SAN DIEGO (CNS) - San Diego-area elected officials mourned the death of Supreme Court Justice Ruth Bader Ginsburg, with county Supervisor Nathan Fletcher calling her death, ``a heartbreaking loss for our country.''``Justice Ruth Bader Ginsberg had a brilliant mind, compassionate heart and deep appreciation for our constitution and what American values should represent,'' Fletcher said Friday. ``I had the great honor to have lunch with her a few years back and was blown away by her intellect and playful spirit.``As a professor at UCSD, her dissent in Shelby v. Holder is a masterpiece in constitutional law. There will never be another RBG.''The court ruled in the case that the provision of the Voting Rights Act of 1965 containing the coverage formula determining which jurisdictions are subject to preclearance based on their histories of discrimination in voting was unconstitutional.In her dissent, Ginsburg wrote, ``throwing out preclearance when it has worked and is continuing to work to stop discriminatory changes is like throwing away your umbrella in a rainstorm because you are not getting wet."Fletcher's wife, Assemblywoman Lorena Gonzalez, D-San Diego, tweeted, ``My heart aches. We will truly miss the clear vision and leadership of Ruth Bader Ginsburg. Rest in Power!''Senate President pro Tempore Toni G. Atkins, D-San Diego, said ``We have lost a major force of our time. Justice Ruth Bader Ginsburg was a tireless advocate for justice, a brilliant legal mind, and an outstanding role model for generations of people.``Like millions of Americans, I join Justice Ginsburg's family in mourning her devastating loss, and honoring her legacy of feminism, equality, and progress.''Assemblyman Todd Gloria, D-San Diego, wrote, ``Our nation is better, fairer, and more just because of Justice Ruth Bader Ginsburg. Godspeed Notorious RBG.''San Diego City Council President Georgette Gomez called Ginsburg ``a trailblazing advocate for women and a voice of integrity, justice, and equality on the Supreme Court.''``Her life has inspired generations to always pursue justice for all,'' Gomez said. ``In her memory, we must keep fighting to make equality a reality in America.''Ginsburg was the second woman appointed to the Supreme Court, nominated by President Bill Clinton in 1993.The Columbia Law School graduate taught at Rutgers and Columbia and was a fierce courtroom advocate of women's rights, making her an iconic figure to feminists and earned her the nickname ``Notorious RBG.''While heading the Women's Rights Project of the American Civil Liberties Union in the 1970s, she brought a series of cases before the court that helped establish constitutional protections against sex discrimination.Ginsburg died at her home in Washington of complications from metastatic pancreatic cancer, the court announced. Court documents state that ResMed's products -- which treat sleep apnea and other sleep disorders -- were provided to companies that in some cases began writing prescriptions to their patients entirely for ResMed equipment.Prosecutors say some examples of ResMed kickbacks included free home sleep testing devices, free or below-cost positive airway pressure masks and diagnostic machines, and free telephone call center and patient outreach services that allowed the companies to order resupplies for sleep apnea patients.RELATED: San Diego suing SDG&E for allegedly delaying pure water projectThe settlement agreement resolves five lawsuits filed by whistleblowers, who will collectively receive around .2 million out of the total settlement."Paying any type of illegal remuneration to induce patient referrals undermines the integrity of our nation's health care system," said Assistant Attorney General Jody Hunt. "When a patient receives a prescription for a device to treat a health care condition, the patient deserves to know that the device was selected based on quality of care considerations and not on unlawful payments from equipment manufacturers." 1679

SAN DIEGO (CNS) - San Diego Padres outfielder Tommy Pham has sued a Midway District strip club where he was stabbed last month.Pham, 32, was stabbed around 10:30 p.m. Oct. 11 outside Pacers Showgirls International by an unknown person or persons who took part in a fight that broke out in the club's parking lot.According to the lawsuit filed Tuesday in San Diego Superior Court, the fight outside Pacers left Pham "trapped" inside the club.The suit alleges the club's private security "escalated the risk" to Pham "by participating in the fight and antagonizing" the fight participants.The suit also alleges club employees did not contact law enforcement "or take any reasonable measures to mitigate" the dangers. Due to unspecified "incidents of violence by third parties" that had occurred at the club in the past, the lawsuit alleges Pacers should have been aware of the possibility of a similar incident and taken measures to prevent it.A representative with the club could not immediately reached for comment.Pham later tried to leave the club, and while walking toward the valet stand to get his car, he was attacked by someone who stabbed the major leaguer "without any provocation," the complaint states.RELATED: County demands Midway District strip club stop "live entertainment" over health ordersA statement released by the Padres shortly after the incident described Pham's injury as a non-life-threatening slash wound to his lower back, while the lawsuit alleges he suffered "catastrophic injuries, which have and will continue to cause him significant economic damage, including but not limited to his earning capacity as an elite professional baseball player."Police have not announced any arrests in connection with the stabbing.A hearing in the case is currently slated for June 25, according to court records. 1836

  

SAN DIEGO (CNS) - The city of Santee called on residents today to help it develop a brand to market the city to tourists, businesses and potential residents.Santee recently partnered with North Star Destination Strategies to develop a marketing brand for the city. To that end, the marketing agency launched an online survey for Santee residents to give feedback on the city's strengths, weaknesses and challenges. Responses to the survey are anonymous, according to North Star Destination Strategies."We have partnered with more than 250 communities across North American and I can't emphasize enough the importance of insights gleaned from community members," North Star Founder Don McEachern said.Residents can access the survey at the city's website and submit it electronically. The survey is also available in physical form at Santee City Hall. The surveys must be submitted by Sept. 2 to be considered."It is important for us to celebrate what we love about our community and share it with others," Santee Mayor John Minto said. SAN DIEGO (CNS) - The aircraft carrier USS Theodore Roosevelt will change its home port from San Diego to Bremerton, Washington, ahead of scheduled maintenance slated for next summer, the Navy announced Wednesday.The ship, which is currently deployed in the Western Pacific, will enter Puget Sound Naval Shipyard for scheduled maintenance known as docking planned incremental availability, or DPIA.Lt. Travis Callaghan said the maintenance required to maintain the Nimitz-class carrier's service life is more involved than what can be done pier- side in San Diego. DPIA involves putting the ship in drydock and will require facilities, equipment and personnel available in Bremerton, Callaghan said.The carrier recently resumed its scheduled deployment in the Indo- Pacific after spending months docked in Guam due to the widespread COVID-19 outbreak aboard the ship.The ship originally departed San Diego on Jan. 17 for a deployment, but was diverted to Guam on March 27 when the outbreak took hold, ultimately infecting more than 1,100 sailors, and killing one, Chief Aviation Ordnanceman Charles Thacker, 41.Navy officials said the carrier now operates with a new COVID-19 standard operating procedure, which modifies how crew members move through the ship, expands meal hours and establishes new social distancing procedures. 1337
