EL CAJON, Calif. - The grieving mother of an accused thief filed a lawsuit Thursday against the homeowner who shot and killed her son.The civil suit identifies the homeowner as Michael Poe, and it stems from an incident in the early morning hours of March 11. Police say the homeowner woke up to the sound of glass breaking. He went outside and found someone breaking into his work truck. His mother Monika Anderson said her son had a drug problem but was doing his best to stay sober.“He was on Suboxone, a drug to stay sober, and someone had stolen his Suboxone,” Anderson said. “Although it's really hard for me to imagine my son at  31 years of age would just start stealing, but I think he was just desperate for drugs and in a lot of pain. I don’t think he deserved to die over that.”Police are investigating the incident and no criminal charges have been filed. Anderson’s attorney, Dan Gilleon, said that investigation should not affect their civil lawsuit.“The bottom line is Joe shouldn't have died and at a minimum it's because this guy didn’t act reasonably,” Gilleon said. “This is not the Wild West. If you decide to play that gunslinger role, then you’re going to end up losing everything you own.”The lawsuit does not specify an amount.“It’s like a mother’s worst nightmare,” Anderson said in tears. “I told Joe, time and time again how much he meant to me.”Scripps station KGTV in San Diego has tried to make contact with Poe several times since the shooting happened, but have not heard back.   1759

EL CAJON, Calif (KGTV) -- A 26-year-old man accused of fatally stabbing a fellow Ramona resident during a fight at a gas station in their East County hometown pleaded not guilty Tuesday to a murder charge and was ordered held on million bail.    Jarrett Austin Wishnick is suspected of mortally wounding Steven Faught, 59, shortly before 6 p.m. Thursday near a set of fuel pumps in front of Stage Stop Liquors at 578 Main St.    Deputies responding to a report of an assault at the business found Faught bleeding profusely from a wound to his neck, sheriff's Lt. Greg Rylaarsdam said.    Paramedics airlifted the victim to a trauma center, where he was pronounced dead. Wishnick -- who remained at the scene of the deadly fight -- was treated for a hand injury before being booked into jail.    It was unclear what prompted the dispute between the men, both of whom had parked their vehicles in front of the gasoline pumps outside the store.    Faught's older brother, Jerry, flew to San Diego from Portland after the incident. He told 10News that his brother had a warm personality.  "Even though he had  very little, he'd give you the clothes off his back."    Wishnick will be back in court Nov. 20 for a bail review and on Jan. 16 for a readiness conference. A Feb. 1 preliminary hearing date was also scheduled.Wishnick faces 26 years to life in prison if convicted of murder and the use of a knife. 1490

Does undocumented immigration lead to more violent crimes? A study looking at the increase of illegal immigrants over 24 years says no.There's a stigma linking violent crime with illegal immigrants and part of that has to do with the spotlight on MS-13 gang arrests across the country and specifically in Lake Worth. But, a state-by-state study says an increase in undocumented immigration actually makes communities safer.The study was conducted by sociologists Michael Light of the University of Wisconsin at Madison and Ty Miller of Purdue University.The FBI's Uniform Crime Report statistics show Florida's violent crime rate over time and statistics from the Pew Research Center show the increase in undocumented immigrants.The study looked at those statistics from 1990 to 2014. In those 25 years, Florida's undocumented immigration was at its lowest in 1990 and its violent crime rate for those years was at its highest. Fast forward to 2007, the undocumented immigration population peaked in the state, and the violent crime rate had dropped by 40 percent and continued to decrease. The study echoes what many immigration advocates argue. "We don’t see a large criminal underground in Lake Worth. What we see are families struggling to get by," said Tim Gamwell, Executive Director of the Guatemalan-Maya Center which helps immigrant families. Big dreams hang up on the walls of the Escuelita Maya in Lake Worth, an after-school and VPK program run by the center.Hopefully, he is going to have a better life than other kids in my country," said Esmeralda about her son.Esmeralda came to the United States when she was five to escape crime in El Salvador.  "It's not an option to come here and be illegal, it's something that we have to do," she said. Getting involved in criminal activity could mean losing everything you've worked for. Patricia Vargas works with families at the Guatemalan Maya Center and said many are afraid of being deported. Gamwell said in some cases they don't even report when they are victims of crimes. "We've seen a history of that, where people are targeted because they have cash on them on payday," said Gamwell. Gamwell said the focus for the 600 plus families they serve in Lake Worth is making ends meet and providing for their children."The big issues are:  How do I educate my children? how to do I get access to a computer? How am I going to pay the rent this month? Not bailing someone out of jail," added Gamwell.  2559
