SAN DIEGO (KGTV) - A 46-year-old Oak Park man is being held without bail in San Diego's Central Jail after San Diego Police say he kidnapped a toddler and molested her.Francisco "Freddy" Diaz faces 8 felony counts, including burglary, kidnapping sexual assault and lewd and lascivious acts on a child under the age of 14. His alleged victim is just three years old.The girl's father, Silvester Soltero told 10News he was working on his car when, unbeknownst to him, the "strange" man who lived next door broke into a bedroom window, grabbing his sleeping daughter.Soltero said Diaz' mother brought his daughter home, but she didn't have her pants. “I grabbed my daughter and I was like, baby what happened?" Soltero said his daughter proceeded to tell him the man touched her private parts.  When the father asked who the man was. Soltero said his daughter pointed out Diaz."I lost it," said Soltero.When the father approached Diaz he became hostile.  “He started screaming if you snitch on me I'll kill you," recalled Soltero.The men fought.  Soltero showed a bruise where he said Diaz tried to poke him in the eye with a fork.Eventually, Diaz ran off, but San Diego Police caught him a short distance away.That's when Soltero said things got worse.  He soon learned his neighbor was a registered sex offender.“They should have told me, they should have told me I was living next to a pedophile, If I had known I wouldn’t have brought my daughter around here, there’s no way in hell," he said.Court records show Diaz was convicted in 2006 for molesting three girls on the playground adjacent to Oak Park Elementary School, which is right across from his mother's house.  He was sentenced to eight years in prison, in part because he already had a criminal history.  In 2000, Diaz was convicted of making a terrorist threat and assault with a deadly weapon.Court records show Diaz is schizophrenic and abuses drugs, specifically methamphetamines. A psychologist is quoted in court documents saying, "If he can remain in treatment, and avoid drug and alcohol abuse, he should not pose a danger to the community's children."12 years later, Diaz finds himself back under the legal microscope.Soltero wants to know why a registered sex offender could live right across from a school full of potential victims, and right next door to the home where Soltero's daughter and three other children live.San Diego Police say Diaz was in full compliance with the terms of Megan's Law.  He is required to check in with police every year and he does so, said Lt. Jason Weeden.  Because Diaz' child molestation convictions were misdemeanors, he doesn't have to steer clear of schools and playgrounds.Silvester Soltero says if that's true, the law should be changed.  “If you’re a sex offender you shouldn’t be by a school, period," he said.Diaz will be arraigned before a judge Wednesday.  Soltero says he will be there to make sure justice is done. 3102

SAN DIEGO (KGTV) -- A 17-year-old boy accused of killing a Carlsbad woman on a popular hiking trail denied the allegations against him during a virtual arraignment Thursday morning.Through his attorney, the teen denied all allegations. He faces charges in connection with the Nov. 23 death of 68-year-old Lisa Thorborg.Thorborg was on a morning walk at Hosp Grove Trail when Carlsbad police investigators said she was attacked and stabbed to death.On Dec. 14, Carlsbad police announced the arrest of a 17-year-old boy in the case. Little information on the teen was released, but police noted the suspect is a Carlsbad resident.Thorborg's death struck a chord with many in the community. In the days following her death, a large group came to honor her by finishing the walk she started.The woman’s death also left many neighbors upset and concerned about their safety while on that trail.During Thursday’s arraignment, the judge also granted the teen's request to two phone calls -- one to his Mom, the other to his grandmother.ABC 10News learned Thorborg’s family was also listening to the hearing through the phone.Another hearing in the case is set for Dec. 22. 1173

SAN DIEGO (KGTV) — A brush fire in the Japatul Valley area exploded in size in about an hour on Saturday, forcing nearby residents to evacuate.The Valley Fire ignited off Spirit Trail and Japatul Road, just southeast of Alpine, just before 2:50 p.m., according to Cleveland National Forest. The fire had scorched about 1,500 acres and was 0% contained as of 5:50 p.m.Fire officials said the dangerous rate of spread was pushing the fire southwest toward Lawson Valley. According to Cal Fire Cpt. Kendal Bortisser says the intense heat and rugged topography of the area are also posing a challenge for crews. SAN DIEGO (KGTV) -- 2018 was a big year for SeaWorld and new rides opening in San Diego seem to be paying off. In a new report, the company announced its first increase in attendance since 2015. A newly-released report by SeaWorld Entertainment, Inc. found that attendance increased to 22.6 million guests in 2018, up more than eight percent. According to Statista, 2018 marked the first time SeaWorld saw an increase in attendance since 2015. The report comes as SeaWorld San Diego gets ready to open another big attraction this spring. Construction on a new roller coaster, called Tidal Twister, is set to be finished in May. The coaster will feature a figure-8, horizontal design and dueling trains. Riders will be able to sit both backward and forward. On Monday morning, he got a call from his roommate, who had also been out of town, telling him the grates on the outside of the granny flat had been damaged.     Inside the house, there was one disturbing discovery after another.    "There was a trail of dirt in the shower. They had urinated on the toilet. He also found shoes and some sweatpants in his hamper that didn't belong to him. Sheets were pulled down and the pillows rearranged and stacked ... realized they were sleeping in my bed ... a creepy feeling of violation," said Yogerst.The intruders in this twisted Goldilocks tale: A homeless couple in their 20s. Neighbors spotted them in the driveway on Sunday. Yogerst says they found his hidden spare key and walked right in."It was like a Holiday Inn.
