SAN DIEGO (KGTV) — Several Californians are suing a state senator for blocking them on his Twitter page, a lawsuit which could impact how all members of the public are allowed to interact with their elected officials. The lawsuit alleges that Dr. Richard Pan (D-Sacramento) violated the rights of several people when he blocked them. Pan is the senator who wrote the 2015 California law that requires children to get vaccinated before going to school. Those who are suing Pan are advocates against vaccination. Pan and other lawmakers argue that people should not be allowed to post or comment what he considers to be false and misleading claims about the safety of vaccination on his page, which he says helps spread dangerous information.RELATED: DOJ to appeal ruling that Trump cannot block social media usersBut others argue that the social media pages of elected officials are public forums, therefore open to everyone with speech protected by the first amendment. Specifically, they accuse Pan of viewpoint discrimination.Earlier this year, a judge ruled in a case against President Donald Trump, who blocked several political opponents and was sued on similar grounds. But such a precedent could go beyond protecting the ability to post a point of view. San Diego Assemblymember Lorena Gonzalez-Fletcher put out several tweets on the issue Monday, suggesting that she should have the right to block people who post abusive, threatening and harassing messages.  1482

SAN DIEGO (KGTV) - Small hands eagerly grabbing candy aren't always paired with young minds showing good judgment. That was certainly the case in San Diego County on Halloween night, when surveillance video captured trick-or-treaters behaving badly.“Frustrating and really disappointing,” said Eastlake resident K.C. Helman.Helman returned home from trick-or-treating with his kids Thursday night to find his candy bowl gone.Video showed two costumed kids walking up to the bowl. One of them grabbed it and they both ran away.It wasn’t the only trick on Halloween night. 10News gathered a collection of videos posted by residents victimized by some frightful behavior. The candy thieves are a far cry from the generous South Bay boy who was caught on camera in 2017 pouring his own candy into an empty bowl so other children wouldn't be disappointed.Lawrence Malot, then 15, explained what motivated him to share his candy. He's not the only good example in San Diego. Ty’evon Walker also gave up his candy to other kids, and told 10News his good reason. 1060

SAN DIEGO (KGTV) -- Scooter riders near the beach are checking their rides a little closer following reports of a group of vandals cutting the brake lines on Byrd scooters in Pacific Beach. "That actually happened to me once in Key West. I had rented scooters and somebody had cut the gas line and we had to walk several miles,” said Jamie Gustine. It was a gas line then, but Jamie says now she’s forced to worry about cut brake lines when she rides. "My kids have ridden them, I have an 8 year old and a 12 year old who was riding the scooter as well, so that's where it scares me the most," she continued. Several people took to social media after the holiday weekend reporting a group of people cutting brake lines on Byrd scooters in Pacific Beach. "It's always something you're thinking about as a parent,” said Michael Cole. Michael Cole, thinking about it as he teaches his 7-year-old daughter to ride. "Somebody is eventually going to get hurt when you're doing something like that, especially down here by the beach, you grab a scooter, you're not thinking that someone cut the break lines."San Diego Police say you should contact the scooter company directly so they can remove the damaged scooters from the streets. The companies would have to file a vandalism report with police. 10News reached out to Byrd for comment, they sent us the following statement: 1379

SAN DIEGO (KGTV) — Stephanie Eppig didn't sleep much last night. She was busy transforming her business model - under a very tight deadline.“I had to redo the entire schedule, try to line up a food partnership, change our hours,” she said.Eppig co-owns Eppig Brewing, with locations in vista and Point Loma.It was getting back up to speed just in time for July, its busiest month .Then, the devastating news Monday - the county - placing strict new limits on bars, breweries and wineries, to stop the increased spread of the coronavirus. The Vista location - back to Curbside pickup only. As for Point Loma, all guests coming will be required to order food, prepared by a food truck on site.“It's really a punch in the gut right now for us and our employees,” Eppig said. “It’s awful because this is our livelihood and this is our employees’ livelihood and we have zero control over our ability to run our business.”To make matters worse, Eppig already exhausted all the money from her federal Paycheck Protection Program loan - which got the brewery through the first shut down. There's no new agreement on a second round of stimulus.Attorney Kelly DuFord Williams, managing partner at Slate Law Group, says businesses can talk to their banks about lending opportunities - but that involves risk.“Either the government in California or if the Federal Government is going to make that decision, they need to fund another round of P.P.P., so that people can keep their jobs, and people's mental health and family life can have some sort of stability,” said DuFord Williams, who represents small businesses and restaurants.County Supervisor Nathan Fletcher said Tuesday that he is hopeful federal officials will continue to provide economic support for impacted businesses and workers. The employees who went back to work and need unemployment once again will have to rectify for the benefits, the state Employment Development Department said. They can reopen their existing claims for a year, assuming they haven’t exhausted the money. The best ways to do so is online. 2072

SAN DIEGO (KGTV) - Sometimes, salads don't require any lettuce or greens. Sometimes, you just need the right mix of fruit and vegetables — and fish.West Pac Noodle Bar's take on green papaya salad brings a different take on salads, adding a heaping helping of papaya, mangos, carrots, and, yes, fish sauce. But as West Pac's Executive Sous Chef Jared Becker showed us, the combination is worth breaking out of your comfort zone. The Dish:Green Papaya SaladWhat You'll Need:For Dressing: 492
