(KGTV) - Nearly six years after it passed, Proposition B will be in front of two courts this week, with the future of San Diego pension reform on the line.Prop B was on the ballot in June of 2012 and passed with 65% of the vote. It promised to solve San Diego's pension crisis by giving new City hires a 401(k) style retirement plan instead of a pension. The change went into effect for all city hires except police officers.Since then, it's been mired in legal challenges.Shortly after it passed, union leaders sued, arguing that any changes to union employment agreements have to be negotiated first before they're placed on a ballot. They said that then-Mayor Jerry Sanders violated that rule when he openly campaigned for the Proposition in 2012.In 2015, the State Labor Board agreed with the union claims.That ruling went to the California 4th District Court of Appeals, who overturned the Labor Board's findings in 2017.In 2018, the State Supreme Court reversed the 4th District's ruling. The Supreme Court sent the issue back to the lower courts to decide what an appropriate "remedy" would be to Sanders' improper campaigning."They did not say 'Overturn Prop B.' They could have," says Reform California's Carl DeMaio, who wrote Proposition B. "They said, 'Hey, district court, find out how you punish the City of San Diego for this violation.' The commission is seeking to determine whether the plan complies with state coastal management rules.The U.S. Fish and Wildlife Service said in a report presented to the commission in March that a massive house mice population is threatening the whole ecosystem on the rugged Farallon Islands, 27 miles (44 kilometers) off the coast of San Francisco.The archipelago is home to the largest seabird breeding colony in the contiguous United States, with approximately 300,000 to 350,000 birds of 13 species, including the rare ashy storm petrels. The islands are also used by marine mammal species for resting and breeding and by migratory birds.Federal wildlife officials proposed using helicopters to dump 2,900 pounds (1,315 kilograms) of cereal grain pellets laced with brodifacoum, an anticoagulant that causes rodents to bleed to death, which is banned in California.Officials acknowledged the plan will kill some seagulls and other species but argue that the benefits of eliminating the invasive species will heal the whole ecosystem."The only way to protect these species and allow the ecosystem to recover is 100% eradication of the mice," said Pete Warzibok, a biologist who has worked on the Farallon Islands for more than 20 years. SAN FRANCISCO (AP) — California has joined nearly two dozen states and municipalities in suing the federal government to stop a new rule that lets health care clinicians decline to provide abortions and other services that conflict with their moral or religious beliefs.California's Attorney General Xavier Becerra filed a lawsuit Tuesday in San Francisco that calls the rule unlawful, reckless and contradictory to laws that seek to protect patients from discrimination and ensure access to care.It says the new rule effectively authorizes discrimination and could curb access to health care for LGBTQ Californians, among others.A similar lawsuit filed in New York federal court on Tuesday was brought by 23 states and municipalities.The city of San Francisco sued over the regulation on May 2, hours after President Trump announced it. 845
