The charges against him include one count of first-degree intentional homicide; one count of first-degree reckless homicide; one count of attempted first-degree intentional homicide; and two counts of first-degree reckless endangerment.In the release, Pierce described what the attorneys will be arguing in court on Rittenhouse's behalf.Pierce argues that when Rittenhouse finished his shift as a lifeguard in Kenosha last Tuesday, he decided he wanted to help clean up damage in Kenosha left amid unrest over the police shooting of Jacob Blake.He and a friend went to a local high school to remove graffiti, according to Pierce. Later that day, they received information about a call for help from a local business owner, whose downtown Kenosha auto dealership was largely destroyed, Pierce says. The business owner said he needed help defending his business.So Rittenhouse and his friend armed themselves with rifles and headed to the business. Pierce added that the weapons were in Wisconsin and never crossed state lines.It was a gun Rittenhouse legally couldn’t carry in Wisconsin due to his age.Rittenhouse and others stood guard at a mechanics shop near the car depot, even after the curfew was in effect.Law enforcement soon began to clear Civic Center Park of protesters, pushing many of these people to where Rittenhouse was standing guard, according to his attorneys.They argue that several times, protesters threatened and taunted Rittenhouse, but he never reacted. "His intent was not to incite violence, but simply to deter property damage and use his training to provide first aid to injured community members, according to the attorneys.They argue that Rittenhouse soon became concerned about protesters injured in clashes with police, and went to provide first aid at a gas station. As he was returning to the mechanics shop after providing aid, he found that police formations had blocked his way, so he returned to the station.Attorneys say protesters then began to chase Rittenhouse, still armed with a long rifle, and he attempted to run away. "Upon the sound of a gunshot behind him, Kyle turned and was immediately faced with an attacker lunging towards him and reaching for his rifle. He reacted instantaneously and justifiably with his weapon to protect himself, firing and striking the attacker," according to Pierce.Court records claim one of the victims, Joseph Rosenbaum of Kenosha, threw a plastic bag at Rittenhouse before the teen shot and killed him. Rittenhouse’s attorneys share a different story.Rittenhouse soon found he was facing against a "mob" as people kicked and swung at him, Pierce argues."In fear for his life and concerned the crowd would either continue to shoot at him or even use his own weapon against him, Kyle had no choice but to fire multiple rounds towards his immediate attackers, striking two, including one armed attacker. The rest of the mob began to disperse upon hearing the additional gunshots," according to Pierce.After allegedly shooting three people, two of whom later died, Rittenhouse walked toward police columns with his hands in the air. "The police did not take Kyle into custody at that time, but instead they indicated he should keep moving," according to the attorneys.But the criminal complaint shows that as he was walking away, Rittenhouse called his friend to tell him that he just killed someone.Kenosha Police Chief Daniel Miskinis said Friday that the shootings never should have happened.“We’ve had two people lose their lives senselessly while peacefully protesting,” Chief Miskinis said.TMJ4 News captured video of Rittenhouse holding his hands in the air as he approached police after the shootings, but officers are seen moving past him to tend to the victims. Chief Miskinis said at the time, there was nothing to suggest Rittenhouse was a threat.“There were a lot of people in the area, a lot of people with weapons and unfortunately a lot of gunfire,” Chief Miskinis said.Pierce meanwhile criticized prosecutors in Kenosha, saying they did not conduct a "serious investigation.""After learning Kyle may have had conservative political viewpoints, they immediately saw him as a convenient target who they could use as a scapegoat to distract from the Jacob Blake shooting and the government’s abject failure to ensure basic law and order to citizens," Pierce concludes.Rittenhouse turned himself into police in his hometown of Antioch, Illinois on Wednesday morning. The court hearing for Wednesday was postponed in Downtown San Diego after a judge recused himself from the case.Two weeks ago, Debbie Mushet voted to have the county take over the Julian Cuyamaca Fire Protection District [JCFPD]. “I definitely voted yes for it, and I thought that was the end of it,” Mushet said. In this special election, 56% of Julian residents voted to have the San Diego County Fire overtake the historic volunteer department. “It’s worked as long as I’ve been up here, but it doesn’t work anymore. There’s a time when things just need to change,” Mushet said. “The volunteers have done a great job ion the past, but it’s just the money wasn’t going to be there.”Despite losing the special election and a unanimous vote by the Local Agency Formation Commission to officially dissolve the department, volunteer firemen are not ready to give up. Attorney Cory Briggs, who represents JCFPD said that decision was made through secret meetings. Therefore, the election results and the commission votes are “null and void.” When the County transition team came to the station on Monday, protestors staged a sit-in, refusing the leave the premises. JCFPD said in a statement, the County sent armed Sheriffs Deputies to “intimidate the unarmed JCFPD personnel who were peaceful truing to secure their facilities and equipment while the new lawsuit works its way through the courts.”“CalFire and the Julian Fire Department that exists now, I don’t understand why we can’t coexist,” Debbie Hickey said. “Every time it’s been really good response times. They knew right where to come.”For years, Hickey has relied on the Julian Fire Department for emergency care for her ill husband. She said she trusts the locals more than an outsider who would be assigned to cover the Julian area. “If I was to call 9-1-1, I don’t know who will come, I don’t know what the response time will be, and that’s a very scary situation to be in,” Hickey said. “My husband is staying down in the city during this time because quite frankly, I’m scared to death to let him come home to Julian.”A volunteer fireman told 10News off camera that since Monday they have not been allowed to respond to emergency incidents. In fact, they said their radios were disconnected. In the meantime, all 9-1-1 calls are being handled by Cal-Fire Station 50, down the street from the JCFPD station.While there is no official sit-in happening now, there are still many volunteers at the station. Volunteer crews have barricaded their engines inside the garage with their SUV’s, to try to stop the county from towing their vehicles. Either way, Mushet said this back and forth is getting out of control. “Let the vote speak for itself, let the count come in, volunteers step back, and it’s over and done,” Mushet said. “This is ridiculous. They asked for the vote they got their vote, and they were not happy with the decision, so they’re refusing to give in and it’s just sad. I’ve never seen this town so divided.”Wednesday’s court hearing scheduled for 8:30 a.m. was delayed after the assigned judge recused himself from the case. No reason was given for his recusal. JOHANNESBURG (AP) — Zindzi Mandela, the daughter of South African anti-apartheid figures Nelson Mandela and Winnie Madikizela-Mandela, has died aged 59. State television the South African Broadcasting Corporation has reported that Mandela died at a Johannesburg hospital early Monday morning. At the time of her death, she was South Africa's ambassador to Denmark. The Mandelas' daughter came to prominence in 1985, when the white minority government offered to release Nelson Mandela from prison if he denounced violence perpetrated by his movement, the Africa National Congress, against apartheid, the brutal system of racial discrimination enforced in South Africa at that time. (AP) — The X Prize Foundation is developing a contest for technology that can detect and extinguish wildfires before they grow too large.X Prize Foundation chairman Peter Diamandis made the announcement Friday at the Near Future Summit in La Jolla, California. Diamandis says it will take about 100 days to develop the rules for the contest. After that, the foundation will try to find a sponsor and launch the competition.Democratic Gov. Gavin Newsom joined Diamandis on stage for the announcement. California has experienced its deadliest and most destructive wildfires in history in the past two years.Newsom has solicited proposals from academics, private companies and entrepreneurs for innovative ways to address California's wildfire problem.
