures, pleaded guilty to a conspiracy charge more than a year ago.Duncan Hunter pleaded guilty about six months later, then resigned from Congress the following month. He was sentenced in March to 11 months in federal prison, but has yet to serve any of his term as the COVID-19 pandemic led to a postponement of his self-surrender date. He's not expected to report to prison until possibly as late as January.Margaret Hunter's attorneys argued for an out-of-custody sentence involving home confinement and prosecutors agreed, citing her agreement to cooperate with investigators and the manner in which prosecutors say her husband directed blame at her when the allegations became public.Prosecutors did seek to have her home confinement delayed until January, as they stated it would be more punitive at that time, with the COVID- 19 pandemic currently keeping the majority of the general public confined to their homes.However, U.S. District Judge Thomas Whelan opted to begin her term immediately.Margaret Hunter made a brief, tearful statement to the court prior to sentencing, saying "I continue to take full responsibility. SAN DIEGO (CNS) - Eight more flu deaths were reported last week in the San Diego region, the county Health and Human Services Agency announced Wednesday.There were 264 lab-confirmed cases in total, a slight increase over the 257 cases reported the week of March 25. Emergency room visits by people with flu-like symptoms dropped from 3 percent to 2 percent over the same span, however.Overall, there have been 334 influenza-related deaths in San Diego County this season, compared to 82 during the same period last flu season.Victims have ranged in age from 1 to 101, and most had underlying medical conditions."Unfortunately, influenza-related deaths are still being reported, a sign that the flu continues to take a toll on the region," said Dr. Wilma Wooten, the county's public health officer . "While influenza activitypersists, people should continue taking precautions to avoid getting sick, especially getting vaccinated."The high number of deaths this season is related to unusually severe strains of the virus but also improved tracking by local medical communities, according to the county. Overall, there have been 20,404 lab-confirmed cases this season, compared to 5,292 cases this time last year.The Centers for Disease Control and Prevention reminds people that it isn't too late to get vaccinated against the flu. SAN DIEGO (CNS) - An SUV struck and killed a 63-year-old woman as she was crossing a street in the Talmadge area, police said Tuesday.It happened around 5 p.m. Monday in the 4600 block of El Cajon Boulevard, between 46th and 47th streets, San Diego police Officer John Buttle said.A 79-year-old man was driving a 2008 Lexus SUV westbound on El Cajon Boulevard near Menlo Avenue when he struck the pedestrian as she was attempting to cross El Cajon Boulevard southbound outside a crosswalk, Buttle said.The woman was trapped under the SUV before crews freed her and took her to a hospital, where she was pronounced dead, the officer said. The victim's name was withheld pending family notification.The SUV driver remained at the scene and intoxication was not believed to have been a factor in the crash, Buttle said. 824
