ESCONDIDO, Calif. (KGTV) - The 'Golden State Killer' arrest is shining the spotlight on a controversial DNA search known as Familial DNA.    In the summer of 2013, local communities were gripped by fear amid a string of unspeakable crimes.An unknown culprit dubbed 'The Creeper' entered five homes in Escondido and one in San Marcos, cutting screens, cutting the clothes of little girls and molesting them while they slept.The suspect left DNA at several scenes, but a search turned up no matches.  Ultimately the case went cold until detectives applied to the State Department of Justice - for a DNA familial search.In 2015, the mystery DNA profile was linked to somebody already in the system, a close relative of the suspect."They were able to determine through a familial search who the suspect likely was," said Deputy District Attorney Ryan Saunders.That suspect was Gilbert Chavarria, who recently pleaded guilty to a host of charges.  He was sentenced to 100 years to life in prison."Police did an excellent job gathering the evidence, but the leads were exhausted. Without the familial searches, we'd still be on our hands waiting," said Saunders.It marked the first use of the search in a local case.  Amid concerns from privacy advocates, Governor Brown in 2008 enacted a policy that familial DNA would be used only as a last resort.It's been rarely used but did provide the break in several serial killer cases, including the 'Grim Sleeper' case and now, the 'Golden State Killer' case.  In the latter, the mystery DNA was linked to a familial profile from an ancestry website.Some law enforcement experts tell 10News the recent cases could lead to a lot more requests for the DNA search.  Familial DNA also provided the break in the infamous 'BTK' serial killer case in Kansas. 1858

Ensa Cosby, daughter of embattled comedian Bill Cosby, has died at the age of 44, TMZ reported and the Associated Press confirmed on Monday. Ensa Cosby reportedly died Friday night in Massachusetts. The cause of her death is unknown as of Monday afternoon. Ensa Cosby was a steadfast supporter of her father, who has been battling accusations of sexual misconduct. Bill Cosby faced a sexual assault trial in 2017, which ended in a mistrial. Ensa Cosby issued a statement on last year on "The Breakfast Club" radio show backing her father. "The accusations against my father have been one-sided from the beginning. When he tried to defend himself, he was sued in civil court," she said. "I've seen the accusations become more horrific and extreme with time and I've witnessed my father's reputation and legendary works be dismissed without any proof."I strongly believe my father is innocent of the crimes that are alleged against him and I believe that racism has played a big role in all aspects of this scandal. How the charges came against him, how people believed them before they were ever scrutinized or tested, how people who questioned the claims were shut down and ignored."Ensa Cosby did not follow her father into show business. Her only acting credit came in 1989, appearing in one episode of "The Cosby Show."Ensa is the second of Bill Cosby's five children to have died. ELIZABETH, N.J. -- Following the announcement of a New York state park in her name, iconic transgender civil rights activist Marsha P. Johnson will be honored in her hometown of Elizabeth, New Jersey.Johnson's family was joined by Union County Freeholders Sergio Granados, Rebecca Williams and LGBTQ+ advocates to announce the future site of a public monument on Freedom Trail in Johnson’s honor.The city said the monument is "anticipated to be the first public monument in the State of New Jersey to honor a LGBTQ+ person and transgender woman of color."Elizabeth also announced that they will be holding a series of events during LGBTQ History Month in October to "engage with the community and the public to participate in the planning and creating of the historic project."Johnson died in 1992 at age 46. Elizabeth Holmes, a Silicon Valley businesswoman whose biotech company Theranos was once valued at billion, will reportedly attempt to claim “mental disease” in her criminal trial, according to multiple reports.Court filings released this week indicate Holmes’ lawyers want to introduce evidence “relating to a mental disease or defect or any other mental condition of the defendant bearing on the issue of guilt.” However, details of what exactly her mental state is, or what the lawyers intend to argue are redacted.Holmes founded Theranos as a Stanford drop-out at age 19. She, and her former romantic partner and Theranos president Sunny Balwani, face fraud charges for claiming their company’s machines could perform several diagnostic tests with just a single drop of blood.The prosecution says the pair knew all along the technology wasn’t capable of doing the tests as promised, and allegedly defrauded investors, doctors and patients. They were charged in 2018 and could face up to 20 years in prison if convicted.Holmes’ attorneys plan to introduce testimony from Mindy Mechanic, according to the filing, a psychology professor at California State University Fullerton.The university’s website lists Mechanic’s focus as “the mental health consequences of violence, such as Post-Traumatic Stress Disorder and depression as well as other important physical and social health outcomes” and that she also provides expert testimony in “complex legal cases involving interpersonal violence.”The judge is allowing the prosecution to conduct their own examination of Holmes, to gather any needed evidence.Holmes’ case is expected to begin in March 2021. 1666

ENCINITAS, Calif. (KGTV) — One person is dead after being hit by a vehicle in Encinitas late Saturday.San Diego Sheriff's Department reported just after 8 p.m. the person was struck in the 2500 block of S. Coast Highway 101. The driver involved remained at the scene and deputies do not suspect alcohol or drugs to be a factor.A Sig Alert for S. Coast Highway 101 was issued as deputies investigated.
