SAN DIEGO (CNS) - A motorist who allegedly struck and gravely injured a bicyclist near Lindbergh Field last month, then fled San Diego and was arrested in Kern County, pleaded not guilty Monday to a felony hit and run charge.Mauricio Flores, 29, is accused in the Aug. 21 crash at India and West Washington streets that seriously injured a 66-year-old man.The victim was hospitalized with what police at the time said was a life-threatening head injury. His current condition is unknown.Police said Flores was driving a 2005 Dodge Caravan that struck the victim.Video footage shot by a witness shows the driver of a van, which had Georgia license plates, pulling to a stop following the collision and getting out along with a female passenger, identified by police as 50-year-old Jessica Bailey.In the video, the pair walked over to the where the injured man was lying on the side of the road. After looking at him for few moments, the driver pulled the bent bicycle out from under the front of the van and set it aside, then got back into the vehicle along with his companion and drove off. A second, male passenger also was seen getting out of the van in the video, but he was not identified by police.About one week after the crash, San Diego police posted Flores and Bailey's names and pictures online and asked for the public's assistance in locating the suspects.According to the California Highway Patrol, an off-duty Kern County CHP officer who had seen a flyer about the hit-and-run case came across the Caravan while riding his motorcycle in Lake Isabella, an unincorporated community about 35 miles northeast of Bakersfield.The officer reported the van, which had California government-agency license plates.Three days later, another CHP officer spotted the van -- now bearing Vermont plates -- in a parking lot outside a Vons store in the area and called in sheriff's deputies, who found Flores and Bailey and arrested them, CHP spokesman Robert Rodriguez said.Flores was booked Sept. 3 into a San Diego County jail and remains held on 0,000 bail following his Monday morning arraignment. SAN DIEGO (CNS) - A motorist who fled a traffic stop in Encanto Tuesday led officers on a 40-minute pursuit that ended with his arrest near Lake Hodges, authorities reported.The man refused to yield when San Diego police tried to pull him over for a traffic violation in the 6800 block of Akins Avenue shortly after 9 a.m., SDPD public-affairs Officer Michael Stirk said.The motorist drove off to the east toward Spring Valley, then entered state Route 125 and headed north, Stirk said.Reaching Santee, the man entered SR-52 and headed west, then merged onto northbound Interstate 15 when he got to the Miramar area.While passing through northern San Diego with SDPD and California Highway Patrol personnel tailing him and tracking his pursuit aboard a police helicopter, the driver managed to avoid running over several spike strips that CHP officers hurled onto the roadway in his path.After entering Escondido, however, the man finally pulled to a stop on the side of the freeway near Ninth Avenue and was taken into custody without further incident about 9:45 a.m., Stirk said.The arrestee's name was not immediately available. 1139

SAN DIEGO (CNS) - Murder and other felony charges were filed Wednesday against a 20-year-old probationer who allegedly fired a gunshot toward his brother, missing him but inadvertently killing a next-door neighbor asleep in his bed.Manuula Save is accused in the Saturday morning death of Michael Walker, 38, who was shot about 1:45 a.m. by a bullet that traveled through a bedroom wall in the defendant's apartment and into the victim's unit in the 13400 block of Midland Road. Walker was hit once in the abdomen and died at a hospital about an hour later.Save faces life imprisonment if convicted of murder, shooting into an inhabited dwelling, assault with a semi-automatic firearm and being a felon in possession of a firearm.RELATED: Man killed by stray bullet in Poway apartment complex, suspect arrestedDeputy District Attorney Kristie Nikoletich said the shooting stemmed from a verbal argument and physical fight between Save and his older brother. "The defendant retrieved a firearm and fired in the direction of his brother to scare him and show his brother that he wasn't scared of him," Nikoletich said. But that bullet ended up going through a wall and striking a sleeping neighbor, Michael Walker. His grieving widow, Christina was inside the courtroom Wednesday, crying throughout the proceedings. 10News spoke to her earlier this week. "I'm just seeing this hole in his stomach, and then I look over, and there's a hole in my wall," Christina Walker said on the phone. She said he was sleeping in the guest room that night, so his snoring would not wake her up — A move that would place him right in the path of that stray bullet, and kill him hours later. Save then allegedly hid the 9mm firearm, which he was not allowed to possess due to a previous hit-and-run conviction involving the death of an elderly woman, Nikoletich said. SAN DIEGO (CNS) - In a ruling stemming from a lawsuit brought the city attorneys of San Diego and two other cities and the state, a federal judge today granted a preliminary injunction against ride-hailing companies Uber and Lyft, requiring them to classify their drivers as employees rather than independent contractors in accordance with a new state law.San Francisco-based Judge Ethan P. Schulman ruled in favor of California Attorney General Xavier Becerra, and the city attorneys of San Diego, Los Angeles and San Francisco in their lawsuit alleging Uber and Lyft have misclassified their drivers, preventing them from receiving ``the compensation and benefits they have earned through the dignity of their labor.''The suit alleges the companies are violating Assembly Bill 5, which went into effect Jan. 1 and seeks to ensure ``gig workers'' misclassified as independent contractors are afforded certain labor protections, such as the right to minimum wage, sick leave, unemployment insurance and workers' compensation benefits.Both companies issued statements indicating they would appeal the ruling, which is scheduled to go into effect in 10 days.Schulman wrote in his ruling that ``both the Legislature and our Supreme Court have found that the misclassification of workers as `independent contractors' deprives them of the panoply of basic rights and protections to which employees are entitled under California law, including minimum wage, workers' compensation, unemployment insurance, paid sick leave and paid family leave.''The judge said that under the ``ABC test'' used to determine whether a worker is an employee or an independent contractor, the companies would not be able to argue their drivers are independent contractors as they perform work that is within the company's usual course of business.Schulman recognized that the injunction could have major impacts for the companies, as well as some drivers who prefer to remain independent, and wrote that ``if the injunction the People seek will have far-reaching effects, they have only been exacerbated by Defendants' prolonged and brazen refusal to comply with California law.''The campaign for Proposition 22, a proposed ballot initiative sponsored by Uber and Lyft that would allow rideshare drivers to work as independent contractors, decried the ruling.``We need to pass Prop 22 more than ever,'' said Jan Krueger, a retiree who drives with Lyft in Sacramento. ``Sacramento politicians and special interests keep pushing these disastrous laws and lawsuits that would take away the ability of app-based drivers to choose when and how they work, even though by a 4:1 margin drivers want and need to work independently.We'll take our case to the voters to protect the ability of app-based drivers to work as independent contractors, while providing historic new benefits like an earnings guarantee, health benefits and more.''San Diego City Attorney Mara W.
