SAN DIEGO (KGTV) - A shopping trip in City Heights ended with a flurry of anti-gay slurs and a road rage assault.On Tuesday afternoon, Marco Aguirre spent an hour shopping, before heading back to his truck, parked in the 3700 block on University Avenue."I back out and lightly bump the car behind me," said Aguirre, 49.Aguirre says he saw two men emerge from an older-model, red sedan. Aguirre apologized, offering to show his insurance, but the men were agitated."The driver came on my side and the passenger came on the other side. Both of them were screaming," said Aguirre.With his cellphone, Aguirre, who is openly gay, capturing the profanities, including a string of anti-gay slurs. Aguirre was frozen. "I feel terrible. Panicked," said Aguirre.He says the slurs continued for about 15 minutes, before he decided to get out of the car to assess the damage."I see no damage to my truck and no damage to their vehicle," said Aguirre. Aguirre says when he stepped onto the sidewalk, he was attacked."One of the guys grabbed my phone and smashed it into the sidewalk. The same guy punched me in the face, under my left eye," said Aguirre. Aguirre says the two men got in the car and took off, leaving him with swelling under his left eye. The incident also left him determined to find the two men."It's not right. I need to take a stand. SAN DIEGO (KGTV) — An apparent SDG&E scam reported by a North County couple turned out to be an actual warning to evacuate, just not for them.The power company is calling a recent interaction with a Poway family a "misunderstanding," after the family believed they had been scammed by someone posing as the company.The Chavez family told 10News this week they received a phone call from someone saying they worked for SDG&E, telling them they needed to evacuate their home while work was being using a helicopter.The message said, “it requires a helicopter. The helicopter is required from the FAA to have certain properties, like yourself, evacuate the home.”ORIGINAL STORY: Family urging San Diegans to be aware of a possible new SDG&E scamAfter calling SDG&E to confirm, they were told there was no work going on in their area. The family believed they had been scammed. But it turns out, the phone call was true — for a different neighborhood.According to SDG&E, FAA does require residents to leave their homes when work is being done in their area requiring a helicopter and special construction.However, when the Chavez family called SDG&E, they didn't use the number the original caller provided. SAN DIEGO (KGTV) -- A state review board will decide Tuesday whether to grant parole to a former skateboarding star from Carlsbad who has spent nearly three decades behind bars for a brutal rape and murder.Mark “Gator” Rogowski was a world champion skateboarder in the 1980’s who drew comparisons to Tony Hawk. He parlayed his fame into endorsements and promotional videos until he entered a guilty plea to the 1991 rape and murder of Jessica Bergsten, whose body was found buried in the desert.“This was a horrific, heinous, monstrous crime by an individual who really doesn’t want to admit that he took out transferred rage on another innocent individual,” said Deputy District Attorney Richard Sachs, who will represent the state at Tuesday’s hearing.Rogowski was denied parole in 2011 and 2016, but his case was granted another review ahead of schedule, Sachs said. The parole board will determine if Rogowski remains a threat to the community based on a psychological assessment and other factors.In a promotional video by the prison rehabilitation non-profit Getting Out by Going In (GOGI), Rogowski said he’s taken accountability for the crime and found a higher power.“My identity as a man was skewed. I thought what it meant to be a man was to be a womanizer, to have a lot of relationships,” he said.In 1991, the former skateboarding celebrity invited Bergsten to his Carlsbad apartment. Bergsten was a friend of the girl who had just dumped Rogowski.In a fit of what he called “misplaced revenge,” Rogowski clubbed the young woman over the head, cut her clothes off with scissors and sexually assaulted her for hours. When she screamed for help, Rogowski covered her with a surfboard bag and strangled her through it. He then drove two hours into the desert and buried her naked body in a shallow grave.“Certain crimes are so horrible they shock the conscience and this is one of them,” Sachs said.Sachs said prosecutors will strongly oppose parole on public safety grounds, although he acknowledged he could not predict the board's decision. SAN DIEGO (KGTV) - A shark was seen off the San Clemente Pier Monday morning, prompting lifeguards to close a two-mile stretch of beach.Several witnesses saw the shark about 9 a.m.  It was estimated at nine feet long, lifeguards said. They did not know what type of shark it was.Few people were in the water because of cold temperatures and minimal surf, said officials.
