SAN DIEGO (KGTV) - A transgender San Diegan is calling for change when it comes to blood donation.Currently, the FDA’s recommendation to blood establishments is that in the context of the donor history questionnaire, male or female gender should be self-identified and self-reported for blood donation.Van Levy of Pacific Beach is non-binary transgender, meaning Van does not identify as male or female. Van goes by gender-neutral pronouns like 'they', 'them', 'their', or just Van.Van tells 10News when they reached out to the San Diego Blood Bank, they were told they would not be able to donate if they could not fully complete the donor history questionnaire, which has two gender-specific questions. Van was told if they cannot fill out 'male' or 'female' on the questionnaire they would not be able to donate blood. “It was really hurtful and painful, it reminded me we haven’t progressed as much as a lot of us like to believe we have, it just hurt," said Van. The two gender-specific questions are, in the past 12 months, have you:Male Donors: Had sexual contact with another male?Female donors: Had sexual contact with a male who had sexual contact with another male in the past 12 months?Helen Bixenman is Vice President of Quality and Regulatory Affairs at the San Diego Blood Bank. She's in charge of making sure blood from the San Diego Blood Bank is safe and pure, free from transfusion-transmitted infections. “It’s important for people to understand we have a wide range of questions, and these questions pertain to the safety of the donor as well as the safety of the blood products. They include medications, how you’re feeling, travel, risk behaviors," said Bixenman.She says they must adhere to the strict regulations and requirements of the FDA and AABB. She says if anyone fails to fill out the entire donor history questionnaire they will be turned away from donating blood.Van wants to see this regulation changed and believes it marginalizes a group of people who only want to help their community. “I definitely understand the rules and regulations that they have to adhere too and I think that there's ways to remove gender from the questions to get to same answers they’re seeking to protect people receiving blood," said Van. Bixenman says the San Diego Blood Bank does not want to turn people away from blood donation. She says this is the first time they've encountered the situation and that she would consider bringing the issue up to advocacy groups and the FDA. 2505

SAN DIEGO (KGTV) -- A San Diego native made history at the Ironman World Championships in Hawaii, becoming the first above-the-knee double amputee to finish what many consider the world's most grueling endurance race. Roderick Sewell crossed the finish line of the 140-mile triathlon race in 16 hours and 26 minutes and immediately embraced his mother. The two lived in San Diego homeless shelters when Sewell was growing up."It's amazing to see how far we've come in 20 years," said the 27-year-old.It's even more amazing when you consider that Sewell had never completed a marathon before Saturday's competition. The Ironman triathlon consists of a 2.4-mile swim, a 114-mile bike ride, and ends with a 26.2-mile marathon.On top of that, Sewell had only six months to train after receiving an invitation from the Ironman organization."I had no bike. I didn't own one" until a few months before the competition, said Sewell. Sewell raced with strategy help from his longtime friend and mentor Rudy Garcia-Tolson. Garcia-Tolson became the first above-the-knee double amputee to finish any Ironman 10 years ago."Back when I first met Roderick, he was about 8 years old. He was actually petrified of the water," Garcia-Tolson said. "Whatever life is throwing at you, mental or physical challenges, you have to fight and get over those and strive for better."Sewell, whose legs were amputated at 2 years old because he was born without tibias, credits much of his success to the San Diego-based Challenged Athletes Foundation. He was introduced to the group at 8 years old."I didn't do any kind of sports. I wasn't very physically active," he said. "And then I started with them and got started in every sport I could."CAF gave Sewell his first running blades at a time when he and his mother were living in homeless shelters."If I can inspire someone, it's a blessing," he said. SAN DIEGO (KGTV) - A senior "hero" leapt into action when she saw a man snatching a neighbor's package in the La Jolla area.On a quiet afternoon last week, Gillian Ackland was in her living room when she saw an unfamiliar white car park right in her cul-de-sac off Colima Street in Bird Rock."It felt kind of strange," said Ackland.Next door was a big package sitting outside her neighbor's door.MAP: Track crime happening in your neighborhood"The car suddenly starts backing up diagonally. I realize he's going for the package, and I run out the front door, saw him with the package and ran to his side of the car," said Ackland.Her neighbor's Ring camera captured it all. In the video, a man is seen walking up to the door, grabbing the big package and a smaller one. As he starts running to his car, so does Ackland, who yells, "That's not yours!" three times.He shoves the package in the back seat, but the door didn't fully close."There was adrenaline going," said Ackland.Ackland sensed her chance."I knew I had a few seconds and I could do something - and I did it," said Ackland.She opened the back door and tried to pull the package out. The package starts to fall out, but not far enough, as the car drives off. Ackland has no regrets."The injustice of all kept me going. I just felt it's not right, and I just thought I could get the package away from him," said Ackland.Another neighbor took a photo of the car showing an Uber sticker on the front windshield. Inside the package was a side table. She says the neighbor missing the package thanked her profusely. He told 10News she is a "superhero neighbor.""It's actually a little embarrassing," said Ackland.The video was shared on the "Neighbors by Ring" app."It's important that neighbors look out for each other. SAN DIEGO (KGTV) -- A San Diego woman has filed a claim against the San Diego County Sheriff’s Department after she says she was groped by one of their deputies.The complaint by the unidentified "Jane Doe" alleges that Deputy Richard Fischer "rubbed and fondled" her on Aug. 20, the San Diego Union-Tribune reported.It claims Fischer was sent to her home with another deputy about 3 a.m. for a welfare check, but he returned alone an hour later and asked to be let inside."Fischer lied to her and said he needed to use her restroom," the claim states. "Jane Doe let him into her home, but immediately realized the restroom claim was just a ruse to get in the house."It goes on, "Fischer told the woman he thought she was cute, hugged her for 10 seconds without consent and then rubbed his hands down her torso, shoulders, arms, back and buttocks. After the hug, he told her again he thought she was good looking, then hugged her again; the woman resisted more aggressively the second time.The woman has now filed a million claim against the San Diego County Sheriff’s Department.In response, the department has placed Deputy Fischer on administrative assignment.The department responded to the claim in part by saying, “…the department holds all of our employees to the highest standards and is in the process of conducting a prompt and thorough investigation into the allegations.”The woman says she has no surveillance video to back up her claim, but thinks the sheriff’s own technology will provide proof of her claim.The woman said when Deputy Fischer came back to her home, he arrived in one of the department’s marked vehicles, vehicles that have GPS monitoring.Among the allegations against the Sheriff's Department are sexual assault and battery, sexual harassment and infliction of emotional distress.Read the department's full statement below: "The Department has received a complaint and claim from a female adult alleging inappropriate hugging by Deputy Fischer.  The employee was immediately moved to an administrative assignment upon notification of the complaint.  The Sheriff's Department does not comment on pending criminal or internal investigations.  However, the department holds all of our employees to the highest standards and is in the process of conducting a prompt and thorough investigation into the allegations." 2372
