EL CAJON (CNS) - A resident at an East County independent-living facility was ordered Thursday to stand trial on a murder charge for allegedly killing a fellow resident by beating him in the face and head with a frying pan following an early morning argument.Brad Masaru Payton, 26, faces 26 years to life in state prison if convicted of the murder charge and an allegation of personally using a deadly weapon in the killing of Matthew McCarthy.Police said the violence at the transitional group home in the 1200 block of Naranca Avenue in El Cajon was reported shortly before 5 a.m. last Dec. 20. Patrol officers arrived to find a badly beaten McCarthy in a bedroom at the residence, said El Cajon Police Lt. Walt Miller.RELATED: Police called from home 78 times leading up to murder with frying panMedics took the victim to a hospital, where he was pronounced dead. Payton was arrested without incident.According to Miller, the victim and the defendant knew each other and lived in separate rooms. During her Supreme Court confirmation hearing on Wednesday, Judge Amy Coney Barrett declined to give her legal opinion as to whether a President could pardon himself for crimes he may have committed while in office.Barrett's deferral came during a line of questioning by Senate Judiciary Committee member Patrick Leahy, D-Vermont. Leahy first asked Barrett if she believed that "nobody is above the law," including the President. Barrett agreed.Leahy then asked if she believed a President would be able to pardon himself, given that President Donald Trump has said he believes he has the right to do so in the past."Because it would be opining on an open question when I haven't gone through the judicial process to decide it, it's not one in which I can offer a view," Barrett said.Throughout his questioning, Barrett has attempted to avoid sharing her personal or judicial views on hotly-debated political topics, citing past precedent of previous Supreme Court justice nominees.It is true that the question of a President pardoning himself has not been challenged in court. But in 1974, at the height of the Watergate scandal, the Justice Department faced the possibility that President Richard Nixon would do just that. On Aug. 5, assistant attorney general Mary Lawton issued a memorandum opinion that "no one may be a judge in his own case" and that "the President cannot pardon himself."Despite Lawton's opinion, some legal experts believe that a President may still be able to issue their own pardon. EL CAJON (KGTV) - After 50 years of service, the well-known San Diego Highway Man is retiring. Thomas Weller has been helping thousands of people stuck on the side of the road since 1966. He tells 10News he started helping after a man helped him in a blizzard when he was a teenager living in Illinois.“I was on my way home about one or two in the morning and the blizzard put me off the road into a snow bank," said Weller.Weller says he never forgot that moment and hoped to be that saving grace for many others. Turns out he tells us he’s lost track of how many people he’s helped.“More than ten thousand, it's just I never keep track.” Weller had a stroke back in March and since then decided it’s best given his limited capabilities to retire.“I’ve lost my strength and my agility, not my judgment yet because I’m still driving.” He tells 10News it’s for the best that he retires because of how increasingly dangerous distracted driving has made the roads."It’s just extremely dangerous out there, more so now than it used to be.”While he is giving up one of his favorite passions in life, he isn’t giving up his outlook on life, “the most beautiful compensations of this life you cannot sincerely help another without helping yourself in the bargain.” 1266
