RUTHERFORD COUNTY, North Carolina — A teen who shot and killed her mother's boyfriend will not be charged, authorities said.The Rutherford County Sheriff’s Office and the District Attorney’s Office said on Aug. 8, Chandra Nierman's 15-year-old daughter shot the 46-year-old male as he was attacking Nierman.Her other children, a 12-year-old son, and a 16-year-old daughter were there when the violence occurred. Sheriff's deputies said the man was threatening to "cut Nierman’s throat and kill everyone in the house."A release from authorities said:"Nierman’s twelve-year-old son retrieved a firearm and Nierman’s fifteen-year-old daughter took the gun from her brother and fired it twice, striking the deceased male in the chest. One of the fired rounds fragmented, grazing Nierman’s sixteen-year-old daughter in the leg."The 16-year-old was taken to a hospital and was released."Nierman suffered significant bruises and contusions from the assault," the release said.The investigation also revealed the deceased man had threatened Nierman several times previously, and four days before, he had assaulted Nierman and fired multiple rounds from a firearm inside the residence to threaten and terrorize her."The investigation further revealed that the deceased male, who had multiple firearms in the house and frequently carried one on his person, was a convicted felon and had two active domestic violence protection orders against him from two different women in Indiana and Ohio, although no domestic violence or assaults had been reported to law enforcement locally prior to the fatal shooting," the release said. "The deceased male has been positively identified as Steven Kelley, originally from Indiana."Based on the facts and the evidence, "it is the conclusion of the District Attorney’s Office that the shooting was justified and no charges will be filed," the release states. 1903

(AP) — A California judge has thrown out a 2016 state law allowing the terminally ill to end their lives, ruling it was unconstitutionally approved by the Legislature.Lawyers for advocates and opponents say Riverside County Superior Court Judge Daniel Ottolia did not rule on the legality of physician-assisted death. This time it’s linked to synthetic marijuana, also known as K2.Joyce Grady has seen the impact the drug is having in D.C. Living in shelters and on the streets has given her a front row seat to the problem.“It's gotten to the point if you hear an ambulance, or police, you automatically put that together with a K2 overdose,” Grady said.The drug is often made to look like marijuana. A mix of chemicals is usually sprayed onto herb or plants, that is then smoked.It can be cheaper and more powerful than marijuana, which is part of its appeal. (AP) — Californians who lost their home insurance because of the threat of wildfires will be able to buy comprehensive policies next year through a state-mandated plan under an order issued Thursday by the state insurance commissioner.As wildfires threaten the state, insurance companies have been dropping many homeowners who live in fire-prone areas.Most of those people turn to the California Fair Access to Insurance Requirements Plan, an insurance pool mandated by state law that is required to issue policies to people who can’t buy them through no fault of their own.But FAIR Plan policies are limited, offering coverage for fires, explosions and limited smoke damage.California Insurance Commissioner Ricardo Lara on Thursday ordered the plan to begin selling comprehensive policies by June 1 to cover lots of other problems, including theft, water damage, falling objects and liability.Lara also ordered the plan to double homeowners’ coverage limits to million by April 1.“You have people that now are being sent to the FAIR Plan and they have no other alternative. They won’t even get a call back from an insurance company to offer them a quote,” Lara said.The FAIR Plan has been around since 1968. It is not funded by tax dollars. Instead, all property and casualty insurance companies doing business in California must contribute to the plan.Known as the “insurer of last resort,” the plan has been growing in recent years as wildfires have become bigger and more frequent because of climate change. FAIR Plan policies in fire-prone areas have grown an average of nearly 8% each year since 2016, according to the Department of Insurance.Likewise, since 2015 insurance companies have declined to renew nearly 350,000 policies in areas at high risk for wildfires. That data comes from the state, and it does not include information on how many people were able to find coverage elsewhere or at what price.The FAIR Plan is governed by a board of directors appointed by various government officials. Lara says he has the authority to reject its operating plan. On Thursday, he ordered it to submit a new plan within 30 days that includes an option for comprehensive policies and other changes.California FAIR Plan Association President Anneliese Jivan did not respond to an email seeking comment.It’s unknown how much the plan’s new policies will cost. But rates for FAIR Plan policies are supposed to break even. The insurance industry must cover any losses. And if the plan generates a profit, that money is given back to insurance companies.FAIR Plan policies have been limited because, in general, the insurance industry doesn’t want state-mandated plans to compete with private insurance plans. But Amy Bach, executive director of United Policyholders — a nonprofit advocating for consumers in the insurance industry — says her group is “hearing from panicked consumers daily.”“If (insurance companies) don’t like it, the solution really is to start doing their job and selling insurance again,” she said. “This is an untenable situation.” 3083

Robert Grays was having the game of his life on Saturday as his Midwestern State University squad was beating Texas A&M-Kingsville 35-13. The 19-year-old sophomore had matched a career-high with seven tackles, with his team about to improve to 2-0 on the season. Saturday ended up being Grays' final game.  With 3:24 remaining in the fourth quarter, Grays went in for a tackle, severely injuring his neck. After being transported to Houston for treatment, Grays died on Tuesday from the injury. Grays was the squad's starting cornerback, and also played on special teams. Grays was a graduate of Fort Bend L.V. Hightower High School in Missouri City, Texas."We are saddened by the loss of Robert Grays, one of our own. This is not an easy time for anyone associated with the football program," MSU coach Bill Maskill said. "He was a tremendous individual. I really believe he might have been the most popular man on our team."He always had a smile on his face. I never saw him have a bad day. He was an uplifting spirit for all of us. He was an exciting, fun loving guy. He's going to be sorely missed. Somehow, someway we'll find a way to fight through it. Robert would want us to forge ahead."Saturday marked a deadly day in college football.
