SAN DIEGO (KGTV) -- An Escondido man who pleaded guilty to firing several rounds into the air in a crowded area when he couldn't get tickets to an Ice Cube concert was sentenced to three years behind bars Wednesday. Daniel Elizarraras, 22, pleaded guilty to discharging a gun at the Del Mar Fairgrounds in early September of 2018. Authorities say Elizarraras raised the gun before shooting into the air while he was in a large crowd near the ticket booth. Elizarraras was shot three times in the torso and once in the arm after he pointed the gun at a deputy. Defense Attorney Pedro Bernal said Elizarraras was severely depressed and trying to kill himself by suicide by cop. They asked for a lower sentence.However, the prosecution said he acted violently, causing chaos, and the situation could have been much worse.Judge Kathleen Lewis agreed saying, "I think it’s amazing that no one was injured or killed in this circumstance.”Before the shooting, officials said the venue was at capacity and began turning people away from the horse races and concert. Fights erupted between security guards and would-be concert-goers who were upset that they wouldn’t be allowed into the show. SAN DIEGO (KGTV) — An infectious disease expert at San Diego State University says early research suggests the COVID-19 pandemic could cause a spike in another, more deadly respiratory disease: tuberculosis.An estimated one in four people on the planet is already infected with TB without knowing it. The bacterium that causes the disease can lie dormant for years, even decades, waiting for the right moment to strike.San Diego State University professor Dr. Faramarz Valafar says SARS-CoV-2, the virus that causes COVID-19, could be just the right pathogen to trigger more TB cases to activate, both worldwide and in the U.S. And the symptoms of COVID-19 could help spread the TB bacteria more efficiently.“COVID-19 could act as a vehicle for transmission of tuberculosis,” he said. “This is a significant public health risk.”In the early 1900s, TB was the number one cause of death in the U.S. Today, it remains one of the top 10 causes of death worldwide with about 1.5 million deaths each year, although deaths in the U.S. are now rare. There were 515 deaths in the U.S. in 2017, the most recent data available.Although the tuberculosis is mostly curable and preventable with antibiotics, some strains have become drug-resistant.“I believe it's naive to think that because there is not much tuberculosis here in the United States, it’s going to remain that way,” said Valafar. “We now have a vehicle for the transmission of all sorts of tuberculosis strains from around the world to the United States.”The CDC estimates up to 13 million people in the U.S. have latent TB. Studies have shown the disease can activate when the immune system is weakened, including by HIV.“If COVID-19 comes in and keeps the immune system busy or overburdened, then my first worry is that tuberculosis in those people could activate,” he said.A small study out of China that has not yet been peer-reviewed suggests people with latent TB are at a higher risk of developing severe COVID symptoms. Other experts have raised concerns about the pandemic could exacerbate TB infections.Valafar said his second worry is that the symptoms of COVID-19 could help spread tuberculosis. Both pathogens take hold in the lungs and cause coughing.“If the person has tuberculosis, all it takes is for COVID-19 to make that person cough or sneeze and there will be a much higher risk of tuberculosis transmission,” he said.Valafar and his team are already studying the effects of TB and HIV in South Africa. They plan to soon expand their study to examine the effects of COVID-19 as well, with results expected in about a year.In the meantime, he’s sounding the alarm to urge people to heed public health warnings. SAN DIEGO (KGTV) - An Airbnb host says his condo was damaged by a guest who used a fake name to book the home.The host, who did not want to be identified because of the crimes committed, estimated nearly ,000 in damaged furniture and stolen belongings.He said the guest, who had recently created their profile and had no prior reviews, held a party in the unit.Damage included chipped furniture, rips on the couch, stains on the carpet and what appeared to be urine on the bed.The host also said that some of his property was stolen, including a watch and some of his medications. He said other items were also stolen, but could not reveal them because of the ongoing police investigation.“I still feel violated,” said the host, who reported the incident to police and Airbnb.He said Airbnb initially dragged their heels on helping reimburse him for all the damage, but on Thursday, finally offered to In a statement to 10News, an Airbnb spokesperson wrote, “We are supporting the host via our Million Host Guarantee and have suspended the guest’s account as we investigate this incident. SAN DIEGO (KGTV) -- A woman in Carmel Valley is warning others after she saw a man masturbating in public late Wednesday night. The woman, who didn't want to be identified, said she was doing a late-night load of laundry when she saw a man in a sweatshirt with the hood pulled up over his face and no pants on masturbating. The incident happened at an apartment complex near Seabreeze Farms Drive and Carmel Knolls Drive. “When I screamed ‘oh my god’ he didn’t budge, he didn’t move, he didn’t even look up at me. He just kept doing what he was doing,” she said. “He didn’t run, he just was in his, he was so comfortable.” She reported it to police and management and was told the same thing happened to another neighbor last week. Police told 10News they are investigating.  818

SAN DIEGO (KGTV) — A San Diego-area man and his grandmother filed a federal lawsuit against two San Diego County Sheriff's Deputies.The lawsuit alleges deputies responded to the wrong address and pulled a then-17-year-old out of his apartment. "I've never experienced something like that," said Cesar Jaramillo.Jaramillo says last October he was watching TV on the couch when he heard a knock at the door. He says deputies asked if someone from the residence called 911.According to his lawsuit, "Cesar informed defendants the call was not from his residence. When defendants asked Cesar if there was a young black female in the apartment, Cesar said 'No,' and informed defendants that they were at the wrong apartment building. Cesar knew who defendants were referencing and knew they lived in the other building. Cesar informed the deputies over half-a-dozen times that defendants were at the wrong building."Jaramillo tells 10News he complied with everything the deputies asked but felt like they didn't believe him."That's when I started closing the wide door, that's when he just reached in and grabbed my hand," Jaramillo said.The lawsuit claims, "Without warrant or probable cause, both defendants unreasonably lured Cesar to unlock and open the door, then entered into Plaintiff's residence and forcibly pulled Cesar by the forearms into submission, leaving instant bruises on both arms."Jaramillo's grandmother was in the back of the house at the time and said she woke up to the commotion."I saw my grandson laying on the ground, in handcuffs and I went crazy, and I said, what is happening," said Teodora Villalobos.According to the lawsuit, "Due to unreasonable seizure and force used on her grandson Cesar, as well as defendants' indifferent attitude, Teodora began having heart complications on scene."Jaramillo's lawsuit alleges negligence, battery, and unreasonable search and seizure, among other things.10News reached out to the San Diego County Sheriff's Department for comment, but a spokesperson they can't comment on pending litigation. 2066
