SAN DIEGO (CNS) - A San Diego federal judge refused Tuesday to release 34 "medically vulnerable" detainees from the Otay Mesa Detention Center, which has the largest COVID-19 outbreak among the nation's U.S. Immigrations and Customs Enforcement facilities.U.S. District Judge Dana Sabraw previously ruled that a group of medically vulnerable detainees be released, in respose to a lawsuit filed by the American Civil Liberties Union alleging that overcrowded conditions at Otay Mesa put detainees at serious risk of contracting the virus.More than 200 people have tested positive at the facility since the outbreak began, including 57-year-old Carlos Escobar-Mejia, who became the first ICE detainee to die from COVID-19 earlier this month.While most of those detainees have been released since Sabraw's ruling, ICE was allowed to review their criminal histories, and decided that 34 among them should remain in custody "based on defendants' determination that they pose a danger to the community," the judge wrote.Sabraw ruled that while Otay Mesa still has the largest virus outbreak in the nation, the reduction in the facility's population and other factors have likely reduced the risk for those still detained.Sabraw's ruling denying a request for a preliminary injunction indicates the facility is currently at 38% capacity, and that the 34 detainees at issue are spread out throughout the facility.The judge wrote that 30 of those detainees are in housing units with no positive cases, "a stark contrast to the situation that existed before the TRO issued, where medically vulnerable detainees were being housed throughout the facility with other detainees who had tested positive."Sabraw wrote that the remaining four detainees are in a unit that is at 12% capacity. Three of the four detainees tested positive for COVID-19 before his TRO order was issued, but have since recovered. The fourth detainee "may be at increased risk, but other factors mitigate that risk," Sabraw wrote.The judge said Otay Mesa has taken measures to mitigate the risk of further spread, including suspending new detainee admissions, screening people who enter the facility, increasing sanitation, providing masks to detainees and requiring employees to use personal protective equipment.Additionally, Sabraw wrote that unlike the detainees previously released, the government had additional interest in "protecting the community," when considering the 34 remaining detainees.Earlier this month, Sabraw also denied a request from the ACLU to release medically vulnerable U.S. Marshals Service inmates from the facility, citing a law that limits the ability for inmates in criminal custody to file lawsuits in federal court, placing certain restrictions on inmate release requests when it concerns the conditions of their detention. 2826

SAN DIEGO (CNS) - A woman was killed in a chain-reaction crash triggered by a loose dog in lanes of state Route 94 near downtown San Diego today.Three cars were involved in the crash, which was first reported just after 10:30 a.m. on westbound Route 94 near 25th Street.A Ford F-150 owned by the San Diego Humane Society was parked in the median of the freeway with the driver and a passenger still inside, preparing to capture a dog when the animal ran into lanes of traffic, a California Highway Patrol dispatcher told City News Service.Multiple cars stopped and swerved, including a Toyota Camry with three occupants that braked and came to a stop in the No. 1 lane, the dispatcher said.A Dodge truck, also in the No. 1 lane, swerved into the median to avoid the Camry, and was struck in the right rear corner by a GMC Yukon towing a trailer that was unable to stop in time.The force of the impact pushed the Dodge into the Camry, which in turn pushed the Camry into the Humane Society pickup, according to the dispatcher.In the aftermath of the accident, it wasn't immediately clear how many cars were involved, but responding fire crews realized the Camry, which at some point had moved to the right shoulder of the freeway, was also part of the crash and launched a rescue operation for that car's occupants, according to a CHP incident log.A 53-year-old woman in the back seat of the Camry sustained a major head injury and was taken to Scripps Mercy Hospital, where she succumbed to her injuries, the dispatcher said.The woman's identity wasn't immediately released.Three other people, including two from the Camry and one from the GMC, 1652

SAN DIEGO (CNS) - A parolee who allegedly stabbed a pair of transients -- one fatally -- in two separate Midway District attacks on Thanksgiving Day was charged Friday with murder, attempted murder and assault with a deadly weapon. SAN DIEGO (CNS) - An outbreak of leptospirosis, a contagious bacterial disease, has been reported in dogs in the region, the San Diego County Health and Human Services Agency announced Thursday.Since October, 34 confirmed and probable cases of leptospirosis have been documented among local dogs, primarily in the Hillcrest and Mission Hills areas. Several dogs required hospitalization and at least one was euthanized.Boarding at kennels that allow dog-to-dog interaction is a major risk factor, though some ill dogs only had contact with other dogs at dog parks. The kennels that were linked to cases notified the owners of all potential contacts of diagnosed cases and closed for at least two weeks for cleaning and disinfection.Signs of leptospirosis in dogs are varied and can include fever, muscle weakness, vomiting, diarrhea, loss of appetite, low energy and frequent urination, which may be bloody.No human cases have been linked to this outbreak in dogs, but anyone who develops fever, headache, muscle aches -- especially in the back and calves -- or other illness after contact with a sick dog should see their health care provider.This week, the county sent a health advisory to local physicians and veterinarians about the outbreak.Leptospirosis is a disease caused by various species of spirochete bacteria called leptospira. These bacteria can infect multiple species of mammals, including humans, dogs, rats, mice, raccoons, skunks and opossums. The bacteria are shed in the urine of infected animals and may contaminate food, water, soil or bedding. Dogs and people can get infected through direct contact with skin abrasions, mucous membranes or by drinking contaminated water."When dogs visit kennels and parks and play, lick and sniff each other, they are at risk of getting these bacteria," said Dr. Wilma Wooten, the county public health officer. "If your dog shows any signs, you should take it to your vet immediately."A vaccine is available to prevent leptospirosis in dogs, especially for those boarding in kennels and frequenting dog parks. 2076
