SAN DIEGO (CNS) - A former member of the U.S. national wrestling team, who was severely injured during a training camp exercise held at Camp Pendleton, has filed a lawsuit alleging the Marine Corps and USA Wrestling encouraged him and other civilians to take part in a military-style exercise involving weapons that the participants weren't adequately trained to use.Richard Perry and his wife Gina Cimmino filed the lawsuit Tuesday in San Diego federal court against the United States and Armament Systems and Procedures Inc., a company that manufactured and sold a padded baton used in the exercise that resulted in Perry's injury on Aug. 27, 2018.Perry and another civilian attendee of the training camp were provided batons and helmets with facemasks and given "instruction to strike, thrust and jab at the opponent's head and face to score a `kill shot,"' according to the complaint.As Perry's training partner jabbed with the baton, the weapon passed through a gap in Perry's facemask and shattered his eye socket and skull, pushing shattered bone fragments into his brain, the suit alleges.The injury nearly killed him and left him with multiple traumatic brain injuries, skull fractures and "permanent, disfiguring, disabling injuries" which "will require extensive future medical care, vocational rehabilitation, and life care for the rest of his life," according to his court papers.Perry and the other wrestlers were invited to Camp Pendleton as part of a joint event held by USA Wrestling and the Marine Corps that was partly intended as a Marine Corps recruitment initiative, according to the suit.Perry's attorneys allege National Team members were required to attend the camp, as non-attendance resulted in "adverse consequences, including losing a monetary stipend they otherwise earn as National Team members."The lawsuit alleges the Marine Corps and USA Wrestling "placed Richard Perry and other civilian Camp attendees into a `fight club'-style full- speed, full-contact military weapons training exercise," and that Marine Corps and USA Wrestling members "recklessly encouraged head shots and baton jabs by the inexperienced participants" during the exercise in which Perry was injured.The helmets provided to Perry and other wrestlers were "grossly unsuitable for the baton striking drills and posed a clear risk of serious injury," according to the suit. The plaintiff also alleges the Marine Corps and USA Wrestling failed to inspect or maintain the equipment used during the exercise and the batons were "dangerously unprotected," with the padding only held in place by duct tape.Robert J. Francavilla, the lead trial attorney on the case, said his client "suffered a traumatic injury that has affected his life, his livelihood and the lives of those who love him. SAN DIEGO (AP) — An animal rights group is asking the U.S. Securities and Exchange Commission to investigate SeaWorld over allegations that it misled investors about injuries during its dolphin shows.People for the Ethical Treatment of Animals said Thursday it had sent a letter to the SEC saying the marine theme park had lied when it said no animals are injured during the shows.The SEC declined comment.The group known as PETA is a shareholder in the company and alleges that SeaWorld trainers have caused injuries when they stand on the dolphins.It says veterinarians have found wounds and scars on dolphins at SeaWorld parks in California, Texas and Florida.SeaWorld said in response that it treats its animals well and has rescued thousands. SAN DIEGO (AP/KGTV) — Unlike most Californians, people in San Diego will be able to get a reprieve from the heat this Labor Day weekend by heading to movie theaters and dining inside a restaurant. Among California’s 10 most populous counties, San Diego is the only one with virus cases low enough to meet state standards for reopening theaters, museums and gyms, and resuming indoor dining — all with limited capacity to provide for physical distancing. San Diego County is listed in the state's second tier, or "substantial" tier, for cities reporting four to seven daily coronavirus cases per 100,000 residents and a positive test rate between 5% and 8%.As of Thursday, San Diego’s case rate is 5.8 and the testing positivity percentage is 3.8%. Since one of those metrics is in the second tier, the county isn't eligible to begin the 14-day countdown to qualify for the next tier of easing restrictions.Local officials say an aggressive reaction to outbreaks and a bipartisan approach have helped the county deal with the pandemic.While San Diego County has kept case rates low, the county reported two new outbreaks — in a business and in a restaurant/bar — on Thursday for a total of 17 community outbreaks in the last week.Officials warned this week that Labor Day weekend poses a threat to those gradually decreasing metrics and encouraged residents to be safe and avoid gatherings over the holiday weekend. 1422

SAN DIEGO (CNS) - A fire that erupted in the attic of a Rancho Penasquitos home early Monday displaced seven residents, but nobody was hurt.The blaze was reported shortly after 12:45 a.m. at the two-story house in the 8400 block of Corte Fragata, off Carmel Mountain Road north of state Route 56, according to the San Diego Fire-Rescue Department.One person in the home told dispatchers the residents smelled smoke and saw smoke coming from the attic, SDFRD spokeswoman Monica Munoz said. Crews knocked down the fire within 25 minutes and kept the flames contained to the attic area, but the house sustained smoke damage, she said.The American Red Cross was called in to help the displaced residents -- four adults and three children -- arrange for temporary lodging.The cause of the fire was under investigation. 821

SACRAMENTO, Calif. (KGTV) -- Republican California State Senator Brian Jones is behind a new bill that, if passed, would change the way military retirement pay is taxed. The bill, titled SB 1071, would exempt military retirement pay from the state’s income tax. According to Jones, California is one of only seven states that fully taxes military retirement pay. Other states include Montana, New Mexico, Rhode Island, Utah, Vermont, and Virginia.
