SAN DIEGO (KGTV) -- A 65-year-old woman was rushed to the hospital after being struck by a vehicle in Serra Mesa on Christmas eve. According to police, the incident happened just before 8 p.m. at the intersection of Ruffin Road and Village Glen Drive near the Village Glen Apartments. Police say the woman was crossing the street when she was struck by a 16-year-old driver. The woman was rushed to the hospital with major injuries. The teen remained at the scene after the crash. SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles.The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates.On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply.In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. SAN DIEGO (KGTV) - A 6,000-gallon tanker carrying highly flammable ethanol overturned in Mission Valley Thursday afternoon, prompting a hazmat response. The tanker overturned near the intersection of San Diego Mission Road and Rancho Mission Road near SDCCU Stadium after 3:30 p.m. The entrance to the stadium was closed as crews cleared the scene. Authorities said 40-60 gallons of ethanol spilled and made their way to a nearby storm drain. Crews were able to prevent the ethanol from entering the San Diego River.According to the San Diego Fire-Rescue Department, crews drilled into the tank to remove additional fuel.The driver was injured as a result of the crash and was taken to the emergency room. His injuries are unknown at this time. SDFRD officials said the driver tried to make a 90-degree turn when the semi overturned. At around 2 a.m. Friday, crews were able to move the truck upright.Roads that were closed by the incident were expected to be reopened by 6 a.m. 986

SAN DIEGO (KGTV) - A brazen package theft — and attempt to stop it — was caught on surveillance video at a Pacific Beach home.Penny Ryan wasn't home when the scene on her porch unfolded, but it was all captured on her doorbell camera. A man walked up to the residence with a small green skateboard and bag before he lays down the board and walks up onto the porch. The man then begins stuffing his bag with packages left on the doorstep.But before he gets away, a concerned nearby resident comes across the man as he's leaving and tells him to put the bag down multiple times.MAP: Track crime in San Diego County neighborhoodsThe thief appears to be willing to put the bag down, telling the resident, "I'll put it down, sir. Sir, I'll put it down." But instead, the man runs away.Ryan said the incident highlights a rise in crime within Pacific Beach, and residents are worried. A look at CrimeMapping.com shows there have been about 30 thefts and burglaries in the Pacific Beach area in the past six months."It has escalated so much in the last 3 years that we are all quite worried about how bad it’s going to get," Ryan said. SAN DIEGO (KGTV) -  A popular Thai restaurant in the College Area has been broken into for the second time in three weeks.At Sala Thai, there are sizzling entrees and simmering frustrations. "Saw the mess on the floor and thought what's going on?" said owner Chira Svangvitaya.A look at the surveillance video gave Svangvitaya the answer. Just before 5:30 Monday morning, a man in a hoodie is seen creeping into through the back door. He heads right to the cash register but finds it empty.He grabs some paperwork, empties the change dish and moments later, he leaves. It isn't for long. "He walked in and out three times, like he's not afraid of anything," said Svangvitaya.Two more trips nets him armfuls of stuff, including a computer, iPad, iPod, checkbooks and a case of soda. Near the end, he takes off his hood - and Svangvitaya's heart sank."I feel so sad and annoying. I don't know what I did to him," said Svangvitaya.The intruder is a stranger to her, but appears to be the same man who broke into the restaurant early Halloween morning. On that occasion, he used a crowbar to mangle the lock and damaged the register while grabbing 0 in cash. He also nabbed five tablets and a computer, crippling her online delivery business.Svangvitaya spent 0 to add a deadbolt after the Halloween break-in. This time, the intruder destroyed the repaired lock and the new deadbolt and went right on in.
