That's why the doctrine is criticized as a "catch 22."“That kind of ‘does this officer get the benefit of the doubt?’ type of inquiry gives judges just lots of room based on their interpretation, their view of whether this seems like a bad case or not, and it means that the judge is taking cases away from the jury based on their own views of the facts,” said Brandon Garrett, professor of law at Duke University.“The way to truly understand it is to look at in the context, as a lot of people are suddenly looking at it when police uses force, and particularly when it's deadly force,” said Aderson Francois, professor of law at Georgetown UniversityThe officers involved in a wrongful death lawsuit in Washington D.C. are expected to claim qualified immunity. In 2018, Marqueese Alston was shot and killed by police while running away. The court will only look at it from the perspective of police and if they reasonably feared for their lives.“What the court will not do is to ask did my client, a 22-year-old black man in DC have a reasonable fear for the police that caused him to run away in the first place,” said Francois.It's important to point out that officers do not personally foot the bill in these cases.“It's about the municipality, the county, the city,” said Garrett. “They're the ones who are paying. They're the ones who should be held accountable. After all, if this officer was poorly trained or didn't have the right support from colleagues, it's not the officer's fault necessarily.”Qualified immunity makes it so the constitutional issue is never addressed. Even if the doctrine disappears, it's still difficult to win a constitutional claim. 2335

NEW YORK (AP) — Stocks fell sharply on Wall Street Thursday as high-flying technology companies took a tumble after months of spectacular gains. The benchmark S&P 500 lost 3.5%, its biggest loss since June, and the tech-heavy Nasdaq fell 5%. Both indexes set record highs a day earlier. Apple, the most valuable U.S. company, slumped 8%. Big Tech companies have made outsize gains this year as investors bet that they would continue posting huge profits, even with many coronavirus restrictions still in place, as people spend more time online with their devices. Some worry those tech companies will be hit hard in a souring US-China relationship and any future tariffs, according to CNN. NOBLESVILLE, Ind. — The teacher whose actions stopped a shooting at Noblesville West Middle School om Friday said his actions were, in his mind, "the only acceptable actions."Science teacher Jason Seaman didn't say much Monday morning in his first press conference since the shooting on Friday. But what he did say only reinforced what many already know about Seaman: It's not about him. He brushed off credit for stopping the shooter, instead praising other teachers, students and the school resource officer at the school. "I want to make it clear that my actions on that day, in my mind, were the only acceptable actions I could've done given the circumstances," Seaman said. "I deeply care for my students and their well-being. That is why I did what I did that day."Police say Seaman, 29, tackled a student who started firing in his classroom Friday morning. He was shot three times during the incident, but released from the hospital Saturday. Ella Whistler, a student at the school, was shot Friday. Her family says she's doing well at Riley Hospital for Children."I can't say enough how proud of Ella I am and how we all should be," Seaman said. "Her courage and strength is nothing short of remarkable and we should continue to keep her in our minds as she continues to recover."After the press conference, Seaman honored at an Indiana Sectional Championship baseball game between Noblesville High School and Hamilton Southeastern High School. Noblesville Schools is selling T-shirts to raise money for Seaman and Whistler.
