In yet another aggressive attempt to bypass federal appeals courts, the Trump administration asked the Supreme Court on Friday to hear a challenge to President Donald Trump's policy that bars most transgender individuals from military service.The policy, first announced by the President in July 2017 via Twitter and later officially released by Secretary of Defense James Mattis, blocks individuals who suffer from a condition known as gender dysphoria from serving with limited exceptions. It also specifies that individuals without the condition can serve but only if they do so according to the sex they were assigned at birth.District courts across the country have so far blocked the policy from going into effect. The 9th Circuit Court of Appeals heard arguments in one challenge earlier this fall and the DC Circuit will hear arguments in early December.On Friday, Solicitor General Noel Francisco filed petitions asking the justices to take up the issue in three separate cases that are still in lower courts so it could be decided definitively this term. Francisco argues that lower court rulings imposing nationwide injunctions are wrong and warrant immediate review.He writes because of the injunctions, "the military has been forced to maintain that prior policy for nearly a year" despite a determination by Mattis and a panel of experts that the "prior policy, adopted by (Defense Secretary Ash Carter), posed too great a risk to military effectiveness and lethality."House Democratic Leader Nancy Pelosi vowed to "fight this discriminatory action" in a statement Saturday."The President's ban is a cruel and arbitrary decision designed to humiliate transgender Americans who have stepped forward to serve our country," she added. "This bigoted ban weakens our military readiness and our country, and shows this president's stunning lack of loyalty to those who risk all to defend our freedoms."Earlier in the month, the Department of Justice warned the 9th Circuit Court of Appeals that it planned to ask for emergency relief to lift the nationwide injunction.The filing comes after Chief Justice John Roberts and Trump got into a public dispute about the independence of the judiciary this week. Roberts issued a rare statement on Wednesday criticizing the President for calling one lower court judge who ruled against him an "Obama judge." The President responded via Twitter criticizing Roberts and accusing the American judiciary of undermining national security.Under normal circumstances, the Supreme Court does not like to take up an issue before it has made its way through the lower courts. The justices like to have issues percolate below so that they can benefit from the opinions of lower court judges.Francisco has moved aggressively at times to get cases before a Supreme Court that is more solidly conservative with the addition of Justice Brett Kavanaugh.Francisco asked the justices to step in to review the lower court's decision in a case related to the addition of a citizenship question to the 2020 Census. INDIANAPOLIS -- An Allegiant Airlines flight from Indianapolis to Myrtle Beach, South Carolina, was forced to make an emergency landing Sunday evening after a “noxious smell” was detected in the cabin.Allegiant Flight 1878 took off from the Indianapolis International Airport at 3:00 p.m. Sunday. It was scheduled to land at Myrtle Beach International Airport at 4:27 p.m.Mid-flight, however, flight attendants came on the intercom and informed passengers that the plane was going to make an emergency landing at the nearest airport due to a “noxious smell” in the cabin.The plane landed at Asheville Regional Airport, where passengers were asked to deplane. A passenger aboard the flight told Scripps station WRTV in Indianapolis that as she did so she could smell a “burning, smoky smell” near the cabin.In a statement to WRTV, Allegiant said the flight was diverted to Asheville "out of an abundance of caution to check out an electrical odor. INDIANAPOLIS -- A man's quick reaction spared him from serious injury or even death after a chunk of concrete was thrown from an overpass on I-465 and shattered his windshield.Alan Cox was driving his Honda SUV on I-465 northbound Wednesday afternoon. He said he saw three men on the overpass as he approached the Pendleton Pike exit. Cox said he could tell they were up to no good, especially when he noticed one throwing something into moving traffic and in his direction."I knew he was going to throw something so I veered to the left a little. He nailed me. INDIANAPOLIS, Ind. -- Eight missing children were rescued in a five-day rescue operation in the Indianapolis area, according to federal authorities.The children saved in "Operation Homecoming" are between the ages of 6 and 17 years old, according to a press release from the U.S. Marshals Service’s Southern District of Indiana.Authorities said the children "were considered to be some of the most at-risk and challenging recovery cases in the area, based on indications of high-risk factors such as victimization of child sex trafficking, child exploitation, sex abuse, physical abuse and medical or mental health conditions."One arrest of an adult subject was made with charges including alleged crimes related to parental kidnapping, intimidation, weapons possession and custodial interference.The children were turned over to the Indiana Department of Child Services for victim assistance and placement.Federal authorities worked with other law enforcement groups, including Indianapolis police and the National Center for Missing and Exploited Children.“The Marshals are committed to assisting state and local agencies with locating and recovering endangered missing children to help prevent their falling victim to crimes of violence and exploitation,” said Dan McClain, U.S. Marshal for the Southern District of Indiana. “The message that we wish to convey to the missing children and their families is that we will use every resource at our disposal to find you.”This story was originally published by Thalia Brionez at KXXV. 1541
