SAN DIEGO (KGTV) — The man accused of fatally stabbing a motorist seven times in the South Bay during a road rage dispute was convicted of second-degree murder Friday.Jurors found Rickey Vernon Smith, 60, guilty after only one day of deliberations in the Nov. 27, 2018, slaying of 36-year-old Horace Williams Jr.Smith is set to be sentenced on Dec. 11.RELATED: Local man brings families light in times of needThe road rage confrontation between Smith and Williams came to a head near Chula Vista Golf Course, after the two argued along several roadways last November. Williams reportedly threw a soda cup at Smith's vehicle before Smith struck Williams' minivan.Prosecutors say Smith then got out of his truck after cutting Williams off, walked over to his driver's side window, punched Williams in the face and walked away, until walking back and stabbing Williams several times with a knife.Witnesses said Williams got out of his van and collapsed in the roadway, bleeding heavily. During a 911 call after the stabbing, Smith told a dispatcher Williams had cut him off and threw a drink at his truck. He added that he followed Williams and later punched and stabbed him out of self-defense after Williams punched him.Smith claimed Williams had lunged at something near the center console of his van and Smith produced his knife "as a last resort," defense attorney Brian Watkins said in court.Prosecutors argued against those claims, citing physical evidence that Smith had forcefully stabbed Williams and was not harmed in the altercation.City News Service contributed to this report. 1801

SAN DIEGO (KGTV) - The local ACLU is now firing back at ICE officials after news broke Tuesday of a new measure in place of blocking certain calls from detainees’ being housed at the Otay Mesa Detention Center.“For the government to interfere with the people's ability to make those calls and advocates abilities to receive those calls is deeply troubling,” said ACLU senior staff attorney Mitra Ebadolahi. She’s now sent a letter to both ICE and ICE’s contractor, CoreCivic, demanding answers and writing in part, "…legally, these blockages may violate the constitution."On Tuesday, Alex Mensing with Pueblo Sin Fronteras said his number was blocked along with numbers to another immigrants rights' activist group, Otay Mesa Detention Resistance. Mensing told ABC 10 News, “Last time I checked, in the United States we're not supposed to censor people's ability to denounce abuses, to denounce medical negligence, to denounce physical assault by guards…by private prison guards or ICE officers against the people.”The Otay Mesa Detention Center has come under fire for allegations of poor health conditions and abuses inside as hundreds of people being housed there were testing positive for COVID-19.“Without more information, it does appear that his kind of blockage is either retaliatory or at least viewpoint discriminatory,” added Ebadolahi.The ACLU is demanding that ICE remove the blockage and offer a response by next Tuesday.CoreCivic referred ABC10 News to ICE which sent a statement Wednesday reiterating part of a statement from Tuesday which reported that it temporarily blocked detainee calls to a specific San Diego area phone number after calls resulted in disruptive behavior from detainees. SAN DIEGO (KGTV) - The hospital patient who brutally beat a San Diego nurse faced a judge on Friday for his sentencing. 10News was in the courtroom, where the nurse described how she fought for her life while 41 year-old Geoffrey Brizzolara attacked her.“I stood in his doorway and I said, ‘How may I help you, sir?’ His response was to lift a 25-pound chair over his head and throw it at me,” nursing supervisor Mary Prehoden told the courtroom. “Mr. Brizzolara beat me with his fists. He kicked me and then scratched me and he pulled a handful of hair straight out of my head,” she went on to say.The attack happened last summer at Scripps Mercy Hospital in Hillcrest. He was a patient at the hospital and apparently has a history of mental health issues. He did not know Nurse Preholden.“His actions were deliberate and vicious. I was defenseless,” she told the courtroom.She was joined by other nurses who say that patient violence against nurses is a constant concern across the country. Nurse Trish Mcauliffe told us, “The resources have to be increased- mental health resources.” Mcauliffe described how she was once attacked by a different patient at another hospital. “I ended up with a split lip [and] loose teeth and then he stood in the doorway, laughing.”Friday, Brizzolara was sentenced to one year behind bars, with an option for early-release to a mental health treatment facility.“Every single one of us who chooses to do this for a living is under threat every day in every hospital in this country,” added Prehoden. 1542
SAN DIEGO (KGTV) - The federal watchdog agency that aims to protect consumers from unfair, deceptive, or abusive practices is suing a San Diego-based company.On Tuesday, the Consumer Financial Protection Bureau (CFPB) sued Encore Capital Group and its subsidiaries, claiming they violated the terms of a 2015 legal agreement.The CFPB claims, “Since September 2015, Encore and its subsidiaries violated the consent order by suing consumers without possessing required documentation, using law firms and an internal legal department to engage in collection efforts without providing required disclosures, and failing to provide consumers with required loan documentation after consumers requested it.”The lawsuit says after the effective date of the consent order, “Encore filed more than 100 lawsuits to collect consumer debts after the applicable statutes of limitations had expired."The lawsuit also claims Encore failed to disclose that consumers might incur international-transaction fees.In response to the lawsuit, the company's Executive Vice President, General Counsel, and Chief Administrative Officer Greg Call said Encore is built on a foundation of treating their consumers fairly and respectfully."We are disappointed that the CFPB has chosen to file this lawsuit on outdated issues, but we will continue to engage with the CFPB and work to ensure that we maintain policies and practices that fully comply with all applicable legal requirements. We believe that there will be no material operational impact as a result of the suit," said Call.
