VISTA, Calif. (KGTV) -- A Vista judge has dropped two charges against Gerardo Martinez Sr., a father arrested last week by San Diego County Sheriff's deputies. Martinez Sr. was facing two charges, felony resisting arrest, and lynching of an officer. The video surfaced last week. Martinez Sr. and his son, Gerardo Martinez Jr., arrested by five deputies. The family says the deputies used excessive force and that the two men were compliant and already in handcuffs. On Monday, the family demanded the department release body cam video and conduct an independent investigation. They also want to see the deputies involved prosecuted. The sheriff's department says they were called for a domestic dispute and that Martinez Jr. was armed with a knife. Deputies were also called to the home in late April for another incident involving Martinez Jr. The family's legal team did not address any questions about what lead up to the video but said Martinez Jr. has an issue with mental illness. They plan on filing civil lawsuits at the end of the week. The deputies in the video are on administrative duty as the investigation continues.   1186

VOLUSIA COUNTY, Fla. -- Michael Yager says he was outraged after learning his son, Jacob, bullied multiple classmates at New Smyrna Beach Middle School in Volusia County, Florida. "I figured I would teach him a lesson that would embarrass him and make him feel the way kids feel," he said.Wanting to teach his 13-year-old a lesson the frustrated father took an unorthodox approach. "I wrote the sign, I'm a bully. Honk if you hate bullies." Yager drove his son to nearby State Route 442 and parked him on a busy corner.His son had to hold the sign high."Embarrassed and kind of nervous," Jacob admitted.He says it did not take long for people to start honking.  Some even stopped to talk to father and son."I had Edgewater Police stop by, I had Volusia County Sheriffs. I had a good response from the neighborhood," Jacob's father said.But he acknowledged not everyone agrees with his parenting. "I had one woman come up and call me every name in the book. "How do you respond to parents who say putting your son out on the road is, in fact, bullying your own son?" he was asked."In my mind, I was doing the right thing, but I guess you cannot please everybody," Michael Yager said. A recent staggering statistic shows one out of every five students report being bullied. Jacob said he has learned a valuable lesson. "You never know what someone can be going through. VISTA, CA (KGTV) — The man accused of intentionally driving a U-Haul van into a crowd of people outside of an Encinitas bar, pleaded not guilty to serious charges in a Vista courtroom Wednesday.Christian Davis, 28, stood next to an attorney with his head down as he was formally charged with two counts of attempted premeditated murder, three counts of assault with a deadly weapon, and one count of felony driving under the influence of alcohol.Deputy District Attorney, Kim Coulter, said the incident early Sunday morning started at the Saloon and Shelter bar when Davis was kicked out.RELATED: Video shows driver slamming into crowd outside Encinitas bar"He was asked to leave because he was highly intoxicated and it was time for him to go," said Coulter.Once he was kicked out, Coulter said he got into a verbal argument with two bouncers, then threatened them."It escalated and culminated with Davis telling the security guards 'you're going to regret doing this, I’m going to come back and I’m going to kill you,'" she said.Moments later, witnesses saw the U-Haul heading for a crowd of people standing outside of the bars.RELATED: Man arrested after driving into crowd outside Encinitas barThe incident was captured on a passerby's dash cam video."He reversed out of a 7-Eleven and he came barreling down a sidewalk in front of Shelter bar, right into a crowd of people," said Coulter. "It’s our position that he used the U-Haul passenger van as a deadly weapon."Good Samaritans rushed to hold Davis in place until deputies arrived and arrested him. Sadly, two men who were outside of the bar at the wrong time were seriously hurt."A 25-year-old victim has had a severe injury to his leg, he’s had his third surgery today," said Coulter.The other victim, a 24-year-old, was also left hospitalized with severe injuries."He has two collapsed lungs, fractured ribs, a broken arm and he did spend time in the ICU," she said.Bail was set at million. (KGTV) — Vista Unified School District union workers say they are worried their jobs are on the line and say the district could be looking at bankruptcy.Union workers rallied Thursday ahead of a district board meeting over a million budget shortfall. Union President Bill Faust represents 1,400 support staffers at Vista Unified, including custodians, secretaries and food service workers who are concerned for their jobs since those are historically among the first to be cut. Faust says the board approved almost million to add unnecessary 8th periods to two high schools and another 1,000 to fire the district's superintendent two weeks ago. He says the board is spending money it doesn't have."We are concerned. With this board mismanaging funding," Faust said. "How are we are going to keep our job when they add add add and we don't have any money and you are looking at .5 million."10News reached out to the superintendent's office for comment but have not heard back.No decisions have been made as to where the cuts will come from. 1074
